Abstract

Bankruptcy is a legal institution created as a way out of debt problems that befall debtors. The bankruptcy mechanism consists of the Postponement of Debt Payment Obligations (Penundaan Kewajiban Pembayaran Utang/PKPU) and bankruptcy itself. These two mechanisms have different legal consequences, especially regarding the available legal remedies, which differ between bankruptcy rulings originating from PKPU applications and those originating from bankruptcy applications. The available legal remedies also differ between bankruptcy rulings originating from applications submitted by debtors and those submitted by creditors. Constitutional Court Decision No. 23/PUU-XIX/2021 has changed the legal remedies provisions in Law No. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations. Prior to the Constitutional Court's decision, there was no opportunity for debtors to file legal remedies against a bankruptcy ruling caused by the rejection of a peace agreement due to the failure to reach an agreement in the PKPU process. However, after the issuance of Constitutional Court Decision No. 23/PUU-XIX/2021, this has changed with the opening of the opportunity for legal remedies in the form of cassation against a bankruptcy ruling due to the rejection of a peace agreement because an agreement was not reached in the PKPU process. It is important to avoid the PKPU process being used as a means to bankrupt debtors who are still solvent but are bankrupted because there are interests of business competition involved.

Abstract

An inmate is someone who is deemed guilty and must serve a sentence in prison based on a verdict or decision from a judge with permanent legal force (inkracht) based on evidence and evidence. Development for prisoners cannot be separated from their rights both inside and outside prison, with the aim of independence which is also in the nature of development as it is directed towards development with the mentality and character of being a complete human being, as well as pious, and also responsible for oneself. , also for families, and for society, and talents and skills can be developed so that they play an active and responsible role in society in the future when free, related to social reintegration. Protection, which is the principle in which inmates are treated in correctional institutions in order to ensure that society can be protected from the possibility of repeating criminal acts in the form of crimes or violations, also provides provisions for life for inmates so that they become useful citizens in society. The research method is normative juridical by referring to statutory regulations, as well as existing literature based on literature study. The result is that social reintegration can provide changes in the development of inmates so that their attitudes and behavior become better and they can have abilities in community life.

Abstract

Pembatasan distribusi minuman kemasan perlu dilakukan dalam UU Nomor 17 Tahun 2023 tentang Kesehatan. Pembatasan yang dimaksud berkaitan dengan minuman kemasan yang marak dan berdampak buruk pada kesehatan Masyarakat. Sementara Undang Nomor 18 Tahun 2012 tentang Pangan juga tidak mengatur pembatasan makanan dan minuman, hanya mengatur pengelolaan keamanan, mutu, gizi, dan tidak bertentangan dengan agama, keyakinan, dan budaya Masyarakat. Penelitian yang digunakan adalah penelitian yuridis normatif, mengkaji hukum dalam wujud peraturan perundang-undangan. Pendekatan yang digunakan adalah pendekatan perundang-undangan dan pendekatan konseptual. Hasil kajian menunjukkan bahwa UU Kesehatan memasukkan makanan dan minuman menjadi elemen penting dalam kesehatan Masyarakat. Tidak ada pengaturan pembatasan distribusi makanan dan minuman, telah menyebabkan proses legislasi dalam UU Kesehatan tidak mengevaluasi norma UU Pangan. Padahal minuman kemasan menyebabkan degradasi kualitas kesehatan masyarakat. Apabila masyarakat mengalami permasalahan dan gangguan kesehatan maka akan berdampak simultan bagi kerugian negara. Tanggung jawab negara untuk membatasi distribusi minuman kemasan adalah mutlak dilakukan. UU Pangan dan UU Kesehatan tidak mempertimbangkan aspek kesehatan dalam distribusi minuman kemasan, hanya memperhatikan aspek terpenuhinya kebutuhan dasar individual. Pemenuhan kebutuhan dasar harus ditujukan pada peningkatan kualitas hidup sehat dan demi kesejahteraan umat manusia. Setiap distribusi minuman yang ada harus memenuhi standar kesehatan, bahkan pembatasan distribusi produk minuman kemasan wajib dilakukan. Hukum administrasi kesehatan mengarah pada pemenuhan hidup yang sehat dan terpenuhinya kebutuhan dasar individual. Pembatasan distribusi minuman kemasan dilakukan untuk memberikan kehidupan yang baik, sehat, serta sejahtera lahir dan batin sebagai bagian dari jaminan hak asasi manusia.

Abstract

This article discusses a community service program focused on the management of legal libraries and documentation in higher education institutions within the DKI Jakarta area. The program aims to enhance the quality of legal library services by optimizing information and legal documentation management systems based on technology. This initiative is driven by the importance of legal libraries as resource centers that support education, research, and the development of legal studies.  The methods employed include training in modern library management, digitization of legal collections, and the implementation of legal reference management software. The program also involves improving the skills of librarians and administrative staff in systematically managing and organizing legal collections. Furthermore, the activities introduce the integration of digital legal information systems to facilitate access and data retrieval for students, lecturers, and researchers.  The results of this program show significant improvements in the effectiveness and efficiency of legal library management. Partner institutions in the program experienced benefits such as easier access to legal literature, more structured documentation systems, and enhanced librarian skills in managing legal data.

Abstract

Corruption is an extraordinary crime. Corruption in Indonesia is increasing every year. The increase in corruption cases in Indonesia is increasingly specific, the mode used by each perpetrator is different. Like a disease, the symptoms of corruption in Indonesia start from the elitist stage where mega corruption occurs in the government. This writing focuses on Supreme Court Decision Number 2633 K/PID.SUS/2018, in which Nur Alam as Governor of Southeast Sulawesi for the period 2008-2017 committed a criminal act of corruption by accepting gratuities in the form of insurance for mining licenses. The method used in this writing is normative juridical with a statutory approach, conceptual approach and case approach. With the aim of measuring the equivalence of the punishment received by the convicted person based on the theory of legal certainty, the principle of legality, and the theory of crime and punishment From the decision that the author examines, it can be concluded that the return of assets resulting from corruption with the mode of gratification in the form of insurance is the return of goods that have economic value obtained from the proceeds of corruption in the form of several insurance policies. In this case, Nur Alam's insurance account must be frozen. The type of punishment for returning assets resulting from corruption is the main punishment consisting of imprisonment and fines, as well as additional punishment, namely paying restitution or taking assets worth restitution and revoking political rights.

Abstract

There seems to be something different from the results of Transparency International Indonesia (TII) including sextortion or sexual extortion in the Global Corruption Barometer Asia 2020. This is extortion in the form of violence or sexual harassment. Generally a form of abuse of power. Sextortion is different from the corruption we know in a legal context. In terms of regulations and institutions, the practice of sextortion or sextortion is a case that occurs quite a lot but is not yet known in corruption eradication institutions in Indonesia. Sextortion is a new area that opens everyone's eyes to the fact that corruption is not only about money. This study uses a qualitative approach to answer how the form of legal protection for victims of sextortion is rife lately in the educational environment. The conclusions of this study indicate that the form of legal protection for victims of sextortion in the educational environment is in the form of assistance, protection and recovery of victims by strengthening the legal aspect in the form of SOPs for Handling Sexual Violence in each educational institution as well as the installation of detection devices. The novelty of this research can be used for extensive interpretation of legal findings by judges to protect victims of sextortion. And the importance of education on strong self-protection awareness, boldly rejecting or saying no.
