Abstract

Tidak sedikit masyarakat Indonesia memilih bekerja di sektor informal, salah satunya menjadi pekerja rumah tangga. Sektor informal, pekerja rumah tangga selama ini belum ada payung hukum khusus yang mengatur terkait dengan hubungan kerja pekerja rumah tangga. Pada tahun 2004, rezim pemerintahan yang memegang kekuasaan sudah membuat Rancangan Undang-Undang Perlindungan Pekerja Rumah Tangga, namun sampai saat ini belum disahkan. Penelitian ini untuk mengetahui problem hukum perlindungan pekerja rumah tangga. Jenis penelitian yang digunakan adalah penelitian yuridis normatif dengan menggunakan data primer dan data sekunder, dengan teknik penarikan kesimpulannya menggunakan teknik induktif. Hasil penelitian menunjukan bahwa pekerja rumah tangga tidak diatur dalam Undang-undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, namun perlindungan pekerja rumah tangga diatur dalam Undang-undang Nomor 23 tahun 2004 tentang Penghapusan Kekerasan dalam Rumah Tangga, sehingga perluperaturan khusus yang mengatur tentang perlindungan dalam hubungan kerja pekerja rumah tangga mulai dari barometer cara perekrutan, pihak penyalur, pihak pemberi kerja, pihak pekerja, jam kerja, pelatihan kerja, menentukan beban kerja, upah, pengawasan, dan sanksi untuk para pihak yang melanggar.

Abstract

The arrangement of fixed-time employment agreements stipulated in the laws and regulations of the Republic of Indonesia is considered ineffective. One of the primary reasons is that some existing provisions are deemed inappropriate for labor-market needs. Several articles concerning work agreements have been removed from the Job Creation Law, but implementation issues remain. Both are concerned with the fulfillment of workers' rights and the types of work that are permissible for workers with specific worker statuses at specific times. This research uses a normative juridical method with a statutory and conceptual approach. The result of analysis indicates that any employment agreement must include legal awareness provisions. This is done to provide a more concrete measure of legal awareness, because everything in the employment agreement is the result of an agreement reached by both parties. If there are impediments to the exercise of rights that are not the result of deliberate reason, the settlement has also been arranged using local wisdom in the form of deliberation between the parties. If the provisions of the laws and regulations regarding the fulfillment of the parties' rights cannot be run optimally, this can be a solution to create harmonious industrial relations. The most important solution to establishing the rule of law in creating a harmonious working relationship is legal awareness in the implementation of fixed-time employment agreements.

Abstract

The tourism sector in Indonesia plays a significant role in the country's foreign exchange income. Optimizing this sector is seen as a way to stimulate various economic segments after the Covid-19 pandemic. However, the workers in this industry face multiple challenges in their employment relationships. Issues such as sub-minimum wages and excessive working hours are prevalent among workers in the hotel, restaurant, and travel agency domains. These problems indicate systemic obstacles within the industry. This study focuses on the Special Region of Yogyakarta and examines the legal intricacies within the employment relationships of its tourism sector. Specifically, it explores the Culinary and Cultural Services Sector associated with the Remains of the Tombs of Kings. The primary goal is to clarify the nuances of justice within employment relationships and scrutinize the alignment of rights for culinary service workers and royal grave attendants with Indonesian law or the presence of justifiable legal reasons for deviations. The research methodology involves comprehensive data collection through stakeholder interviews, summarizing diverse challenges in the field. Findings underscore persistent discrepancies, notably within certain restaurants that violate the stipulated minimum wage as per the Indonesian Job Creation Law through fixed-term or indefinite-term work agreements. On the other hand, the employment relationship of Abdi Dalem workers, safeguarding Kings' tombs, aligns with labor laws due to their casual daily worker status, justified by an intermittent work schedule that exceeds legal provisions. In conclusion, this research provides a nuanced understanding of the existing issues within the employment relationships of the tourism sector. It sheds light on both legal infringements and instances where deviations are substantiated by explicit legal rationales.

Abstract

In Indonesia, child marriage is still a complicated problem that hasn't been handled. A kid's well-being is harmed by the practice of child marriage, which violates children's human rights. Several initiatives have been undertaken, such as amending Law No. 16 of 2019 regulating Marriage to change the minimum age for marriage. This, however, is still unable to address Indonesia's issue of underage marriage. The Republic of Indonesia's Supreme Court's Directory of Decisions reveals a notable increase in requests for marriage dispensation following the adoption of new laws of the legal age of marriage. This research is normative legal research. This study aims to examine the legal dynamics and problems of family law enforcement in the practice of child marriage in Indonesia. Based on the findings, the government is trying to lower the emergency rate of child marriage in Indonesia by enacting laws that tighten marriage dispensation procedures and refresh the minimum age of marriage. In addition to the national strategy program for avoiding child marriage, efforts have been made to safeguard children's rights against the practice of underage marriage through the swift formation of rules in various areas. Despite recent legal updates to the marriage age, child marriage is still a common practice in Indonesia because family law is not strictly enforced in the country. Among the factors contributing to the law enforcement conundrum surrounding child marriage are the social realities of Indonesian society, the discordance of adult age limits, and the many interpretations of the word urgent reasons.

Abstract

Child Labor is a serious problem that has attracted national and international public attention. The purpose of writing this article is to analyze in depth the review of the fulfillment of child Labor rights based on maqashid sharia. This article's research method uses a type of normative legal research using secondary data obtained through literature study. The collected data was then analyzed descriptively qualitatively using a conceptual approach, namely the concept of maqashid sharia. The results and findings in this article are that Islam places the fulfillment of children's rights as an important thing to realize. The general aim of Allah SWT in sending down the Shari'a is to bring about benefits. The basic concept of benefit is realizing benefits and preventing harm. The practice of child Labor is prohibited, because it conflicts with the five main principles of maqashid sharia, namely the protection of religion, soul, mind, property and descendant, which are primary needs (dharuriyyah) that must be fulfilled in humans. The priority of a child's age is to fulfill the rights of religion, soul, reason and heredity rather than fulfilling the need for wealth.

Abstract

Remittances generated by migrant workers, particularly those from Indonesia, play a significant role in supporting the economic stability of households and national economies. However, the magnitude of these contributions contrasts sharply with the limited legal and social protection available to migrant workers. This research examines the key factors underlying the persistent impasse in migrant worker protection policies within ASEAN and explores potential strategies for improvement through a comparative assessment of the European Union experience. Using normative juridical methods that combine conceptual, regulatory, and comparative analyses, the study evaluates ASEAN legal instruments and compares them with the European Union framework for protecting migrant workers. The analysis identifies three main causes of policy stagnation in ASEAN. First, the region lacks binding obligations that require member states to adopt uniform minimum standards. Second, existing enforcement mechanisms are weak and do not ensure consistent implementation. Third, member states resist the establishment of supranational authority, limiting opportunities for stronger regional governance. Despite these challenges, functional adaptation through the selective adoption of European Union practices offers viable options, including harmonizing minimum standards, establishing regional complaint procedures, and facilitating the portability of social rights. The research concludes that a gradual and priority based approach, especially for high risk sectors, can enhance migrant worker protection while remaining consistent with the principles of the ASEAN Way.

Abstract

Gaps in the protection of Indonesian migrant workers (PMI) in the pre-placement period. The fact that prospective migrant workers are increasing every year but are not supported by adequate and appropriate skills (Skill-Mismatch). The author has identified 6 factors that cause the ineffective protection of migrant workers that are not prepared to be strengthened during the pre-placement period, including: 1) Problem mindset 2) Discussion and communication obstacles 3) Mentality 4) Lack of understanding of labor law 5) Lack of cultural information about the country of placement and 6) Lack of financial and entrepreneurial literacy. The urgency of strengthening skills for CPMI students as ordered by the PMI Protection Law Number 18 of 2017 is important considering that the implementation of job training by the government through digital services or through government partners is currently not effective. Therefore, curriculum policy innovation is needed for CPMI students so that the above problems can be overcome as early as possible through learning according to skill needs so that CPMI students can receive longer, continuous and programmatic debriefing. This paper examines the gap in the protection of CPMI students during the pre-placement period and contributes thoughts related to the transformation of the AI- based curriculum towards zero skill-mismatch. This research method uses a type of normative law using a legislative approach and theories or expert opinions that are conceptual in nature that are integrated-interconnected. This paper explains that AI- based curriculum transformation requires multistakeholder collaboration. With an adaptive and predictive approach, AI can be a means of supporting skill strengthening for CPMI, in this case CPMI students in PMI enclaves in Indonesia

Abstract

Perkembangan teknologi digital yang pesat menuntut peningkatan literasi digital dan kesadaran akan keamanan informasi di kalangan generasi muda, khususnya di tingkat SMA. Tujuan dari kegiatan pengabdian ini adalah untuk memberikan pelatihan mengenai literasi digital dan keamanan informasi kepada guru dan siswa SMA Negeri 1 Sedayu. Metode yang digunakan dalam pelatihan ini adalah pendekatan workshop interaktif yang meliputi ceramah, diskusi, dan simulasi praktis. Materi yang disampaikan mencakup pengenalan terhadap literasi digital, ancaman siber seperti phishing dan malware, serta cara melindungi data pribadi di dunia maya. Hasil dari kegiatan ini menunjukkan peningkatan signifikan dalam pemahaman peserta mengenai cara melindungi informasi pribadi dan mengenali ancaman siber. Berdasarkan evaluasi menggunakan pre-test dan post-test, peserta mengalami peningkatan pengetahuan mengenai literasi digital dan keamanan informasi, dengan 100% peserta mampu mengidentifikasi ancaman siber setelah pelatihan. Pelatihan ini juga berhasil meningkatkan kesadaran peserta tentang bahaya kejahatan siber, seperti cyberbullying, serta langkah-langkah pencegahan yang dapat dilakukan. Kesimpulannya, pelatihan ini berhasil mencapai tujuannya dalam meningkatkan pemahaman dan keterampilan peserta dalam menghadapi tantangan dunia digital. Diharapkan pelatihan ini dapat menjadi model untuk kegiatan serupa di sekolah lain, guna menciptakan lingkungan digital yang lebih aman dan bijak di kalangan generasi muda.

Abstract

The central problem lies in the structural limitations of the asset recovery regime under the Anti-Corruption Law, which requires a criminal conviction for confiscation. This restriction has hindered full recovery of state losses, particularly in cases involving hidden or transferred assets and transnational challenges. The research aims to assess the paradigmatic nature of Indonesia’s asset forfeiture reform by analysing its conceptual transformation, constitutional legitimacy, and systemic coherence. This research employs a normative juridical method, relying on statutory, conceptual, and comparative approaches. The research reveals that, first, the shift from conviction-based forfeiture to non-conviction-based (NCB) forfeiture reflects an emerging transformation from offender-oriented justice toward asset-oriented justice. However, in Indonesia, this transformation remains transitional and has not yet restructured the philosophical and institutional foundations of asset recovery. Second, the comparative analysis demonstrates that the United Kingdom has successfully institutionalised civil recovery mechanisms within a strong framework of judicial oversight and proportionality, supported by human rights safeguards, thereby illustrating that effectiveness and constitutional protection are not mutually exclusive. Finally, Indonesia’s reform, while normatively progressive, still depends on harmonisation with constitutional guarantees and requires clearer standards of proof, differentiated procedural safeguards, and stronger institutional coordination to ensure systemic coherence and prevent abuse of power. The research recommends adopting a hybrid-restorative constitutional model of asset forfeiture. Such a model should provide limited autonomy for non-conviction-based confiscation, integrate early asset tracking and freezing mechanisms, apply differentiated standards of proof, and embed strict constitutional safeguards through effective judicial review and proportionality principles.

Abstract

The Indonesian labor market is shifting toward greater flexibility, driven by a surge in layoffs in the post-Covid-19 period (2020-2024), limited employment opportunities in the manufacturing sector, the demographic bonus, and the rapid expansion of platform-based industries and digital commerce. This shift has contributed to the rise of the gig economy, which has yet to provide adequate job security and decent working conditions. This paper examines the growing employment uncertainty within the gig economy and discusses how the government can respond through fairer and more responsive regulations to support a decent standard of living and sustainable worker welfare. This study employs a normative legal research method with legislative and conceptual approaches, relying on secondary data in the form of primary materials and scholarly literature from reputable academic sources. The findings indicate the need to revise labor laws, as mandated by Constitutional Court Decision No. 168/PUU-XXI/2023, which calls for the prompt enactment of a new Labor Law capable of providing holistic protection. Lessons from several developed countries highlight the need for regulatory synchronization both vertically, between laws and their implementing regulations, and horizontally, between the Manpower Law and other related policies. Labor regulations should cover both formal and informal workers through a work-life balance approach for all, with the aim of promoting fairness, welfare, and sustainable decent work. Thus, the framework of labour protection needs to be recalibrated to include gig workers.
