Abstract

Penelitian tentang Tinjauan Hukum Pidana Terhadap Denda Adat Menurut Nilai Kalwedo dan Snyoli Lyeta Di Desa Tounwawan Pulau Moa Kabupaten Maluku Barat Daya bertujuan dengan kemanfatan atas pelaksanaan pidana adat/denda adat dengan mempedomani nilai-nilai Kalwedo dan Snyoli Lyeta. Kesatuan Masyarakat Adat Desa Tounwawan di Maluku Barat Daya dengan budaya Kalwedo dan Snyoli Lyeta/Niolilieta/Hiolilieta/Siolilieta kerapkali dijumpai adanya peradilan sederhana pada tingkat peradilan desa yang dikenal dengan Tommara/Molumolu (menghilangkan/menutup perbuatan yang dilakukan oleh setiap subyek hukum atau pemulihan kondisi sosial) yang dalam keilmuan hukum dikenal dengan “simple justice/restorative justice” yang masih tetap dipertahankan, hal ini kerapkali dipergunakan untuk menyelesaikan masalah guna menghindarkan perlakuan kelompok keluarga yang bersifat memihak dan sewenang-wenang ketika terjadinya suatu konflik (delict) antar subyek hukum maupun antar kelompok.

Abstract

In accordance with the problems mentioned earlier, this research is a normative study of the application of restorative justice to perpetrators of criminal acts of child abuse through a conceptual approach, a statutory approach, prioritizing the use of legal materials through normative and empirical studies and various findings regarding the application of restorative justice against Perpetrators of Crime of Child Abuse, then from the results of this description conclusions and suggestions can be drawn. The results of the research and analysis use the concept of legal protection, which is an initial framework for thinking about the implementation of restorative justice for perpetrators of child abuse crimes. The results of the study show that the perpetrators and/or suspects of child abuse can be submitted to restorative justice by fulfilling various formal requirements for the victim by involving the families of both parties and related elements in society, namely resolving problems amicably by prioritizing applicable customary law and binding for the purpose of terminating an investigation based on restorative justice.

Abstract

The State of Indonesia is a State of Law (rechtstaat/staats law), which completely separates positive law (positivism law) from customary law (adatrecht) as unwritten law (custom), so that when a criminal act/criminal action occurs (delict) the state with all its powers according to the law (formal criminal law and material criminal law) through the related judiciary (sub system) acts to defend state law in order to protect the interests of the injured legal subject (victim). The results show that the system and values ​​and laws of the Duan-Lolat customary law have a position in national law as a sub-system of the Indonesian customary law system so that Duan-Lolat customary law gets its position in the criminal justice system without invalidating the national law in this case. material criminal law and the ideal form of criminal justice system in accommodating Duan-Lolat customary law against the settlement of offenses at the pre-adjudication and adjudication stages carried out by the authorized sub-system as a component of criminal justice.

Abstract

Undang-Undang Penghapusan Kekerasan Dalam Rumah Tangga Nomor 23 tahun 2004 telah memunculkan beragam reaksi dikalangan masyarakat. Banyak yang merasa tidak nyaman dengan undang-undang ini, menganggapnya sebagai upaya membawa persoalan pribadi ke ranah publik. Tanpa dapat disangkal, isu kekerasan dalam rumah tangga masih dianggap sebagai hal tabu dalam beberapa lapisan masyarakat kita, dianggap sebagai masalah keluarga yang seharusnya tidak diungkapkan secara terbuka, akan tetapi selalu saja terjadi berbagai bentuk kekerasan dalam rumah tangga yakni kekerasan fisik, kekerasan seksual, kekerasan peikis dan kekerasan ekonomi. Tanpa disadari bahwa bentuk-bentuk kekerasan dalam rumah tangga terjadi dalam lingkup keluarga, baik itu Suami terhadap Isteri, Isteri terhadap Suami, Suami terhadap Anak, Isteri terhadap anak maupun anak terhadap Orang Tuah. Oleh karena itu dipandang perlu oleh Majalis Jemaat GPM Syota dan Pemerintah Dusun Syota Desa Klis Kecamatan Pulau Moa Kabupaten Maluku Barat Daya untuk diagendakan sebagai bentuk kerja sama pelaksanaan program kerja antara Mahasiswa KKN PSDKU Unpatti Maluku Barat Daya tahun 2023 dengan Majelis Jemaat Syota dan Pemerintah Dusun Syota untuk melaksanakan Sosialisasi Tentang Penghapusan Kekerasan Dalam Rumah Tangga. Selain daripada Sosialisasi Penghapusan Kekerasan Dalam Rumah Tangga, Pemerintah Dusun Syota memandang perlu untuk dilaksanakan Sosialisasi Hukum tentang Hak Ulayat dan Hak Kepemilikan Tanah Warga serta Prosedur Pendaftaran Tanah Warga yang pada prinsipnya memberikan pemahaman hukum kepada masyarakat terhadap berbagai persoalan tanah warga dan bentuk penyelesaiannya.

Abstract

The development of traditional villages is carried out by the Regent who is assisted by the Council for the Development of Traditional Institutions and the Board for the Development of Traditional Institutions. With the existence of various variations in the application of customs in the government system which gives rise to dualism in local leadership which in turn can result in ineffective village government, this is certainly food for thought for future village government systems. The research used is sociolegal research, namely a combination research method between doctrinal legal research methods and empirical legal research methods. Doctrinal research is intended to carry out library research by identifying laws and regulations and collecting other data related to the problem being studied. Empirical research is intended to identify, study and analyze the application of customary law in the administration of Batumiau village government, Pulau Letti District, Southwest Maluku Regency, as well as the impact of the application of customary law in the administration of village government. With the increasingly rapid flow of globalization, and the qualification that Southwest Maluku is a region famous for its culture and adherence to custom, it is appropriate that many are questioning the existence of customary law in this area for the future. Based on the description above, we are interested in conducting legal research with the title.

Abstract

Hak Ulayat atau tanah ulayat adalah hak milik bersama sehingga dapat dipertegas kepada Masyarakat Adat Desa Patti bahwa Hak Ulayat atau Tanah Ulayat tidak dapat dijadikan sebagai hak milik perorangan kecuali telah digarap atau dikelolah oleh perorangan dalam Soa/Mata Rumah/Marga sebagai milik Hak Ulayat sehingga telah menjadi status obyek bekas tanah ulayat sehingga dapat dijadikan sebagai hak milik perorangan. Hak Ulayat atau tanah Ulayat tidak dapat dipindahtangankan dalam bentuk hibah, jual beli, angunan, hak pakai, hak guna usaha dan lain sebagainya. Yang dapat dipindah tangankan adalah obyek bekas tanah ulayat yang adalah merupakan milik perorangan. Terhadap hal itu maka dipandang perlu oleh Pemerintah Desa Patti Kecamatan Pulau Moa Kabupaten Maluku Barat Daya untuk diagendakan sebagai bentuk kerja sama pelaksanaan program kerja antara Mahasiswa KKN PSDKU Unpatti Maluku Barat Daya tahun 2023 dengan Pemerintah Desa Patti untuk melaksanakan Sosialisasi Tentang Hak Ulayat dan Kepemilikan Tanah Warga serta Prosedur Pendaftaran Tanah Warga yang pada prinsipnya memberikan pemahaman hukum kepada masyarakat Desa Patti terhadap berbagai persoalan tanah warga dan bentuk penyelesaiannya. Pelaksanaan kegiatan pengabdian masyarakat berupa sosialisasi hukum kepada masyarakat adat Desa Patti ini dilaksnakan oleh Tim Dosen atas permintaan dari Mahasiswa KKN dan Dosen Pembimbing Lapangan kelompok KKN di Desa Patti setelah selesainya malakukan observasi lapangan dan selanjutnya pendekatan dengan Pemerintah Desa Patti dan Dosen Pembimbing Lapangan.

Abstract

The Law on the Elimination of Domestic Violence Number 23 of 2004 has generated mixed responses among the public. A number of people are unhappy with the regulation, seeing it as an attempt to bring personal problems into the public domain. Although it cannot be denied, the issue of domestic violence is still considered a topic to be avoided in some segments of our society. This is considered a family issue that should not be discussed openly, despite the fact that various types of domestic violence continue to occur, including physical violence, sexual violence, psychological violence and economic violence. Forms of violence in the domestic sphere occur between family members, including violence from husbands against wives, wives against husbands, husbands against children, wives against children, and children against parents. Therefore, it is deemed necessary by the Klis Village Government, Moa Island District, Southwest Maluku Regency to serve as a collaborative initiative in implementing the work program between the 2023 Southwest Maluku PSDKU Unpatti KKN Students and the Klis Village Government. The aim is to hold outreach activities regarding the Elimination of Domestic Violence.

Abstract

Settlement of Infidelity Cases According to Customary Law in Lolotuara Village, Pulau Lakor District, Southwest Maluku Regency. The problem in this legal research is how to resolve cases of infidelity.     In accordance with the problem formulation in this legal research, the problems found in the indigenous community in Lolotuara are cases of infidelity which occur either between husband and wife of another person or between a husband or wife and another man or woman outside of the husband and wife relationship. . That if the case of infidelity occurs, there are also customary fines that can be implemented by Saniri Negeri Lolotuara as a customary institution that upholds customary values ​​that have been violated by individuals in society.        This research is a normative juridical research, a problem solving approach through a conceptual approach, a statutory approach and a case approach, then from the results of the description conclusions and suggestions can be drawn.   The results of the research show that the resolution of cases of infidelity through customary criminal sanctions in Lolotuara Village is carried out by requesting responsibility for men to marry girls. If the woman is the wife of the person who committed the affair then a customary fine is implemented, if they do not comply with the request to marry the girl then it is implemented. customary fines, if you are someone's wife then you are obliged to fulfill customary obligations, namely customary fines to the girl and the wife or husband of the person who has been harmed by the actions carried out by the parties. The mechanism for resolving and administering customary sanctions in Lolotuara can be accepted and implemented by customary sanctions because it is adhered to by the Lolotuara indigenous community and its existence is recognized in the national legal system. Due to this, the implementation of customary fines as a form of fulfilling customary obligations by the parties in cases of infidelity or adultery is still enforced in society because it has coercive power which is implemented by the Saniri of Lolotuara State, these customary sanctions are seen as fulfilling a sense of justice for Indigenous Peoples Lolotuara.

Abstract

In accordance with the nature of nature, humans from birth until death live together with other humans. Or in other words, humans cannot live alone, separated from other human groups. Since time immemorial, humans have had a desire to gather with each other in a group, besides that, humans have had a desire to be in society. Aristotle stated that humans are zoon politicization, which means that humans as creatures basically always want to socialize and gather with fellow humans because humans are social creatures. Customary law contains a traditional nature, stems from the will of ancestors who are usually deified and custom is also considered to be based on the will of the gods. Customary law comes from customs. Customs are a collection of social rules that have existed for a long time, have become a tradition in society, and which are intended to regulate the order of that society. These rules are obeyed in a legal association. Not all customary rules are positive law. Because besides sanctioned customs, there are also non-sanctioned customs. The emergence of the Duan Lolat culture as the highest customary law (adatrecht) began with a form of marriage, which used to be understood that an ideal marriage was one that occurred within one's own circle, and it was forbidden to carry out marriages outside one's group. The social grouping system in what is called Duan Lolat does not construct standard social strata/classes like the caste system. Duan as the giver of the daughter, Lolat as the recipient of the daughter in a Tanimbar marriage, from which the marriage gives rise to their respective rights and obligations which should and should not be implemented from the time the marriage occurs up to a certain level of descent.

Abstract

Criminal law is a branch of law that regulates crimes and violations and the sanctions that can be imposed on perpetrators. A good understanding of criminal law is very important for society to be able to avoid acts that violate the law and understand their rights and obligations as citizens. Criminal law is a collection of rules that determine what actions are prohibited and subject to criminal sanctions. Actions that are categorized as criminal acts can include crimes and violations. Regarding this matter, it is deemed necessary by the Rotnama Village Government, Mdonahiera District, Southwest Maluku Regency to schedule it as a form of cooperation in implementing service to the Rotnama Village Community through socialization with the theme "Bacarita with the Rotnama Village Community" which in principle provides legal understanding and builds legal awareness to Rotnama Village community regarding various legal problems that occur and forms of resolution. The implementation of community service activities is carried out by the Lecturer Team at the request of the Head of Rotnama Village to collaborate in implementing community service activities for the Rotnama Village Community in order to provide an understanding of criminal law which is very important for every member of the community. By understanding criminal law, people can contribute to creating a safe and orderly environment and ensure that their rights are protected by law
