Abstract

Konsep ‘good governance’ adalah merupakan mekanisme pengelolaan sumber daya ekonomi dan sosial yang substansial dan penerapannya untuk menunjang pembangunan yang stabil melalui syarat efisien dan merata. ‘Good governance’ bukanlah sesuatu yang terjadi secara chaostic, random atau tidak terduga. Atau dalam bahasa lain sebagai kebijakan yang sestainabel (berkelanjutan).  oleh karena itu, Konsep good governace  merupakan manivestasi pergeseran konsep negara dari ‘nachwachterstaat’ (negara penjaga malam) ke  konsepsi negara kesejahteraan (welfare state)

Abstract

AbstractIndonesia is a nation state based on law, it is stated in the Constitution of 1945 NRI. As also has been a national consensus that the nation Indonesia is committed to realize the ideals of Pancasila law. Ideals of law will affect the effectiveness of the legal validity of such ideals people. Eventhough, law still requires judicial authorities. One of the perpetrators of judicial power as stipulated in article 24 paragraph (2) of NRI Constitutions In 1945 the Supreme Court. Therefore the Supreme Court is expected to have the Chief Justice who has the integrity and quality, capable berperaan as a reformer of law in creating an idealized clean Judicial justice seekers. AbstrakNegara Indonesia adalah negara yang berdasar atas hukum, hal ini dinyatakan dalam UUD NRI Tahun 1945. Sebagaimana juga telah menjadi konsensus Nasional, bahwa bangsa Indonesia berkomitmen mewujudkan cita hukum Pancasila. Cita hukum akan berpengaruh terhadap efektifitas berlakunya hukum dalam masyarakat.Walaupun demikian cita hukum masih memerlukan kekuasaan kehakiman. Salah satu pelaku kekuasaan kehakiman sebagaimana diatur dalam pasal 24 ayat (2) UUD NRI Tahun 1945 adalah Mahkamah Agung. Oleh karenanya Mahkamah Agung dituntut untuk memiliki Hakim Agung yang memiliki integritas dan kualitas, mampu berperaan sebagai pembaru hukum dalam mewujudkan Peradilan yang bersih yang diidealkan para pencari keadilan.

Abstract

Indonesian National Police Regulation Number 8 of 2021 concerning the Handling of Criminal Acts Based on Restorative Justice has regulated police authority. This regulation was established as it is indeed necessary for the police to serve as a guideline in handling criminal acts through a restorative justice mechanism. The establishment of this regulation further emphasizes that the discretion provision in Article 18 of Law Number 2 of 2002 is highly urgent and needed in law enforcement practices. Repressive law enforcement efforts are increasingly considered less effective. The research problem formulated includes: First, what is the meaning of restorative justice as a complaint offense under Article 70 of Law Number 1 of 2023? Second, how is the implementation of restorative justice determination as a complaint offense at the level of authority within the Indonesian National Police? This study employs a normative juridical research method. The findings indicate that the application of restorative justice by law enforcement officials remains inconsistent, with varying interpretations at different stages, including investigation, prosecution, and trial processes. A review of the implementation of restorative justice for children in the Mojokerto District Court Decision Number: 11/Pid.Sus-Anak/2023/PN Mjk serves as an example of such inconsistencies. This issue arises due to the absence of explicit restorative justice provisions within the Indonesian Criminal Code (KUHP). The enactment of Law Number 1 of 2023 further reinforces Indonesian National Police Regulation Number 8 of 2021. The implementation of restorative justice determination for complaint offenses at the level of police authority following the enforcement of Article 70 of Law Number 1 of 2023 also stipulates the conditions under which restorative justice may be granted. The application of Article 70 of Law Number 1 of 2023, when aligned with Article 18 of Law Number 2 of 2002, grants police discretion to apply restorative justice in a manner that can be integrated with public interest considerations, particularly those oriented toward fines.

Abstract

Indonesia, as the world's largest archipelagic state, faces complex challenges in maritime law enforcement. The establishment of the Maritime Security Agency (BAKAMLA) as the embryo of the Indonesian Coast Guard aims to fulfill institutional needs to ensure security and safety within national waters. This study aims to analyze the essential role of BAKAMLA in maritime law enforcement and identify the regulatory challenges it faces. Using a normative juridical approach, this research examines various legal frameworks related to maritime institutions and authority. The findings reveal that overlapping regulations and authority among institutions such as the Indonesian Navy (TNI AL), the National Police (POLRI), the Ministry of Marine Affairs and Fisheries (KKP), and others significantly hinder BAKAMLA’s effectiveness. Therefore, harmonization of maritime legal systems and regulations is urgently needed. It is recommended to enact a Coast Guard Law as a single regulation that designates BAKAMLA as the main coordinator of maritime law enforcement. This reform is expected to improve inter-agency coordination, integrate early detection systems, and strengthen Indonesia’s maritime sovereignty and security.

Abstract

An Islamic state is a state that bases its constitution on the teachings of the Qur'an, where the state aims to achieve the people's welfare. In order to achieve this goal, Islam recognizes political thought as a means to realize this goal. One form of political thought is exemplified by the change of head of state in Medina after the death of the Prophet Muhammad, SAW. Islamic politics not only focuses on the change of head of state but also upholds the application of the values ​​of the Qur'an as the foundation for the formation of the state structure and the basis for managing the state. Although similar, the view of Islamic ideology as the basis for the state still causes debate to this day because there are Islamic views that are not in line with the foundation of the modern state. This conceptual paper discusses two main topics: the first concept of the state in the Qur'an and the second relationship between Islam and the state. The results of the author's study show that, first, the Qur'an does not explicitly regulate the form of the state but explains the principles and procedures for the state, such as governance, equality and protection of rights, politics, economics, and trade. Second, there is a correlation between religious ideology and the context of the state where religion is used as the basis for instilling values ​​in the state. However, this idea has been debated and developed depending on the paradigm used. There are at least three schools of theory in the relationship between Islam and the state, including conservative, modernist, and secular.

Abstract

In the juridical analysis, the granting of compensation in land acquisition under 5 (five) construction of a water management installation for the Jatiluhur Regional Drinking Water Supply System (IPA SPAM). Water Management Installation for Drinking Water Supply Systems (IPA SPAM) covering an area of 32,554 m2 or (3.26 Ha) through land acquisition for development in the public interest which is now also an urgency for the government because it is considered to be able to support national welfare and development, the Government of Indonesia officially passed Perpu Number 2 of 2022 concerning Job Creation to deal with the global economic crisis, the threat of inflation, and the current multi-sector crisis that has not been able to meet legal requirements. Analysis related to whether land acquisition under 5 (five) hectares (Development for Water Management Installation for Jatiluhur I Regional Drinking Water Supply System (IPA SPAM) in Bekasi City is in accordance with Perpu No. 2 of 2022 and how are the efforts to provide compensation for land acquisition, with the general research objective is to study Land Procurement Under 5 (Five) hectares and specifically to find out the obstacles and efforts in overcoming the problem of giving compensation, the research method used in this research is normative juridical research. Furthermore, here we discuss efforts that can be made where one of the solutions is by entrusting compensation in court to people who object, while efforts can be made for communities on land assets to provide compensation by adhering to the principle of horizontal separation then, the presence of the Perpu can also be an effort to implement and resolve obstacles to land acquisition.

Abstract

Penal mediation is carried out to bring together criminal offenders and victims, so this penal mediation is often also known as "Victim Offender Mediation" (VOM). In Indonesia itself, the use of mediation can be seen in Law No. 30 of 1999 concerning Arbitration and Dispute Resolution. Settlement of cases through mediation is in line with the concept of local wisdom that lives in Indonesian society. The noble values contained in the Pancasila state foundation fade with the times and technology; the values contained therein, such as divinity, justice, decency, harmony, unity, humanity, and mutual cooperation, are no longer reflected in the lives of the nation, state, and society. Society is also included in the formulation of legal products. Penal mediation is less well known among Indonesians. In mediation, the urgency is the value of Pancasila in the settlement of criminal cases in Indonesia, which is the community's need for a progressive, humane criminal dispute settlement that provides a sense of justice for victims, society, and perpetrators, which cannot be carried out by national criminal law. The local wisdom of people in various regions of Indonesia in the settlement of criminal disputes based on deliberation and consensus (mediation) as local institutions has not been utilized optimally in answering this problem. The formation of law in Indonesia is based on historical aspects and is in accordance with the conditions and circumstances of the people. In mediation, it requires the involvement of all stakeholders in solving criminal acts through mediation based on local wisdom using impartial or neutral media and mediators.
