Abstract

The existence between International Humanitarian Law and Human Rights Law has a different feel from each other, though equally universal. As an example of mistreatment of prisoners of war committed by US Occupation Forces in Iraq, surely all countries say it is an international crimes (war crimes). This paper would discuss concerning how the relationship the International Human Rights with International Humanitarian Law in Situations of International Armed Conflicts. The paper argued that the relationship between human rights and humanitarian law can be distinguished but not separated. The principles of the UDHR can apply to the International Humanitarian Law, but some of the principles of the UDHR and limited humanitarian law apply in times of peace and times of armed conflict alone. Argued that the gap between International Humanitarian Law by the Human Rights bridged together through the enactment of the principles of human rights and humanitarian law principles that cannot be postponed.

Abstract

Indonesia is renowned for its abundant natural resources and vast biodiversity. However, Indonesia also has wildlife species that are most vulnerable to the threat of extinction. Illegal wildlife trade poses a serious threat to the preservation of wildlife in Indonesia. Wildlife illegally traded based on facts found in the field is mostly a catch from nature, not from captive breeding. Gunung Leuser National Park (Taman Nasional Gunung Leuser, TNGL) as one of the national parks in Indonesia faces problems in the protection of this wildlife. This is triggered by the process of industrialization, illegal logging activities and crimes against protected wildlife. Wildlife protection in Indonesia and internationally is regulated legally through Law No.5 of 1990 and internationally through the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). The role of local government, BKSDA TNGL, and related agencies in suppressing the extinction rate provides an understanding to the community of TNGL conservation areas, in particular, to reduce conflicts and clearance of plantation land by utilizing the concept of environmentally sustainable development as well as providing the mitigation measures.

Abstract

Development of business transactions especially buying and selling has globally impact to daily activities, and in modern era it disrupted by technology. Distance and time was no longer an obstacle in terms of getting the desired goods or services. The buying and selling transaction is then called online buying and selling transaction, a term commonly used by business actors in Indonesia and even the world. Civilizations and actions of a person change drastically in fulfilling his desire to get something what he wants. The online buying and selling transaction is even considered the 5th Industrial Revolution for the order of trade and industrial civilization in the world today. This paper will see and examine online buying and selling transactions from the perspective of the International Private Law, because it is not impossible this online buying and selling transactions cross the border of the country. It is hoped that this paper will give different insight and perspective for readers about online transaction.

Abstract

Aceh dikenal dengan kultur dan budayanya yang sangat kental berkaitan erat dengan Hukum Islam. Hukum Islam sendiri berkembang di Aceh sejak awal masuknya Islam di nusantara, yaitu dimulai sejak kerajaan Samudera Pasai. Sejak saat itu Hukum Islam menjadi landasan norma dan aturan hukum yang berlaku di tanah rencong ini yang juga akhirnya mempengaruhi kehidupan bermasyarakat di Aceh. Adat dan budaya masyarakat Aceh mempunyai keanekaragaman yang sesuai dengan bagian etnis di setiap daerah yang ada di Aceh. Keaneragaman itu mencerminkan betapa kaya serta beragamnya etnis masyarakat Aceh tersebut. Hukum adat sejalan dengan pelaksanaan Hukum Islam yang diterapkan di Aceh telah menjelma menjadi pemersatu serta perekat dalam susunan dan bagian dalam sendi kehidupan masyakat Aceh, yang akhirnya dapat sebagai modal dalam susunan pembangunan di Aceh. Karena itu, sendi dan nilai adat istiadat serta kebudayaan Aceh harus dijaga kelestariannya, diberdayakan dan dirawat di dalam bingkai persatuan dan kesatuan kehidupan bermasyarakat menjelang berakhirnya otonomi khusus Aceh 2027. Penelitian ini membahas mengenai pembahasan sudut pandang dan peran serta hukum adat di Aceh; pengertian adat dan hukum adat dalam tinjauan terminologi, sejarah penerapan adat dan hukum adat di dalam masyarakat Aceh, dasar dari penerapan Hukum Adat di Aceh, legalitas lembaga adat Aceh, lembaga adat pasca Memorandum of Understanding (MoU) Helsinki 2005 dan peran serta lembaga adat dalam penegakan syari’at Islam di Aceh menjelang berakhirnya otonomi khusus Aceh 2027.Kata Kunci: Hukum Adat; Masyarakat; Syariat Islam; Otonomi Khusus Aceh.

Abstract

Aceh is known for its culture, which is closely related to Islamic laws. Islamic law itself developed in Aceh since the beginning of the entry of Islam into the archipelago, which began with the kingdom of Samudera Pasai. Since then, Islamic law has become the basis for the norms and rules of law that apply to the land of Rencong, which ultimately affects the life of society in Aceh. This foundation has become the motto and philosophy of life of the Acehnese people in the westernmost province of Indonesia, namely “hadih madja, adat ngon syari'at lagee dzat ngon sifeut” which means that sharia law and adat are like substance and nature. The customs and culture of the Acehnese people are diverse and correspond to the ethnic sections of each region in Aceh. This diversity reflects the richness and ethnic diversity of the Acehnese population. Customary law, in line with the implementation of Islamic Law applied in Aceh, has transformed into a unifying and adhesive in the structure and parts of the life of the Acehnese community, which in turn can serve as capital in the development structure in Aceh. Therefore, the joints and values of Aceh's customs and culture must be preserved, empowered, and cared for in the frame of unity and unity of social life towards the end of Aceh's special autonomy in 2027. This study discusses the perspective and role of customary law in Aceh, the definition of adat and customary law in terms of terminology, and the history of the application of adat and customary law in Aceh.

Abstract

Penelitian ini bertujuan untuk menganalisis bagaimana implikasi Putusan Mahkamah Agung Nomor 46 P/HUM/2018 terhadap mantan narapidana dapat menjadi calon legislatif dalam penyelenggaraan Good Governance. Penelitian menunjukan bahwa demi mewujudkan suatu pemerintahan yang baik (good governance) di Indonesia berdasarkan konsep negara demokrasi yang senantiasa melibatkan rakyat, serta jaringan pembuatan suatu keputusan melibatkan banyak unit politik. Hasil Putusan MA Nomor 46 P/HUM/2018 merupakan norma baru yaitu pemulihan kembali hak-hak dan kebebasan orang yang telah menjalani hukuman dan tidak membatasi hak konstitusional dijamin Pasal 28 UUD NRI Tahun 1945, dan dalam Pasal 43 ayat (1) UU Nomor 39 Tahun 1999 tentang Hak Asasi Manusia Sebuah keniscayaan bahwa pencalonan anggota legislatif harus berasal dari figur yang bersih dan tidak pernah memiliki rekam jejak cacat dalam berintegritas. Namun pengaturan terhadap pembatasan hak politik seseorang harus berdasarkan undang-undang, bukan diatur dalam peraturan perundang-undangan di bawah undang-undang sebagaimana Peraturan Komisi Pemilihan Umum oleh Lembaga KPU.
