Abstract

Notaris merupakan pejabat publik yang memiliki peran sangat besat dalam mengakomodasi perbuatan hukum sesuai dengan yang sudah diatur dalam UU Nomor 2 Tahun 2014 yang dilakukan oleh masyarakat sesuai dengan tuntutan zaman. Notaris dapat dikatakan sebagai profesi pejabat yang membuat dokumen tekuat dan terpenuh dalam pemenuhan bukti secara otentik atau sempurna yang dilakukan untuk proses penegakan hukum. Notaris dalam menjalankan profesinya diwajibkan untuk menyesuaikan dan mengikuti perkembangan di era globalisasi dikarenakan keterkaitannya mengenai hal—hal yang menyangkut tentang perdata seperti transaksi-transaksi yang terjadi dan dilakukan melalui sarana elektronik dan banyak dilakukan secara online, serta semakin banyak mengalami perkembangan dan saling terintegrasi satu sama lainnya, sebagai contoh adalah hubungan antara Kementrian Hukum & HAM yg terintegrasi dengan Kementrian Koordinator Bidang Perekonomian, hubungan ini terintegrasi melalui sistem perizinan terbaru yaitu OSS (Online Single Submission) sesuai dengan PP Nomor 24 Tahun 2018. Kemajuan informasi yang berkembang pesat ini bisa menjadi bumerang sekaligus menjadi tantangan tersendiri bagi keberadaan dan eksistensi notaris. Terdapat aturan yang diwajibkan dituangkan dalam bentuk akta notaris, dan jika hal ini tidak dilaksanakan atau tidak dituangkan dalam bentuk akta yang dibuat oleh notaris, maka kegiatan dan/atau transaksi itu dianggap tak memiliki kekuatan hukum. Ini menunjukan terdapat hubungan hukum antara keperdataan di masyarakat dengan notaris, termasuk hubungan dalam bidang ekonomi. Dengan demikian akan menimbulkan permasalahan bagaimana kedudukan hukum atas akta notaris dalam perizinan usaha terbaru bagi dunia kenotariatan?Keywords: Profesi Notaris, Era Transedental, Transendensi Pancasila, OSS.

Abstract

Sumber daya alam di Indonesia secara garis besar dibagi menjadi empat, yakni: bumi, air, mang angkasa, dan kekayaan alam yang terkandung di dalamnya. Amanat Pasal 33 ayat (3) UUD NRI 1945 untuk mengelola sumber daya alam tersebut untuk dipergunakan sebesar-besarnya untuk kemakmuran rakyat. Fakta yang terjadi, pendistribusian sumber daya agraria tidak seimbang dan belum mencerminkan keadilan sosial. Dalam hal ini perlu dilakukan pembaharuan hukum agraria nasional yang berkeadilan sosial.

Abstract

This activity discusses the implementation of electronic land certificates as part of the digital transformation in Indonesia's land administration system. The transition from a manual to an electronic system presents various challenges, particularly in terms of accessibility, potential land disputes, and data protection. To address these obstacles, community service activities were carried out using a normative approach and case studies, targeting economically productive communities and vulnerable groups. The program's success was measured through several indicators, including increased legal awareness, the number of active users of the system, a reduction in land disputes, and compliance with data protection standards. This activity was held in Sukajaya Village, Sumedang Regency, West Java, on Friday, January 17, 2025, with participants consisting of village officials and residents of Sukajaya. The results indicate that synergy between clear legal regulations, continuous community assistance, and adequate technical support is the key to the successful implementation of electronic land certificates.

Abstract

The government issued a Government Regulation on the Implementation of Mineral and Coal Mining Business Activities, which regulates the offering of Special Mining Business Permit Areas on a priority basis to business entities owned by religious community organizations. The method used is normative juridical supported by empirical data, a case approach based on developing news media. Data collection techniques through secondary data, with qualitative juridical analysis. The results of this study are first, the legal policy of granting mining business permits to religious community organizations based on the Government Regulation on the Implementation of Mining Business Activities has contradicted the Mineral and Coal Mining Law. The priority offer in the law is addressed to BUMN and BUMD, while in the government regulation it is addressed to religious community organizations, which is a constitutional problem; second, the existence of guarantees in environmental management for religious community organizations as holders of mining business permits requires compliance with these business entities with environmental management instruments. In addition, it will test the consistency of religious organizations' understanding of the concept of environmental preservation in practice or business actors carrying out mining activities.

Abstract

Business law in Indonesia is predominantly shaped by the civil law tradition of continental Europe, resulting in regulations that often overlook local needs and values. The uncritical adoption of foreign legal norms has marginalized indigenous legal traditions, which historically embody principles of ethical commerce and community-based practices. This misalignment between formal regulation and local business conduct creates legal uncertainty, discourages domestic investment, and undermines the competitiveness of local entrepreneurs. To address these challenges, business law reform must integrate cultural values such as consensus-based decision-making (musyawarah), mutual cooperation (gotong royong), distributive justice, and social responsibility, while remaining adaptive to globalization and economic liberalization. Employing a normative legal research method with conceptual and statutory approaches, this study analyzes the integration of local wisdom into business law to strengthen inclusivity, contextual relevance, and sustainability. The findings are expected to contribute theoretically and practically to a national business law framework that not only reflects Indonesia’s constitutional identity but also preserves local culture and reinforces grassroots economic sovereignty.

Abstract

The massive spread of hoaxes through social media has become a serious challenge in Indonesia, as it not only disrupts individual understanding but also threatens social harmony and legal certainty. This community service program, organized by the Women’s Empowerment Forum (FPPI) Bali Province, aimed to raise public awareness of the dangers of hoaxes while providing legal knowledge regarding the consequences faced by those who disseminate false information. The program was carried out through a combination of legal counselling and participatory communication campaigns with a local cultural approach. The legal counselling materials included the regulatory framework governing hoaxes, their social impacts, and strategies for early detection and prevention. Meanwhile, the communication campaign utilized posters, infographics, digital content, as well as cultural expressions such as traditional poetry (pantun) and Balinese performing arts, making the legal messages easier to understand and more engaging. Participants, consisting of women, youth, students, and community leaders, were actively involved in discussions, simulations, and group campaigns. The results of the program indicated an increased understanding among participants regarding the legal implications of spreading hoaxes and improved ability to identify misleading information in the digital sphere. This program demonstrates that participatory community-based strategies, when combined with legal literacy and cultural communication, can strengthen both digital awareness and social resilience against hoaxes. The initiative also reflects the role of higher education institutions in fulfilling the Tri Dharma of universities through legal education, community empowerment, and the promotion of responsible digital citizenship.

Abstract

The politics of agrarian law in Indonesia plays a crucial role in shaping the fate of indigenous peoples’ communal land rights (hak ulayat). Although the recognition of such rights is enshrined in the Constitution and several statutory regulations, their implementation remains limited. Regulatory disharmony, the absence of formal recognition of customary territories in many regions, and the stagnation of the Indigenous Peoples Bill (RUU Masyarakat Adat) reflect the state's weak commitment to protecting indigenous rights. Using a normative legal approach and analysis of relevant court decisions and policies, this article concludes that meaningful protection of hak ulayat requires agrarian policy reform rooted in social justice and legal pluralism.

Abstract

Indonesian Migrant Workers (Pekerja Migran Indonesia-PMI) constitute a vulnerable population that frequently encounters family-law problems, particularly marriages that are religiously valid but not formally registered. From a legal standpoint, marriage registration is mandatory as an instrument to ensure legal certainty and family protection. In practice, however, many PMI marriages abroad remain unregistered due to limited access to legal information, cross-border administrative barriers, institutional fragmentation, and jurisdictional differences. This situation creates legal uncertainty regarding the status of spouses and children, obstructing the fulfillment of civil rights, access to public services, and family-law protections, thus undermining the state’s mandate to protect PMI and their families. This cross-border Community Service Program (Pengabdian kepada Masyarakat-PKM) aims to bridge the gap between legal norms and lived realities through an integrated itsbat nikah (judicial marriage validation) service model implemented in Kuching, Malaysia. The program employs a socio-legal approach using a participatory community-engagement design combined with applied doctrinal legal research. Data were collected through regulatory review, field observation, limited interviews with PMI and stakeholders, and administrative and legal assistance. Qualitative analysis connected the regulatory framework of marriage, civil registration, and migrant-worker protection with legal service delivery and the social impacts experienced by migrant families. The program’s outcomes indicate that an integrated itsbat nikah model enhances legal certainty for PMI families through judicial validation of marriage and the integration of legal documentation into civil registration processes. The program recommends strengthening cross-border integrated legal services and updating technical policies to better address the structural vulnerabilities of PMI as part of broader efforts to expand access to justice.

Abstract

The mepasah burial tradition practiced by the Bali Aga community in Terunyan Village, Bali, represents a distinctive form of local wisdom in treating the deceased through open-air placement without burial or cremation. This tradition is grounded in customary village law (awig-awig) and sustained through transcendental communication that constructs symbolic relationships between humans, ancestors, nature, and the local cosmological order. In contemporary social developments, the continuity of the mepasah tradition faces increasingly complex socio-legal challenges, including the declining internalization of awig-awig values among younger generations, the emergence of social friction due to differing interpretations of customary norms, and unequal relations between indigenous communities and external actors, particularly the tourism sector and state institutions. These challenges are exacerbated by the limited operationalization of formal recognition of customary village law within public policy practices, resulting in the marginalization of customary norms when confronted with positivist-oriented health and environmental regulations. This Community Engagement Program (Pengabdian kepada Masyarakat/PKM) focuses on strengthening the customary law of Terunyan Village by positioning transcendental communication as a source of normative and cultural legitimacy in the implementation of burial traditions. The program employs a participatory socio-legal approach through the review of awig-awig, participant observation, focus group discussions (FGDs), and in-depth interviews with customary leaders and community members, in line with the constitutional recognition of indigenous communities under Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia and the recognition of customary villages under Law Number 6 of 2014 on Villages. The novelty of this program lies in the design of a customary law strengthening model that integrates transcendental communication as a mediating mechanism between customary norms, the state legal framework, and external tourism pressures. The implementation results demonstrate increased collective legal awareness, strengthened social legitimacy of customary village law, and the formation of transcendental communication patterns that function as mechanisms for social conflict resolution and strategies for customary preservation. These findings affirm that the sustainability of local traditions in Bali requires a harmonious integration of customary law, community social dynamics, and transcendental communication as the foundation of equitable customary village governance.
