Abstract

Surat kuasa khusus dalam hukum acara perdata Indonesia merupakan hal yang sangat penting agar seseorang dapat diwakilkan kuasa hukum di pengadilan. Surat kuasa khusus harus sah secara hukum agar seseorang kuasa hukum mempunyai legal standing dalam perwakilan seseorang, namun pada praktiknya surat kuasa khusus yang ditandatangani tunanetra seringkali dianggap tidak sah oleh hakim karena keterbatasan penglihatan yang dimiliki tunanetra, yang menimbulkan permasalahan tunanetra tidak dapat diwakilkan oleh seorang kuasa hukum dalam beracara. Penelitian ini dibuat bertujuan untuk mengetahui mengenai keabsahan surat kuasa khusus berdasarkan hukum positif di Indonesia. Metode penelitian yang digunakan adalah yuridis normatif dengan mengkaitkan ketentuan-ketentuan hukum yang berlaku dalam penerapan secara praktik. Spesifikasi penelitian yang dilakukan adalah deskriptif analitis yaitu penulisan yang menggambarkan dan menerangkan secara jelas situasi atau peristiwa terkait dengan keabsahan surat kuasa khusus untuk tunanetra dengan data-data yang penulis peroleh melalui studi kepustakaan dan wawancara. Hasil yang diperoleh dari peneilitian ini adalah surat kuasa khusus untuk tunanetra berdasarkan peraturan perundang-undangan sah secara hukum apabila tidak dilakukan oleh seorang tunanetra yang belum ditetapkan sebagai curatele berdasarkan putusan pengadilan dan telah memenuhi ketentuan sesuai dengan peraturan perundang-undangan dan tidak perlu dilakukan di hadapan notaris.

Abstract

The success of a peace effort through mediation is highly dependent on the strategy and skill of the mediator in reconciling couples who are about to divorce. The purpose of this study is to describe the factors related to the legal aspects regarding obstacles to the level of success of mediators as a peace effort in divorce cases and to formulate efforts to optimize the role of mediators in order to reduce the divorce rate in the Soreang Religious Court based on related laws and regulations. This writing uses a normative legal method with analytical descriptive research specifications. The author implements normative law to the facts and practices that occur in the field. Data collection techniques use literature and field studies to collect information on divorce case data and the role of mediators in the Soreang Religious Court. The results of this study indicate that first, the success of peace efforts in divorce cases in the Soreang Religious Court is influenced by various inhibiting factors, including the good faith of the parties who are less cooperative, the influence of legal counsel, the condition of the mediation room is less representative, the parties' lack of understanding of mediation, and the role of the mediator is less than optimal. Second, the mediator's skill and sincerity are the main supporting factors for achieving a successful mediation in the Soreang Religious Court. However, mediators still do not have sufficient skills and professionalism to explain and hold caucuses. This is addressed through education or training programs, as well as enforcement of mediator certification to ensure the quality, credibility, and professionalism of mediators in the Class IB Soreang Religious Court.

Abstract

The Indonesian capital market has undergone changes, especially related to legal reforms that can be seen in terms of quantity including legal certainty and protection for investors. These changes are accompanied by the application of the new economy encouraged by the Government of Indonesia, especially for the development of digital technology because technology companies and start-ups have the opportunity to invest or do business in Indonesia. One form of encouragement for Indonesia's new economy is the issuance of Financial Services Authority Regulation Number 22 / POJK.04 / 2021 concerning the Application of Share Classification with Multiple Voting Rights by Issuers with Innovation and High Growth Rates Conducting Public Offerings of Equity Securities. The application of dual class shares in the multiple voting shares system is expected to provide protection for the company's vision and mission so that it can develop properly. The research method used is normative juridical by collecting secondary data related to research problems.

value of the bankruptcy estate (boedel pailit) through the going concern principle. Law No. 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (UUK-PKPU) allows curators to continue the debtor’s business, particularly under Article 179 paragraph (1). However, the absence of clear normative parameters creates legal uncertainty and inconsistent practices. This study analyzes the application of the going concern principle in the settlement of bankruptcy estates following the annulment of homologated composition agreements and examines the urgency of technical implementing regulations. Using a normative juridical method supported by statutory analysis, court decisions, legal doctrines, and interviews, the research focuses on the cases of PT Sri Rejeki Isman Tbk. (Sritex) and PT Texmaco Perkasa Engineering Tbk. The findings reveal that going concern implementation depends not only on legal provisions but also on non-legal factors, such as transparency, asset control, capital availability, management credibility, and creditor support. Texmaco’s case shows approval when these conditions are met, while Sritex demonstrates rejection due to lack of transparency and unlawful activities. The study underscores the need for a Supreme Court Regulation (PERMA) that establishes eligibility parameters, approval mechanisms, reporting obligations, and curator protection to ensure consistency, legal certainty, creditor protection, and greater economic benefits in Indonesian bankruptcy practice.
