Abstract

This research aims to knowing implementation of Constitutional Right of Indigenous People in Agricultural Land Pawning According to Custom in Minangkabau West Sumatra. In Indonesia Agricultural Land Pawning be regulated in the Law No. 56 Prp 1960, where in Article 7 section 2 limits liens that have been implemented within seven years to be returned to the owner without ransom. This poses a problem in the implementation in the Minangkabau, because according to Minangkabau customary law, liens are to be redeemed regardless of the time period. this research is an emperical law research or sosiological (socio legal research). The result of this research knowing that On one hand the Indonesian 1945 Constitution acknowledges the existence of the rights of indigenous people, but on the other hand there are laws and regulations that are counterproductive to the guarantee of the mentioned rights. The implementation of agricultural land pawning in West Sumatra Minangkabau is not a bonded labor system that requires extortion but rather a system based on mutual help and pawn prices nearly equalize the price of the land. The application of Article 7 (2) of Law No.56 Prp 1960 is certainly harmful to the constitutional rights of Indigenous Minangkabau people.

Abstract

Badan Penyelesaian Sengketa Konsumen Kabupaten Solok berwenang menyelesaikan sengketa konsumen diluar pengadilan atau non litigasi. Adapun penyelesaian sengketa konsumen yang telah dilakukan oleh Badan Penyelesaian Sengketa Konsumen Kabupaten Solok salah satunya yaitu adanya tagihan air yang tidak wajar yang diterima konsumen sedangkan air yang mengalir tidak lancar. Penyelesaian ini menarik untuk diteliti karenapenelitian ini dapat membantu konsumen dalam memahami hak-hak konsumen, dan juga dapat membantu memahami kebijakan publik mempengaruhi penyelenggaraan jasa air minum, tentu apa yang telah terjadi dapat merugikan konsumen dikarenakan tidak tercapainya hak-hak konsumen oleh pelaku usaha seperti yang telah di atur dalam ketentuan Pasal 4 Ayat (8) Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen bahwa hak untuk mendapatkan kompensasi, ganti rugi dan penggantian apabila barang atau jasa yang diterima tidak sesuai dengan perjanjian atau tidak sebagaimana mestinya. Permasalahan dalam penelitian ini adalah bagaimana bentuk penyelesaian sengketa konsumen terhadap ketidakwajaran tagihan air dengan Perusahaan Daerah Air Minum oleh Badan Penyelesaian Sengketa Konsumen Kabupaten Solok? Dan bagaimana tanggung jawab Perusahaan Daerah Air Minum terhadap putusan yang dikeluarkan Badan Penyelesaian Sengketa Konsumen Kabupaten Solok? Metode penelitian yang digunakan yuridis sosiologis yaitu penelitian hukum yang mengkaji bekerjanya hukum di dalam masyarakat dengan melakukan teknik pengumpulan data yaitu wawancara dengan Sekretaris BPSK Kabupaten Solok selain melakukan wawancara peneliti juga menggunakan bahan hukum primer dan bahan hukum sekunder. Berdasarkan hasil penelitian yang peneliti lakukan, yaitu bentuk penyelesaian sengketa konsumen terhadap ketidakwajaran tagihan air yaitu dengan cara mediasi, tanggung jawab PDAM terhadap putusan yang dikeluarkan BPSK yaitu pihak PDAM menera ulang meteran air tanpa dikenakan biaya.

Abstract

Terjadinya kasus tindak pidana menguasai tanah tanpa izin pemilik yang sah dilakukan di wilayah hukum Polres Solok Kota, tentu apa yang dilakukan ini adalah suatu perbuatan melanggar hukum positif seperti yang telah diatur dalam ketentuan pasal 6 Ayat (1) huruf a PRP No. 51 Tahun 1960 mengatur larangan penggunaan tanah tanpa izin yang berhak atau kuasanya yang sah. Jika melanggar, maka pelaku dapat dipidana dengan hukuman kurungan selama-lamanya 3 bulan dan/atau denda sebanyak-banyaknya RP 5.000,00. Permasalahan dalam skripsi ini adalah 1) bagaimana proses penyidikan hukum terhadap tindak pidana menguasai tanah tanpa izin pemilik yang sah di Kota Solok, berdasarkan Undang-Undang Nomor 51 PRP Tahun 1960? Dan 2) apa kendala dalam proses penyidikan terhadap tindak pidana menguasai tanah tanpa izin pemilik yang sah di Kota Solok, berdasarkan Undang-Undang Nomor 51 PRP Tahun 1960? Dalam penelitian ini peneliti menggunakan metode penelitian yuridis sosiologis dengan melakukan wawancara kepada penyidik satreskrim Polres Solok Kota, selain melakukan wawancara, peneliti juga mengumpulkan data melalui studi dokumen dengan menggunakan bahan hukum primer dan bahan hukum sekunder. Berdasarkan hasil penelitian yang peneliti lakukan, yaitu 1) penyidikan terhadap tindak pidana menguasai tanah tanpa izin pemilik yang sah di kota solok berdasarkan Undang-Undang nomor 51 PRP tahun 1960, 2) kendala penyidikan terhadap tindak pidana menguasai tanah tanpa izin pemilik yang sah di kota solok, berdasarkan Undang-Undang nomor 51 PRP tahun 1960 yaitu tersangka tidak kooperatif, pengumpulan barang bukti yang sulit dan pemanggilan saksi yang sulit.

Abstract

Regional development is one of the efforts to utilize all the potential of the area in supporting development activities. Regional potential is the basic capital for the development of a society in improving its welfare. The existence of the area's potential is a means of supporting various development activities, both in terms of infrastructure potential, natural potential, population potential and business potential of the population as well as the potential of integrated cultural areas that can be exploited and used to improve development results in the context of justice and equity in an area . An area that is developed and developing is greatly supported by the existence of regional potential. The regional area is the geographical condition of an area which provides various opportunities for an area to manage the potentials of the area within a region. Community business activities also include potential productive areas in contributing to development activities and their results. The existence of sources of livelihood and employment owned by a community in an area, will make a major contribution to development activities, especially in the economic sector which has the potential to increase the ability of an area to become self-sufficient. Based on the description above, it becomes a concrete reference that every spatial planning activity carried out by the Regional Government of West Sumatra, always refers to the whole life of the people, including their economy, to build a just and prosperous society, it is necessary to regulate the development of appropriate integrated cultural areas. with the regional spatial plan. The supporting and inhibiting factors that must be disseminated to the community so that the development of integrated areas according to the regional spatial layout plan can be applied properly, namely socializing the factors of understanding legal substance, institutional structure, local wisdom culture, community knowledge, facilities and infrastructure available to community members know and understand the application in setting regional spatial planning in a region of West Sumatra, which directly or indirectly contributes greatly in participating in developing regional spatial planning in their region.

Abstract

Village-Owned Enterprises are mandated in Government Regulation Number 11 of 2021. Based on Article 1, BUMDes is a business entity whose capital comes from separated village assets. The existence of BUMNagari Salayo Sepakat in Nagari Salayo plays a role in improving the community's economy, but in its implementation there are still problems in the savings and loan unit, namely the existence of credit congestion so that payments do not match the agreed initial. The formulation of the problem discussed in this paper is how the implementation of savings and loans and what are the obstacles and efforts made in the implementation of savings and loans by the Nagari Salayo Sepakat Enterprises according to Government Regulation Number 11 of 2021 concerning Village-Owned Enterprises in Nagari Salayo. The approach method used by researchers in this study is sociological (empirical), an approach that is legal research that functions to look at the law in the implementation of savings and loans by the Nagari Salayo Sepakat Enterprises according to Government Regulation Number 11 of 2021 concerning Village-Owned Enterprises in Nagari Salayo. The research results show that (1) the implementation of savings and loans by the Salayo Sepakat Village-Owned Enterprise (BUMN) includes (a) gathering members for savings and loans, (b) collecting savings, (c) applying for loans through direct applications, (d) verifying and approving loans, (e) disbursing loan funds, and (f) repayment and monitoring of loans. (2) Obstacles to the implementation of savings and loans by the Salayo Sepakat Village-Owned Enterprise (BUMN) include low community participation and trust, low member financial literacy, limited human resources for managers, a high risk of non-performing loans, and suboptimal governance and SOPs. Efforts to overcome these obstacles include increasing outreach, member mentoring, strengthening human resources, credit selection, and developing SOPs, in accordance with Government Regulation Number 11 of 2021concerning Village-Owned Enterprises in Nagari Salayo.
