Abstract

Legal principles as basic norms are described as the basis / general guidelines forpositive law / applicable law. One of the legal principle problems that will be discussedby researchers in this research is about the application of principles that arenot in accordance with the reality that occurs in court. There are too many formalitiesthat are difficult to understand, and the rules are not clear, which allows for multiple interpretations and results in fear of proceeding in court. Too many formalitiesare an obstacle to the running of the courts. In this case the problem is notonly in the examination at trial, but also in the settlement of the examination reportat the trial until the signing of the decision by the judge and its implementation. Itoften happens that a case is delayed for years because the witnesses do not come, orthe parties in turn do not come or decide to withdraw from the case. In fact, there areseveral cases that were continued by their heirs. Meanwhile, in terms of costs incourt, the high court costs will cause interested parties to think again and againabout filing a claim to court. Based on this, it can be concluded that the speed withwhich the trial runs will increase the court’s authority and increase public confidencein the court.How to cite item: Shanty, W. Y. (2020). Abstract

On normative perspective, court upheld law based on the regulation and justice. Judicature was carried outfast, simple and cheap. However, in practice, judicature process always spent much time because of the formalprocedure. From entering the case to court until decision or finding of court which got the law confirmation, italways needed much time, complicated process, and much money. Especially for businessmen, case or longconflict would inflict financial loss. In business world, special skill was needed to decide special conflict inbusiness world which was not always known by every judge, for example contract. To be able to investigate anddecide those kinds of conflicts completely, it was not enough only having knowledge about regulation as thelaw principle. To make a business conflict completion reflected justice or it could be accepted by all parties, lawsystem gave alternative of conflict completion out of court. By this way, the burden of court was decreased andmore than that the completion which was the will meeting would not cause a new case. The character ofcompletion above became an alternative which had to be passed by all parties in conflict, especially businessconflict, to get the effective solution and to decrease or even to abolish conflict because of business.

Abstract

In fact, drugs are goods that are very useful for the benefit of many people's lives when used and used properly. However, in reality this is not the case, and not a few of these items are used inappropriately for their intended purpose or in other words, are misused and cause various negative aspects in the community. The purpose of this paper is to find out the criminogenic side of drug use that should not be carried out by the community, and to find out drug use among the community, which is actually not in harmony with social values, cultural aspects and negative factors in people's lives. The study in this paper contributes in overcoming the crime of drug abuse, in order to achieve the goal and to facilitate the understanding and implementation of handling drug problems using Pre-emptive, Preventive, and Repressive methods; and understand trends related to drugs, more specifically trying to contribute in solving the problem of drug abuse as part of the social pathology in people's lives.

Abstract

Desa Kepuharjo merupakan wilayah di Kecamatan Karangploso, Kabupaten Malang yang menjadikan tanaman obat keluarga menjadi salah satu potensi yang ada di desa tersebut. Banyaknya toga yang ditanam oleh masyarakat desa dapat dikembangkan menjadi suatu produk yang dapat mendongkrak perekonomian dan mengurangi pengangguran. Sudah sejak lama tanaman obat keluarga ditanam secara turun temurun dan diajarkan oleh generasi yang terdahulu ke generasi selanjutnya. Di Desa kepuharjo tradisi ini sebagian besar masih dipertahankan bahkan hingga sekarang hampir di setiap rumah/tempat tinggal warganya menanam tanaman obat keluarga. Bahkan desa ini merupakan desa percontohan dimana warganya mengembangkan dan membudi dayakan tanaman obat keluarga. Pengelolaan potensi desa yang dalam hal ini adalah tanaman obat keluarga diolah menjadi suatu produk yang dapat menghasilkan keuntungan lebih banyak dibandingkan apabila hasil panennya langsung dijual tanpa diolah terlebih dahulu. Tidak jarang mereka mengeluh dikarenakan hasil panen yang berlimpah dan tidak terjual habis maka terjadi penumpukan hingga membusuk. Jalan satu-satunya yang mereka tempuh adalah menjualnya kepada tengkulak dengan harga dasar sehingga mereka tidak mendapat keuntungan bahkan tidak jarang mengalami kerugian. Dengan demikian diharapkan akan membantu masyarakat dalam memperpanjang usia panen, mengembangkan desa menjadi desa swakarya dan industri kecil menengah yang mengelola hasil tanaman obat keluarga hingga menjadi produk olahan yang digemari masyarakat. Abstract

The Indonesian nation has a wealth of customs which form a strong identity in the lives of its people. One custom that has its own characteristics is the Toba Batak tradition, especially in terms of dividing inheritance. In the Toba Batak traditional inheritance system, the distribution of inheritance traditionally prioritizes sons. This is different from the provisions in the Indonesian Civil Code (KUHPerdata) which equalize inheritance rights between sons and daughters. This research uses empirical legal research methods which aim to examine the position of girls in Toba Batak traditional inheritance law in Malang City, as well as to identify factors that influence changes in perspectives on girls' inheritance rights. Apart from that, this research also seeks to understand the mechanism for resolving traditional inheritance disputes carried out by Toba Batak traditional leaders. The research results show that although the Toba Batak community in Malang City still adheres to a patrilineal system, there has been significant development in recognizing the inheritance rights of girls. Girls are now starting to get equal inheritance rights with boys, especially for property obtained from their own hard work. Efforts to resolve traditional inheritance disputes by Toba Batak traditional leaders in Malang City also show an effort to bridge traditional values with modern realities, creating harmony between customary law and state law.

Abstract

The digitization era in Indonesia has brought about rapid technological advancement, leading to an increase in digital or electronic forms of human activities, particularly in land-related activities. To avoid land disputes, it is essential to ensure legal certainty regarding land rights status. This is achieved through electronic land registration carried out by the National Land Agency (BPN). Article 2 of the Regulation of the Minister of Agrarian Affairs/Head of BPN No. 1 of 2021 outlines the implementation of electronic land registration. This research aims to analyze the implementation of Article 2 of Regulation of the Minister of Agrarian Affairs/Head of BPN No. 1 of 2021 by the National Land Agency (BPN) of Malang Regency and identify the challenges faced by BPN Malang Regency in implementing the regulation. This research employs an empirical legal research method, which examines the effectiveness of law within society. The findings indicate that electronic land registration at the National Land Agency (BPN) of Malang Regency has been gradually progressing, with thirty thousand lands already registered. Challenges encountered include insufficient human resources, a significant portion of the population lacking technological literacy, and concerns regarding cybercrime and electronic certificate forgery.

Abstract

This research focuses on adoption cases where prospective adoptive parents carry out the adoption process without obtaining a court decision, which contradicts the stipulations of Article 20 paragraph (1) PP Number 54 of 2007. According to this provision, child adoption must be formally conducted through a court order. The main objectives of this study are to determine the legal status of adoptions conducted without a court order and to examine the legal protection available to adopted children whose adoptions have not undergone a court process, particularly in terms of their rights and obligations within the adoptive family. The research employs the normative legal method, utilizing the statute approach and the case approach to address the problem at hand. A literature study is conducted to collect relevant data, and qualitative methods are employed to analyze the legal materials. The findings of the research highlight that adoptions carried out without a court order lack legal standing, leaving adopted children without adequate legal protection, especially concerning their rights and obligations in the adoptive family. The court's involvement in the adoption process is crucial to establish a proper legal status for the adopted child and to ensure their legal protection, particularly regarding their rights and obligations within the adoptive family.

Abstract

The Brantas River area in Malang City, East Java, has experienced a decline in water quality due to domestic waste. Many residents living along the riverbanks rely on the river as a primary water source, despite the deteriorating environmental conditions. Therefore, an in-depth study is needed on the policies and programs implemented by various related institutions using the Gender Analysis Pathway (GAP). This study examines gender mainstreaming (PUG) policies and programs adopted by government institutions in Malang City, particularly in the areas of waste management and water quality, as well as the implementation of PUG within communities residing along the Brantas River. This research is classified as empirical legal research, as it evaluates the implementation of regulations, policies, and gender mainstreaming programs within relevant agencies. The findings indicate that: (1) The implementation of PUG programs within government institutions in Malang City has not been maximized, as each department carries out programs based on its specific duties and responsibilities. (2) The implementation of PUG within communities along the Brantas River has not been carried out, as evidenced by the lack of gender-related socialization from government agencies. Additionally, community needs, such as waste bins, have not been effectively communicated to the government. There is also a desire among residents to independently measure the quality of well water, but they lack the necessary knowledge to do so. The community has expressed a willingness to learn and conduct independent water quality assessments. (3) The challenges in implementing PUG at the community level are evident, as residents lack awareness and understanding of gender-related issues, making it difficult to develop programs using gender-based indicators.  Keywords: Policy, Gender Mainstreaming, Environment
