Abstract

This research aims to determine the potential for implementing Payment Postponement (PKPU) when the economy is sluggish and to find out the challenges faced by business entities. By using a normative juridical approach with a philosophical and conceptual perspective, this research reveals critical insights. These findings underscore the important relationship between PKPU and bankruptcy as a reasonable solution for debtors experiencing difficulties. However, in this solution there are latent risks that can be detrimental. Therefore, the debtor's careful behavior is very important in dealing with this dangerous situation. This research emphasizes that the option to carry out debt restructuring or financial restructuring carries relatively lower risks for debtors, thereby placing them in an advantageous position. Instead, PKPU appears as a viable solution, although it is best done as a last resort. This research highlights the dynamics that exist around the use of PKPU, highlighting the potential as well as the associated risks. The report advocates informed decision-making among debtors, by emphasizing the importance of choosing debt settlement strategies with the least risk.

Abstract

Perkembangan teknologi, terutama internet dan media sosial, telah memberikan dampak besar terhadap hak cipta, mempermudah akses dan distribusi karya seni, namun juga meningkatkan pelanggaran hak cipta. Penelitian ini bertujuan untuk menganalisis pengaruh teknologi terhadap perkembangan hak cipta dan dampaknya terhadap pelanggaran yang terjadi, serta untuk mengevaluasi efektivitas regulasi yang ada. Metode yang digunakan adalah yuridis normatif dengan pendekatan kepustakaan untuk menganalisis norma hukum terkait perlindungan hak cipta dalam era digital. Hasil penelitian menunjukkan bahwa meskipun ada regulasi seperti Undang-Undang Hak Cipta dan Peraturan Pemerintah tentang Royalti, penegakan hukum masih terbatas karena adanya kesenjangan antara hukum positif dan dinamika teknologi. Implikasi dari temuan ini adalah perlunya reformasi regulasi yang lebih responsif terhadap perkembangan teknologi, seperti memasukkan platform digital seperti YouTube dalam kategori layanan publik yang wajib membayar royalti. Selain itu, penerapan hukum progresif sebagai solusi dalam mengatasi kelemahan sistem hukum yang kaku juga sangat diperlukan untuk memberikan perlindungan yang lebih efektif bagi pencipta di era digital. Penelitian ini mengusulkan adanya pembaruan regulasi dan penerapan teknologi baru seperti blockchain untuk meningkatkan transparansi dan efisiensi dalam pengelolaan royalti.

Abstract

Dalam hal perlindungan konsumen, perhatian yang serius dari berbagai pemangku kepentingan sangat diperlukan, termasuk pelaku usaha, pemerintah, dan konsumen itu sendiri. Perlindungan konsumen menjadi tolok ukur efektivitas kegiatan usaha dan perdagangan di suatu negara sesuai dengan ketentuan yang berlaku. Salah satu kewajiban pelaku usaha adalah mencantumkan tanggal kadaluwarsa pada kemasan produk, sebagaimana diatur dalam Pasal 6 Peraturan Badan POM Nomor 31 Tahun 2018 tentang Label Pangan Olahan. Penelitian ini menggunakan pendekatan hukum normatif dengan data sekunder yang bersumber dari literatur, serta pendekatan perundang-undangan. Rumusan masalahnya mencakup kewajiban pelaku usaha terhadap pengedaran obat kadaluwarsa dan perlindungan hukum bagi konsumen. Hasil analisis menunjukkan bahwa tanggung jawab hukum perlindungan konsumen terhadap produk obat kadaluwarsa diwujudkan melalui ketentuan yang ditetapkan oleh Badan Pengawas Obat dan Makanan (BPOM), yang berfungsi di bawah Badan Pengawas Perlindungan Konsumen. Peraturan Presiden Nomor 80 Tahun 2017 menjadi landasan hukum bagi BPOM, yang bertujuan untuk mengoordinasikan pengawasan obat dan makanan sesuai standar yang ditetapkan. Ini mencakup penyusunan kebijakan, norma, dan prosedur pengawasan pra dan pasca peredaran, serta penetapan ketentuan teknis untuk standar obat. Dengan demikian, perlindungan konsumen dapat semakin dioptimalkan melalui regulasi yang ketat dan pelaksanaan yang disiplin.

Abstract

This research aims to analyze three legal issues related to the provisions within Law No. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations (UUK-PKPU), namely the short duration of the Postponement of Debt Payment Obligations (Penundaan Kewajiban Pembayaran Utang/PKPU) time limit, the provisions regarding time limit constraints as a cause of the failure of debtor's reconciliation efforts with creditors, and legal protection for the debtor's interests to prevent bankruptcy. This study adopts a normative juridical research method relying on secondary data and literature studies. This normative system includes principles, norms, regulations, court decisions, agreements, and doctrines that represent the views or teachings of legal scholars. The research findings indicate that PKPU aims to provide protection to creditors and offer debtors the opportunity to propose reconciliation regarding their debts. Although the time limit is not the determinant of the failure of reconciliation efforts, it does influence the achievement of the PKPU process. The debtor's weak bargaining position and the inability to reach an optimal reconciliation agreement are major concerns. UUK-PKPU provides legal protection for debtors, but the tight time limit may hinder the achievement of PKPU objectives. The implications of this research highlight the need for further review of PKPU time limit provisions to support the effectiveness of reconciliation efforts and protect debtor interests in avoiding bankruptcy.

Abstract

Peace agreement in Delay of Debt Payment Obligations (PKPU) offers ways to pay all or part of the debt as an effort to avoid bankruptcy, so that the peace is legally valid and binding on the parties, it requires ratification of the peace from the Commercial Court. However, in practice, it was found that there were delays in ratifying the peace agreement that had been agreed to by the parties due to reports that had not been submitted by the management during the PKPU period. The focus of the research is to identify the legal consequences of delaying the approval of the peace agreement on debt settlement of the debtor. The method used is normative juridical with descriptive analysis. Secondary data sources are used, involving legal materials related to primary legal materials and providing explanations for them. Secondary data sources include books, journals, papers, reports, scientific papers, and undergraduate research results in the field of law. Apart from that, tertiary legal materials are also used as additional references, such as articles, books or papers. The results of the research show that delays in ratifying peace agreements that violate statutory provisions have the potential to create legal uncertainty and can lead to debtor bankruptcy. The research conclusion emphasizes the importance of maintaining compliance with legal procedures in PKPU in order to achieve legal certainty for all related parties.

Abstract

Intellectual Property Rights (IPR) play a crucial role in the creative economy, and the state must provide legal protection for intellectual property as a form of appreciation for creators/inventors for their efforts and hard work in producing new innovations, while minimizing intellectual property infringements. In practice, there are several challenges and difficulties in enforcing laws related to Intellectual Property Rights (IPR). This research aims to explore the role of IPR in supporting the development of the creative economy in Indonesia. The research method applied is the normative legal research method. This approach explores information from written regulations and legal literature related to IPR in Indonesia. The data used is secondary data obtained through literature studies. The conclusion of this research indicates that IPR protection plays a central role in supporting the ecosystem of the creative economy. However, challenges such as the lack of awareness among the public and creators about the importance of protecting intellectual property, as well as deficiencies in regulations supporting the protection of traditional knowledge, need to be addressed. Collaborative efforts between the government, creative industry stakeholders, and the public are necessary to ensure optimal enforcement of IPR and promote sustainable growth in Indonesia's creative economy.

Abstract

The concept of progressive law is placed in a sociological perspective where law is directed to serve the interests of society. This research aims to create a more just, sustainable and participatory economy for Indonesian society, by placing sustainability as the main focus. This research identifies the challenges faced by Third World countries, especially in the context of globalization which leads to the domination of global economic actors over resources and markets. This has led to social stratification that is increasingly felt globally, increasing inequality and presenting sustainability and justice issues. Furthermore, concrete steps are needed to improve the legal system and mechanisms that support progressive economic development, including optimizing the Anti-Monopoly Law to prevent economic concentration, as well as implementing a progressive tax system to create a fairer distribution of wealth. In addition, this research encourages the active role of local governments, community-based market mechanisms, and community agricultural development.
