Abstract

This paper intends to question about how to answer the the implementation of basuluh in Banjar tribe in inheritance dispute and how the analysis of Islamic law and the Supreme Court Regulation No. 1 of 2008 on the implementation of basuluh in Banjar tribe in inheritance dispute. Data are collected by interview and documentation then analyzed by qualitative method and descriptive verification technique with deductive-inductive mindset. The implementation of basuluh in Banjar tribe in inheritance dispute is based on the existing law of Sultan Adam. Basuluh is conducted by contacting the main figure of the village. These figures will give his personal solution to implement it peacefully. In general, the division is done in two ways, namely faraid islah and islah. The result of basuluh has no legal force, but if broken, it will be sanctioned customarily. In Islamic point of view, basuluh of Banjar tribe has already been in accordance with the principles of  maqaṣid al-syariīah. On the perspective of PERMA No. 1 of 2008, it does not reveal any significant differences between the two overall but the legal basis that governs them. So that, the mediation done by PERMA No. 1 of 2008 is specifically regulated in detail. On the other hands, the mediation in court has more disadvantage than that of  basuluh even though  the deed of peace has a legal force and has a limit time. So that, no party can stall. However, basuluh, in this case, is more effective than mediation in court.Tulisan ini bermaksud menjawab pertanyaan tentang bagaimana pelaksanaan basuluh Suku Banjar dalam sengketa waris serta bagaimana analisis hukum Islam dan Peraturan Mahkamah Agung No. 1 Tahun 2008 terhadap pelaksanaan basuluh Suku Banjar dalam sengketa waris. Data yang dihimpun menggunakan teknik wawancara dan dokumentasi dianalisis dengan metode kualitatif menggunakan teknik deskriptif verifikatif dengan pola pikir deduktif-induktif. Pelaksanaan basuluh Suku Banjar dalam sengketa waris berdasarkan pada undang-undang Sultan Adam yang masih ditaati. Basuluh dilakukan dengan menghubungi tokoh yang dipandang sebagai tetuha kampung. Tokoh ini akan memberikan pandangannya agar penyelesaian dilaksanakan secara damai. Pada umumnya pembagian dilakukan dengan dua macam cara, yaitu Farā’iḍ Iṣlaḥ dan Iṣlāḥ. Hasil dari kesepakatan basuluh ini tidak memiliki kekuatan hukum, namun jika dilanggar akan diberi sanksi adat. Ditinjau dari hukum Islam, Basuluh suku Banjar dalam sengketa waris telah sesuai dengan maqaṣid asy-syariīah. Ditinjau dari PERMA No. 1 Tahun 2008 tidak ditemukan adanya perbedaan yang signifikan antara keduanya secara keseluruhan. Yang menjadi perbedaan hanya dasar hukum yang mengatur keduanya sehingga mediasi menurut PERMA No. 1 Tahun 2008 diatur secara rinci sedangkan pelaksanaan basuluh hanya sekedar berdasarkan yang sering dilakukan masyarakat Banjar. Selain itu mediasi di pengadilan memiliki kelemahan kurang efektif dibandingkan basuluh namun akta perdamaiannya memiliki kekuatan hukum serta memiliki batasan waktu sehingga tidak ada pihak yang dapat mengulur-ulur waktu. Sedangkan basuluh lebih efektif dibandingkan dengan mediasi di pengadilan namun hasil kesepakatannya tidak berkekuatan hukum dan tidak memiliki batasan waktu pelaksanaan.Kata kunci: basuluh, Suku Banjar, sengketa waris

Abstract

This biographical reseach is talking about A. Mukti Ali, a moslem intellectual from Cepu. He is the founder of scientific-cum-doctrinaire approach or synthetic method, which is one of Islamic Studies approaches. He is also known as the founder of religious harmony concept in Indonesia, that is agree in disagreement. He also opened Comparative Religion department in 1960 so that the Comparative Religion becoming well-known in Indonesia.

Abstract

Abstrak. Tulisan ini akan menjawab pertanyaan: Apakah perempuan adalah kelompok kelas kedua dalam Islam? Jawaban atas pertanyaan tersebut adalah bahwa dalam kenyataannya Islam pada awal kemunculannya telah mengangkat status perempuan dengan melarang pembunuhan bayi perempuan, menghapus status perempuan sebagai harta benda, menetapkan kecakapan hukumnya, memberikan hak untuk menerima mahar, merubah perkawinan dari hubungan hak milik menjadi sebuah hubungan perjanjian, dan membolehkan perempuan menguasai harta benda miliknya serta menggunakan nama gadisnya setelah menikah. Al-Quran juga memberikan hak kepada perempuan untuk mengelola kekayaannya sendiri serta mengatur kebebasan hak suami dalam menceraikan isterinya. Abstract: This paper answers the question: Are women second-class citizens in Islam? The answer for the question is that the revelation of Islam raised the status of women by prohibiting female infanticide, abolishing women’s status as property, establishing women’s legal capacity, granting women the right to receive their own dowry, changing marriage from a proprietary to a contractual relationship, and allowing women to retain control over their property and to use their maiden name after marriage. Al Quran also grants women financial maintenance from their husbands and controlled the husband’s free ability to divorce her wife. Kata Kunci: Isu-isu Perempuan, Gender, Kesetaraan, dan Ajaran Islam.

Abstract

This article explores the perspectives of penghulus (marriage functionaries) in Banjarmasin regarding online marriage contracts, navigating the interplay between religious tradition and technological. Drawing upon differences in interpretation among Islamic jurists, the article elucidates varying views on the validation of marriage contracts, focusing on the concept of ittiḥād al-majlis (unity of session). This concept significantly shapes penghulus’ opinions on the legitimacy of online marriage contracts. Against this backdrop, the article analyses the factors driving discourse among penghulus regarding online marriage contracts and their implications within Banjarese community. Conducting interviews with 12 penghulus in Banjarmasin over a three-month period from September to November 2023, the study underscores the importance of religious tradition in Banjarmasin society and its adaptation to technological progress in interpreting Islamic law. The study finds that while the majority of penghulus oppose online marriage contracts, a minority endorse them under specific conditions. Those against them argue that ittiḥād al-majlis necessitates the physical presence of all parties in one location during the marriage contract process, whereas proponents contend that the virtual realm fulfills this criterion. These findings reflect the ongoing societal dialogue regarding the interpretation of religious doctrines and technological innovations, offering valuable insights into the intersection of religious tradition and technology in contemporary Islamic jurisprudence. [Studi ini menginvestigasi perspektif para penghulu di Kota Banjarmasin terkait hukum akad nikah secara online, yang mencerminkan pergumulan antara tradisi keagamaan dan kemajuan teknologi. Dengan mengacu pada perbedaan pendapat para ulama fikih tradisional, artikel ini mengidentifikasi perbedaan dalam penafsiran terhadap ittiḥād al-majlis sebagai salah satu syarat ijab dan kabul dalam perkawinan, yang mempengaruhi pendapat para penghulu tentang sah tidaknya akad nikah secara online. Di tengah kompleksitas ini, artikel bertujuan untuk menganalisis faktor-faktor yang membentuk perdebatan para penghulu terkait hukum akad nikah secara online serta implikasinya dalam konteks masyarakat Banjar. Dengan mewawancarai 12 penghulu di Kota Banjarmasin selama tiga bulan, dari September sampai November 2023, studi ini menyoroti pentingnya tradisi keagamaan dalam masyarakat Banjar dan adaptasi terhadap perkembangan teknologi dalam penafsiran terhadap hukum Islam. Kajian ini menunjukkan bahwa mayoritas penghulu menolak akad nikah secara online, sementara sebagian kecil memperbolehkannya dengan syarat tertentu. Mayoritas penghulu yang menolak menginterpretasikan ittiḥād al-majlis dengan keharusan kehadiran para pihak secara fisik dalam satu tempat dalam prosesi akad nikah, sedangkan sebagian kecil yang membolehkan memandang bahwa ruang virtual telah memenuhi kriteria ittiḥād al-majlis tersebut. Abstract

Studies on Islamic inheritance law in Egypt have thus far tended to be descriptive-historical, particularly concerning the codification through Law No. 77 of 1943 and Law No. 71 of 1946, without offering much critical assessment of the methodological foundations of takhayyur (cross-madhhab selection), taṭbīq (contextual application), and tajdīd (reinterpretation). This gap highlights the lack of theoretical reconstruction regarding the state’s institutional ijtihād and the limited analysis of the reform’s impact on society, gender justice, and cross-national inheritance dynamics. This study aims to analyze the methodological construction of Egypt’s inheritance law reforms, evaluate their implications for the principle of substantive justice, and examine their relevance to contemporary challenges. Theoretically, it employs the concept of institutional ijtihād—namely the role of the state in selecting and adapting the opinions of fuqahāʾ—to explain the flexibility of Islamic law within the modern legal order. The findings indicate a significant redefinition, including: restricting homicide as an impediment to inheritance solely to cases of intentional killing; granting equal rights in al-masʾalah al-mushtarakah; expanding radd rights for widowers/widows; introducing special regulations on lineage acknowledgment (al-muqarr lahu bi al-nasab); and the establishment of the obligatory will (waṣiyyah wājibah) for orphaned grandchildren. These results affirm that Egypt’s inheritance law reform represents an effort to balance classical fiqh with modern social demands. The implication is that the Egyptian model may serve as a reference for other Muslim-majority countries, including Indonesia, in formulating inheritance law that is more just, adaptive, and oriented toward gender justice and legal pluralism.   Keywords: Inheritance Law Reform, Institutional Ijtihād, Obligatory Will (Waṣiyyah Wājibah)
