Abstract

The 2022 National Social Security Council report reveals that 67.7% of Indonesian Migrant Workers (PMI) abroad are not enrolled in the BPJS Employment program, indicating the ineffectiveness of Republic of Indonesia Ministerial Regulation No. 18 of 2018. While social security is crucial for PMIs, the current regulatory framework falls short in ensuring comprehensive protection. In response, the Indonesian Government amended the regulation in 2023, resulting in Minister of Manpower Regulation No. 4 of 2023, aiming to enhance social security for PMIs. This research assesses the implementation of Minister of Manpower Regulation No. 4 of 2023, focusing on Hong Kong. Employing an empirical juridical approach with primary and secondary data, the study investigates the attitudes of Indonesian Migrant Workers in Hong Kong. The deductive approach is used to draw conclusions, with the study’s respondents being Indonesian Migrant Workers in Hong Kong. Despite the regulatory amendment, the findings reveal limited interest among Indonesian Migrant Workers in Hong Kong to register for government-provided social security. Reluctance stems from conflicting government regulations, as workers prefer employer-provided insurance. Consequently, Indonesian Migrant Workers express a preference for the non-mandatory status of BPJS Employment, hoping to rely on employer-provided insurance without compulsory enrollment.

Abstract

This article aims to examine legal protection for workers who are victims of sexual violence in the workplace, as well as the legal implications for perpetrators of sexual violence from the perspective of Criminal and Employment Law in Indonesia. The research method used is normative research. The research results show that legal protection for workers from sexual harassment is regulated in various existing regulations. One aspect that is regulated is the right of witnesses and victims to obtain security protection for themselves and their families, as well as freedom from threats related to the testimony they give. Furthermore, the procedures for resolving cases of sexual harassment in the workplace are limited to legal sources in the form of the Employment Law, through deliberation, negotiation, and if no agreement is reached, filing a lawsuit for termination of employment. This article finds that there is still a lack of focus in highlighting the importance of legal protection for victims of sexual harassment in the workplace to ensure their safety and comfort, including knowledge of the procedures for resolving these cases, in order to achieve optimal legal justice. Focusing on a better understanding of rights and related legal procedures is essential in ensuring adequate protection for workers who are victims of sexual violence.

Abstract

Perkawinan anak masih menjadi isu kompleks di Indonesia yang berlum terselesaikan hingga hari ini. Praktik perkawinan anak merupakan pelanggaran terhadap hak asasi anak yang berdampak buruk terhadap kesejahteraan hidup seorang anak. Berbagai upaya telah dilakukan termasuk merubah materi batas usia perkawinan melalui Undang-Undang No 16 Tahun 2019 tentang Perkawinan. Namun hal tersebut masih belum mampu menyelesaikan masalah perkawinan anak di Indonesia. Data Direktori Putusan Mahkamah Agung Republik Indonesia menunjukkan adanya lonjakan permohonan dispensasi kawin yang signifikan pasca disahkannya aturan baru terkait batasan usia menikah. Penelitian ini merupakan penelitian hukum normatif. Penelitian ini bertujuan untuk mengkaji dinamika hukum dan problematika penegakan hukum keluarga atas praktik perkawinan anak di Indonesia. Hasil penelitian menunjukkan bahwa dinamika perkembangan hukum terkait pembaruan batas usia minimum menikah hingga pengetatan syarat dispensasi kawin merupakan salah satu upaya pemerintah dalam menekan angka darurat perkawinan anak di Indonesia. Upaya perlindungan hak-hak anak atas praktik perkawinan di bawah umur juga telah dilakukan melalui program strategi nasional pencegahan perkawinan anak hingga langkah cepat berbagai daerah dalam membentuk aturan pencegahan perkawinan pada usia anak. Meskipun secara legal, batas usia menikah telah mengalami pembaruan namun kenyataanya praktik perkawinan anak tetap dapat ditemukan dengan mudah hal ini disebabkan karena masih lemahnya penegakan hukum keluarga di Indonesia. Dilema penegakan hukum terkait praktik perkawinan anak ini diantaranya disebabkan oleh realitass osial masyarakat Indonesia, disharmonisasi batasan usia dewasa, multitafsir atas frasa alasan mendesak.

Abstract

Tidak sedikit masyarakat Indonesia memilih bekerja di sektor informal, salah satunya menjadi pekerja rumah tangga. Sektor informal, pekerja rumah tangga selama ini belum ada payung hukum khusus yang mengatur terkait dengan hubungan kerja pekerja rumah tangga. Pada tahun 2004, rezim pemerintahan yang memegang kekuasaan sudah membuat Rancangan Undang-Undang Perlindungan Pekerja Rumah Tangga, namun sampai saat ini belum disahkan. Penelitian ini untuk mengetahui problem hukum perlindungan pekerja rumah tangga. Jenis penelitian yang digunakan adalah penelitian yuridis normatif dengan menggunakan data primer dan data sekunder, dengan teknik penarikan kesimpulannya menggunakan teknik induktif. Hasil penelitian menunjukan bahwa pekerja rumah tangga tidak diatur dalam Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, namun perlindungan pekerja rumah tangga diatur dalam Undang-undang Nomor 23 tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga, sehingga perluperaturan khusus yang mengatur tentang perlindungan dalam hubungan kerja pekerja rumah tangga mulai dari barometer cara perekrutan, pihak penyalur, pihak pemberi kerja, pihak pekerja, jam kerja, pelatihan kerja, menentukan beban kerja, upah, pengawasan, dan sanksi untuk para pihak yang melanggar.

Abstract

The arrangement of fixed-time employment agreements stipulated in the laws and regulations of the Republic of Indonesia is considered ineffective. One of the primary reasons is that some existing provisions are deemed inappropriate for labor-market needs. Several articles concerning work agreements have been removed from the Job Creation Law, but implementation issues remain. Both are concerned with the fulfillment of workers' rights and the types of work that are permissible for workers with specific worker statuses at specific times. This research uses a normative juridical method with a statutory and conceptual approach. The result of analysis indicates that any employment agreement must include legal awareness provisions. This is done to provide a more concrete measure of legal awareness, because everything in the employment agreement is the result of an agreement reached by both parties. If there are impediments to the exercise of rights that are not the result of deliberate reason, the settlement has also been arranged using local wisdom in the form of deliberation between the parties. If the provisions of the laws and regulations regarding the fulfillment of the parties' rights cannot be run optimally, this can be a solution to create harmonious industrial relations. The most important solution to establishing the rule of law in creating a harmonious working relationship is legal awareness in the implementation of fixed-time employment agreements.

Abstract

The tourism sector in Indonesia plays a significant role in the country's foreign exchange income. Optimizing this sector is seen as a way to stimulate various economic segments after the Covid-19 pandemic. However, the workers in this industry face multiple challenges in their employment relationships. Issues such as sub-minimum wages and excessive working hours are prevalent among workers in the hotel, restaurant, and travel agency domains. These problems indicate systemic obstacles within the industry. This study focuses on the Special Region of Yogyakarta and examines the legal intricacies within the employment relationships of its tourism sector. Specifically, it explores the Culinary and Cultural Services Sector associated with the Remains of the Tombs of Kings. The primary goal is to clarify the nuances of justice within employment relationships and scrutinize the alignment of rights for culinary service workers and royal grave attendants with Indonesian law or the presence of justifiable legal reasons for deviations. The research methodology involves comprehensive data collection through stakeholder interviews, summarizing diverse challenges in the field. Findings underscore persistent discrepancies, notably within certain restaurants that violate the stipulated minimum wage as per the Indonesian Job Creation Law through fixed-term or indefinite-term work agreements. On the other hand, the employment relationship of Abdi Dalem workers, safeguarding Kings' tombs, aligns with labor laws due to their casual daily worker status, justified by an intermittent work schedule that exceeds legal provisions. In conclusion, this research provides a nuanced understanding of the existing issues within the employment relationships of the tourism sector. It sheds light on both legal infringements and instances where deviations are substantiated by explicit legal rationales.

Abstract

There exists a normative disharmony between the Tax Court Law, the Judicial Power Law, and the General Provisions and Tax Procedures (KUP) Law, which adversely affects the independence and authority of the Tax Court in adjudicating tax disputes. This legal inconsistency generates juridical uncertainty regarding the Tax Court’s position within the Indonesian judicial system and the mechanisms for oversight of its decisions. This research aims to evaluate the current tax dispute framework in Indonesia and explore potential reforms by comparing the systems in the United States, Russia, and Australia. The research utilizes a This research is a normative legal research using a legislative, conceptual and comparative approach.  The study reveals that the independence of Indonesia’s Tax Court is weakened by dual oversight from the Supreme Court and the Ministry of Finance. Despite reforms aimed at improving autonomy, challenges such as case backlogs, prolonged proceedings, high litigation costs, and limited regional access remain. These findings highlight the urgent need for systemic reform. Drawing on international examples from the United States, Australia, and Russia, the integration of Alternative Dispute Resolution (ADR) mechanisms could significantly improve efficiency, fairness, and public trust in the tax system. Aligning the Tax Court fully under the Supreme Court and adopting ADR would strengthen institutional integrity.
