Abstract

This study aims to examine the prohibition of Pecoah Kohon in the indigenous marriage Rejang tribe. Pecoah Kohon is a union between a man and woman related by blood, namely one grandmother. In this study, the problem emphasized a customary prohibition on the union, regardless of its non-prohibition by Islam. This qualitative-field analysis used a normative-sociological approach, with the implemented data collection techniques prioritizing interviews and documentation. A purposive sampling technique was also used to determine the informants. The results showed that the survival of Pecoah Kohon tradition was due to the socialization carried out by traditional officials in a systematic, structured, and hierarchical pattern toward the Rejang community. Sanctions were also considered quite strict against customary violations. Moreover, the good communication and cooperation between traditional officials and the community was a strong foundation for the preservation of Pecoah Kohon tradition and the Islamic religious insights of the Rejang community were increased. From this context, the debate about the tradition had various meeting points and solutions. This indicated that Pecoah Kohon supporters believed the tradition did not include prohibitions and cancellations of marriage, with its performance considered a tribute and cultural preservation. Religious experts also understood that Pecoah Kohonwas solely a custom and not a belief exceeding or equalling religion, indicating needless argumentative efforts.

Abstract

Abstracts: This research aims to explore the provisions and practices of inheritance distribution in the Pekal tribe in Ipuh District, Mukomuko Regency, and its relevance to the concept of ‘urf. The method used is qualitative research with a descriptive approach. The results show that the inheritance distribution system in the Pekal tribe is conducted through family deliberation, with the types of inheritance divided into three categories: hareto pamawu (personal assets), hareto sakutu (joint property), and hareto pamehi (gift property). The heirs entitled to receive the inheritance include the children and the wife of the deceased, while the parents are not included in the list of heirs. The practices of inheritance distribution in the Pekal tribe indicate both alignment and misalignment with Islamic law. Practices that align include distribution based on consensus (qismah tarâdî) and the acknowledgment of parental gifts as part of the inheritance. On the other hand, practices that do not align with Islamic law include not granting full ownership rights to the heirs' spouse and excluding the heirs' parents from the list of heirs, equal shares between sons and daughters, and the existence of inheritance that is not distributed. These findings emphasize the need for a reassessment of inheritance distribution practices in the Pekal tribe to achieve alignment with the principles of Islamic law.Keywords: Inheritance, 'urf.  Abstrak: Penelitian ini bertujuan untuk mengeksplorasi ketentuan dan praktik pembagian harta warisan pada Suku Pekal di Kecamatan Ipuh, Kabupaten Mukomuko, serta relevansinya dengan konsep ‘urf. Metode yang digunakan adalah penelitian kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa sistem pembagian warisan di Suku Pekal dilakukan melalui musyawarah keluarga, dengan jenis harta peninggalan terbagi menjadi tiga kategori: hareto pamawu (harta bawaan), hareto sakutu (harta bersama), dan hareto pamehi (harta pemberian). Adapun ahli waris yang berhak menerima warisan meliputi anak dan istri pewaris, sementara orang tua tidak termasuk dalam daftar ahli waris. Praktik pembagian harta warisan pada Suku Pekal menunjukkan adanya aspek yang selaras dan aspek yang tidak sesuai dengan syariat Islam. Praktik yang sejalan meliputi pembagian berdasarkan kesepakatan (qismah tarâdî) dan pengakuan terhadap pemberian orang tua sebagai bagian dari warisan. Di sisi lain, praktik yang tidak sejalan dengan syariat mencakup: tidak memberikan hak kepemilikan mutlak kepada pasangan pewaris, orang tua pewaris tidak termasuk ke dalam daftar ahli waris, penyetaraan bagian antara anak laki-laki dan perempuan serta keberadaan harta warisan yang tidak dibagikan. Temuan ini menegaskan perlunya pengkajian ulang terhadap praktik pembagian harta warisan di Suku Pekal untuk mencapai keselarasan dengan prinsip-prinsip syariat.Kata Kunci : Waris, ‘urf.
