Abstract

ABSTRACT The existence of an Act regulating the eradication of criminal acts of terrorism apparently did not dampen terrorist acts in Indonesia. Likewise with the process of arrest and detention of parties suspected of being terrorists, often paying little attention to the elements of human rights. In addition, the forms of human rights restrictions in Article 28 of the Law on the eradication of criminal acts of terrorism also have the potential to violate human rights. This is because there are still provisions or articles governing arrest and detention that are not yet in line with respecting and protecting human rights. Keywords: Proportionality, Human Rights Restrictions, Terrorism Law ABSTRAK Adanya Undang-Undang mengatur pemberantasan tindak pidana terorisme ternyata tidak menyurutkan aksi teroris di indonesia. Begitu pun dengan proses penangkapan dan penahanan  terhadap pihak yang diduga sebagai pelaku teroris, seringkali kurang memperhatikan unsur Hak Asasi Manusia. Selain itu  bentuk-bentuk pembatasan hak asasi manusia dalam pasal 28 Undang-Undang pemberantasan tindak pidana terorisme ternyata juga berpotensi dalam melanggar hak asasi manusia. Hal ini dikarenakan masih adanya ketentuan atau pasal-pasal yang mengatur tentang penangkapan dan penahanan belum sejalan dengan penghormatan dan perlindungan HAM. Kata Kunci: Proporsionalitas,  Pembatasan HAM, Undang-Undang  Terorisme

Abstract

Referring to tourism regulations, tourism development aims to increase economic growth, improve community welfare, poverty, and overcome unemployment. The study results explain that the involvement of corporations in the tourism business in tourism development in Labuan Bajo, Komodo, Indonesia has an impact on human rights. Five types of tourism businesses that have an impact on human rights, namely: tourist attractions and tourist areas, entertainment and beverage businesses, accommodation and food businesses, tourism transport businesses, and recreational and entrepreneurial businesses. The relationship between the impact of the tourism business and human rights is formed when on the one hand the interest of tourism development is to improve the economy at the local and national levels, but on the other hand, the involvement of private and foreign corporations tends to override the rights of local communities. This research is an analytical descriptive study, which refers to the research results and literature related to the discussion. This study concludes that there is a gap in the acceptance of economic benefit values for local communities from tourism development because there is discrimination in government policies against the opportunity and convenience of conducting tourism businesses, which are more likely to be given to corporations.
