Abstract

Direct local elections is an illustration form of the democratic process that is realized by the government’s seriousness implemented at all levels of government. Implementation of the local elections have a purpose to carry out the implementation of a democratic system at the local level which is an extension of the central government, furthermore also a moment for the community to voicing their political rights as citizens. In practice, direct election conducted in some areas not yet in spite of the existence of violations to cause conflict between the members. The problem is how to practice the local elections directly in the province of North Sumatra; How is the behavior of the people of North Sumatra to direct the election process have been implemented. Methods This study used a qualitative approach which is descriptive study. Then conducted a qualitative analysis of the substance, the context, and the relationship between the perpetrators of the campaign with an audience from the aspect of human rights. Based on field data, direct election practices still use transactional practice, discrimination against particular groups, the lack of availability of facilities for the group of disabled tools, election fraud, organizers are still in favor of one candidate, the high cost elections, prone to horizontal conflict as a result of people’s behavior, and the function of political education are not optimal.

Abstract

Law enforcement in Indonesia is more complicated and not easy. During the process under the rule of authoritarian government where the freedom to obtain equality before the law deliberately systematically restricted. Since the Law on Legal Aid was passed by the House of Representatives in 2011, a variety of hope began to appear for the sake of the establishment of a legal aid system that can be accessed by all groups of society, especially people can’t afford (poor). But along the way, there are still many weaknesses and needs significant improvement. Therefore the problem is how the implementation of the provision of free legal aid (pro bono publico) by the local government for the poor society in East Java province; and how the coordination between the Provincial Government of the East Java with Regional Office of the Ministry of Justice and Human Rights in East Java as legal aid providers in the area. This research method using descriptive qualitative approach. Then conducted a qualitative analysis of the substance and research context to the aspects of Human Rights. The practice of providing legal aid to the poor society in East Java province is still experiencing problems, such as lack of socialization related to the provision of legal aid to the poor society, inadequate number of Legal Aid organization in making the provision of legal aid, the amount of the cost of legal aid has not been sufficient in the process in the trial, as well as administrative requirements related Certificate Disadvantaged (SKTM) are abused by some unscrupulous and not according to their distribution.

Abstract

Dalam memenuhi hak penyandang disabilitas di Lembaga Pemasyarakatan dan RumahTahanan, Pemerintah membentuk Unit Layanan Disabilitas. Namun pada faktanyaterdapat kendala yang mengemuka adalah ketersediaan petugas dengan jumlah penghunidan sarana prasarana yang belum sesuai standar menyebabkan pemenuhan hak melaluiunit tersebut belum optimal. Tulisan ini berupaya menganalisis pelaksanaan kebijakanserta strategi dan rekomendasi terhadap pelayanan penyandang disabilitas dan penyediaanakomodasi yang layak pada Unit Layanan Disabilitas di UPT Pemasyarakatan. Kajianini menggunakan pendekatan kualitatif dengan menggunakan model implementasikebijakan Ripley dan Franklin. Hasil kajian menunjukkan bahwa pelaksanaan kebijakanunit layanan disabilitas pada Lembaga Pemasyarakatan dan Rutan di lokasi kajian belumoptimal dikarenakan terdapat berbagai permasalahan seperti minimnya jumlah tenagamedis, kurangnya kompetensi petugas dalam menangani penyandang disabilitas denganjenis tertentu, belum semua Lembaga Pemasyarakatan dan Rumah Tahanan memilikiprosedur standar pelaksana, dan sebagainya. Oleh karenanya terdapat tiga alternatifpilihan kebijakan yang dapat dilakukan yaitu pertama, peningkatan terhadap dukungansumber daya kebijakan. Kedua, Koordinasi, komunikasi dan kerjasama dengan unitkerja/instansi/lembaga lain dalam pelaksanaan ULD sesuai tujuan kebijakan. Ketiga,monitoring dan evaluasi kebijakan yang ditetapkan. Atas dasar alternatif sebelumnya,maka penulis merekomendasikan untuk memilih alternatif strategi kebijakan pertamadalam mengatasi berbagai kendala dalam pelaksanaannya.

Abstract

Regulations concerning DKI Jakarta Province no longer designate the area as the nation's capital. Issues arise when the formulation of regulations appears to lack optimal community engagement, suggesting the potential for regulations that benefit specific parties or groups. This study employs a qualitative methodology, specifically a literature review, which entails the aggregation of materials and data from various sources, including books, journals, and websites pertinent to the article's theme. The study's results demonstrate the essential and strategically important role of community involvement in the development of laws and regulations. This occurs because regulations and policies are formulated with the community's interests and objectives in consideration when they are actively engaged. Increased legislation and regulations favoring public interests will be enacted due to the recognition of the significance of public participation. Integrating the community into significant meetings related to law formation, including work meetings, committee sessions, drafting team discussions, and plenary assemblies as decision-making forums, is an effective method to guarantee public involvement in the legislative process. Public hearings, consultations, and additional avenues are equally significant. Moreover, to effectively align individuals' aspirations with legal standards, council members must authentically embody the ethos of public service. The public must be discerning and judicious in their choice of representatives who truly embody this spirit. Nonetheless, the populace ought to possess the greatest access to governmental procedures to facilitate their involvement in the formulation of laws and regulations. The public should have convenient access to this information and be able to obtain clear details through various offline and online sources.

Abstract

Penyusunan dan penyelarasan Naskah Akademik merupakan proses yang penting dilakukan karena hasilnya dapat menjadi dasar dalam penyusunan kebijakan atau undang-undang. Namun terdapat beberapa kendala dalam praktinya yaitu Naskah Akademik tidak dimulai dengan penelitian hukum atau studi lain, minim partisipasi publik serta abainya pemrakarsa kebijakan terhadap sejumlah proses dalam penyelarasan. Tulisan ini bertujuan untuk menganalisis urgensitas pembentukan dan memformulasikan materi muatan pedoman dan tata cara penyusunan dan penyelarasan Naskah Akademik. Tulisan ini menggunakan pendekatan kualitatif melalui sudut pandang formulasi kebijakan. Adapun teknik pengumpulan data dilakukan dengan cara wawancara di enam provinsi, FGD dengan Unit Kerja Eselon I dan Kementerian/Lembaga terkait secara daring dan luring serta studi dokumen. Hasil kajian menunjukkan bahwa terdapat sejumlah urgensi perlunya dibentuk pedoman dan tata cara dalam penyusunan dan penyelarasan Naskah Akademik. Adapun materi muatan yang dapat dicantumkan dalam kebijakan tersebut diantaranya definisi atau ketentuan umum terkait penyusunan dan penyelarasan Naskah Akademik; batasan substansi atau materi muatan yang menggunakan Naskah Akademik atau surat keterangan atau penjelasan; kewenangan yang melakukan proses dan pengawasan penyusunan dan penyelarasan Naskah Akademik; tahapan-tahapan dalam penyusunan dan penyelarasan Naskah Akademik; jangka waktu dalam proses penyusunan dan penyelarasan Naskah Akademik; dan pendekatan teori yang digunakan dalam penyusunan dan penyelarasan Naskah Akademik.
