Abstract

The rights of concurrent creditors in the decision to postpone debt payment obligations during the COVID-19 pandemic. To know and analyze the rights of concurrent creditors in determining the vote for extension and peace after the postponement of debt payment obligations during the COVID-19 pandemic. To find out and analyze the obstacles and legal protection efforts against concurrent creditors due to the postponement of debt payment obligations during the COVID-19 pandemic. Problem formulations for this journal are; How are the rights of concurrent creditors in the postponement of debt payment obligations during the Covid-19 pandemic?, How are the rights of concurrent creditors in determining the extension vote and peace after the postponement of debt payment obligations during the Covid-19 pandemic? and What are the obstacles and legal protection efforts against concurrent creditors due to the postponement of debt payment obligations during the COVID-19 pandemic? This research is normative legal research accompanied by supporting data. The research data was collected through a literature study. The analysis was carried out using qualitative methods. Based on the research results, it is concluded that: First, the rights of concurrent creditors in the decision to postpone debt payment obligations during the Covid-19 pandemic are based on the theory of positive law put forward by John Austin, namely in Article 222 paragraph (2) of Law Number 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. Second, The rights of concurrent creditors in determining the extension vote and peace after the postponement of debt payment obligations during the Covid-19 pandemic. Third, Obstacles to legal protection of concurrent creditors due to the postponement of debt payment obligations during the Covid-19 pandemic, namely the absence of funds for the costs of managing and administering postponement of debt payment obligations, uncooperative bankrupt debtors, and debtors selling/hiding their assets before being declared bankrupt. Legal protection efforts against concurrent creditors due to the decision to postpone debt payment obligations.Keywords: legal protection, concurrent creditors, postponement of debt payment obligations

Abstract

This study aims to explore the impact of media, especially online shop platforms, on Muslim teenagers’ clothing choices by considering religious values and media exposure. This research has a high urgency since it illustrates the impact of mediatization of clothing consumption on Muslim teenagers, who face a dilemma between maintaining religious identity and following fashion trends promoted by the media. in the context of globalization and cultural change, this phenomenon creates serious challenges that need to be understood and addressed by focusing on religious identity and values embraced by individuals, this research fills the gap from previous studies that tend to be underrepresented and geographically limited. Through a qualitative approach, this study examines the clothing consumption characteristics of Muslim teenagers by comparing previous research and journals and analyzing data from interviews and observations. The results highlight online media as a major factor in influencing the selection and consumption of clothing that may not be in line with religious principles. Recommendations for future studies include a broader analysis involving all religions in the digital age, and investigating the factors that influence the selection and consumption of clothing that may not be in line with religious principles.

Abstract

Problems then arise when, before or after the bankruptcy declaration decision is pronounced, it turns out that the bankrupt debtor's bankrupt assets which are included in the Curator's inventory list have been confiscated by investigators in connection with alleged criminal acts committed by the bankrupt debtor, where the confiscation action carried out by the investigator is based on Article 39 Paragraph (2) of the Criminal Procedure Code which must be in accordance with the provisions of Article 39 Paragraph (1) of the Criminal Procedure Code. The provisions on general confiscation are in conflict with criminal confiscation, because Article 31 of the Bankruptcy and PKPU Laws gives priority to general bankruptcy confiscation, whereas criminal confiscation is regulated in Article 39 paragraph (2) of the Criminal Procedure Code, which also gives priority to criminal confiscation. This conflict is further strengthened by the dichotomy between public law and private law, thus giving rise to legal uncertainty and hindering the curator in carrying out his duties to settle the bankrupt's assets, which automatically harms the creditors as victims

Abstract

Child sexual abuse in Islamic boarding schools in Indonesia remains a pressing issue that is often overlooked within educational institutions. This study investigates the manipulation of religious doctrine in cases of child sexual harassment within these environments, aiming to understand how perpetrators exploit religious principles. The research uses a descriptive qualitative approach and analyzes online media coverage to explore those involved' characteristics, methods, and motives. The findings reveal that perpetrators employ three primary strategies to manipulate religion: redefining religious doctrines, reconstructing religious practices, and repositioning religious authority. These tactics are employed to legitimize and normalize sexual harassment of children in Islamic boarding schools. This study recommends conducting in-depth interviews with perpetrators and victims to gain a deeper and more empirical understanding. Additionally, the study provides recommendations for developing policies and practices to prevent religious manipulation and safeguard children's rights within Islamic boarding schools. This study emphasizes the urgent need for effective measures to protect vulnerable children in these educational settings.

Abstract

This study explores the hadith commentary (sharḥ) in Al-Arba‘īn an-Nawawiyyah by Muhammad ibn Ṣāliḥ al-‘Usaimin. It focuses on assessing the depth and methodology of al-‘Usaimin’s interpretation of the forty hadiths compiled by Imam al-Nawawī. The objective is to examine how al-‘Usaimin presents his commentary and how his approach contributes to a more nuanced understanding of Islamic teachings within a contemporary framework. This research adopts a qualitative library research design. The primary data source is al-‘Usaimin’s Syarḥ al-Arba‘īn an-Nawawiyyah, while secondary sources include relevant books, academic journals, and other scholarly works. Data were collected through various references, including printed and digital materials. The analysis applies discourse analysis, involving the systematic examination and interpretation of texts from both primary and secondary sources. The findings indicate that al-‘Usaimin’s commentary is marked by a strong integration of Qur’anic verses to reinforce the meanings of the hadiths. His adherence to the structure and order established by al-Nawawi reflects a methodological consistency, while his inclusion of supplementary hadiths enriches the explanatory depth. Overall, al-‘Usaimin’s work demonstrates a thoughtful and systematic effort to contextualize prophetic traditions for modern readers, offering a comprehensive and spiritually grounded interpretation.
