Abstract

This research aims to interpret the legal consequences for Notaries regarding the Cross Holding Deed of Sale and Purchase of Shares which annulled by the Court used by a normative juridical approach, by examining library materials including statutory regulations, legal rules, legal principles and analyzing the provisions of statutory regulation, court decision and other legal material. The public views that notaries always know all matters relating to law, so notaries are expected to be able to inform and explain in detail to their clients that the deed to be made contains prohibited reasons. Even though at the time the deed was drawn up, the Limited Liability Company Law didn’t contain a prohibition on cross share ownership, the prohibition on cross share ownership was stated in the Law on the Prohibition of Monopoly Practices and Unfair Business Competition. In this case the applicant did not involve a third party, the Notary who made the Deed of Cross Share Sale and Purchase. However, a Notary in carry out his position as a public official must apply the principle of prudence, so that in carry out his duties as a Notary doesn’t cause harm to his clients and does not create legal uncertainty.

Abstract

Certificate of land ownership regulated in the Undang-Undang Pokok Agraria (UUPA) is an ownership proof of the land right where it becomes powerful evidence. The increasement of necessity of a land is not followed by the increasement of the availability of land that can be utilized by the society, which causes many disputes related to the ownership or land right. One of many problems that arises is double certificate on a land. Double certificate on a land causing risks on the owner of land right where such phenomena caused by the maladministration to criminal action. Badan Pertanahan Nasional (BPN) as an institution established by the Government that holds the sole authority in national land should be responsible in the matters related to the land dispute, especially double certificate. Beside that, there is a necessity on the legal protection to be provided by the State for the owner of land right to protect the rights of the land owner. The research performed using juridical normative with legislation approach and conseptual approach. The results of the research will be presented in the form of an explanatory-analysis where the author explains the legal certainty for land ownership holders regarding the issuance of double certificates

Abstract

Given the very important role of Notaries in upholding justice and truth in society, everyone who participates in law enforcement is obliged to carry out their duties with integrity and devotion, thus raising the degree of the Notary profession to a noble level (officium nobile). This can lead to increasingly complex and challenging tasks amidst the increasingly intense competition between Notaries, which in turn causes some Notaries to be less careful in carrying out their official obligations. The rapid changes in society are accompanied by the increasing need for Notary services, especially in the midst of globalization. People need Notary services in order to carry out their legal obligations, especially in the framework of civil law, where the implementation of a legal action depends on the existence of supporting documents such as letters or documents. This deed is often made by a Notary in the form of an original deed, so that it has more legal weight because of its official and legal existence. Notaries are public officials who have the authority to make Deeds and other legal authorities, as stated in Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning Notary Offices. In Indonesia, the legal system is very important to resolve various disputes between the government and the community. Another indication that legal certainty has been guaranteed is the stipulation or legalization of a contract by a Notary. The purpose of this normative legal research is to examine laws and regulations relating to the position and duties of Notaries in society

Abstract

This study examines the legal aspects of mystery box sales transactions in e-commerce, which raise legal challenges, particularly regarding the validity of contract objects and consumer protection. The object of mystery boxes is often unknown to consumers, potentially leading to breach of contract. Under civil law, this may violate Articles 1320 and 1238 of the Civil Code. According to Law No. 8 of 1999 on Consumer Protection, the lack of clarity in mystery box contents may violate the consumer's right to accurate information and cause harm. This study emphasizes the importance of regulation and consumer education to ensure fair and lawful transactions.

Abstract

The making of authentic deeds by a notary is part of the legal service that has the highest evidentiary value in the Indonesian civil law system. One of the formal requirements of an authentic deed according to Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary (UUJN) is the presence of two witnesses who know and directly witness the process of signing the deed. In notarial practice, notary staff are often appointed as witnesses for reasons of administrative convenience, trust, and availability of time. This study aims to examine the legal position and role of notary staff as witnesses in authentic deeds and the form of legal protection available if the deed is legally disputed. The research method used is normative legal with a statutory and conceptual approach, supported by literature studies and analysis of related court decisions. The results of the study indicate that notary staff are legally valid as witnesses as long as they meet the requirements as competent witnesses according to law. However, if a dispute arises over the deed, the staff can be asked for information as a witness in court and has the potential to face legal pressure. Therefore, legal protection for notary staff includes the principle of good faith, legal protection for witnesses, the right to legal assistance, and the ethical responsibility of notaries as employers. In conclusion, there needs to be more explicit regulations regarding the role of staff in deeds and clear protection mechanisms to maintain professionalism, integrity, and legal certainty in notarial practice.

Abstract

Dalam menjalankan kewenangannya sebagai pejabat pembuat akta autentik, seorang Notaris diwajibkan untuk menjalankan kewenangannya berdasarkan UUJN dan Kode Etik Notaris. Dalam praktik sehari-hari, Notaris sangat lekat dengan penggunaan data pribadi kliennya yang mana hal ini termuat dalam akta autentik maupun dokumen-dokumen lain yang dibuatnya. Hal tersebut tentunya membawa tanggung jawab tersendiri bagi Notaris untuk dapat menjaga kerahasiaan atas informasi dalam akta maupun dokumen yang ada padanya. Di Tengah masifnya penggunaan data pribadi, pemerintah pun mengundangkan UU PDP sebagai regulasi yang memberikan kepastian hukum bagi masyarakat maupun pihak-pihak terkait dalam menggunakan data pribadi. Dengan menggunakan metode yuridis normatif, penelitian ini akan membahas mengenai dampak UU PDP terhadap kewajiban Notaris serta tanggung jawab Notaris apabila terdapat kebocoran data klien dengan mengacu pada hukum nasional. Berdasarkan hasil analisis penulis, ditemukan bahwa diundangkannya UU PDP membawa dampak bagi Notaris yang mana dalam hal ini Notaris dikategorikan sebagai Pengendali Data Pribadi sehingga mengemban kewajiban serta tanggung jawab yang diamanatkan dalam UU PDP, selain menjalankan kewajiban yang diatur dalam UUJN. Selain itu, dengan mengacu pada prinsip tanggung jawab liability based on fault dan strict liability, maka Notaris bertanggung jawab apabila terjadi kebocoran data klien dalam Protokol Notaris.

Abstract

This study aims to analyze how the implementation of Government Regulation Number 22 of 2015 concerning Amendments to Government Regulation Number 60 of 2014 for village funds originates from the State Revenue and Expenditure Budget (APBN). This study uses Grindle's theory, namely that policies depend on their content and context, and their level of success depends on the conditions of the three component variables of implementation resources: factors of power, interests, and the strategies of the actors involved; characteristics of institutions and authorities; and decision and responsiveness. The research method used is a descriptive comparative with five villages (Kalilunjar Village, Gentansari Village, Giritirta Village, Kebutuhduwur Village, and Pesangkalan Village) as research subjects. The study results show that from the aspect of power, the characteristics of institutions and authorities, decisions and responsiveness, and resources have gone well. The five villages also have the potential to become tourist villages. The implementation of village funds is intended for the realization of advanced, robust, independent, and prosperous villages and village communities.
