Abstract

Secara umum masyarakat Desa Silawan memiliki pengetahuan tentang perdagangan orang namun tidak memiliki wawasan yang luas tentang bahayanya dan modus-modusnya. Masyarakat Desa Silawan tidak pernah mendapatkan sosialisasi terkait hal tersebut sehingga tidak sedikit dari mereka pergi bekerja ke luar negeri dengan cara non prosedural yang dapat menjadikan mereka korban perdagangan orang. Karena itu perlunya diberikan pemahaman yang luas terkait ancaman perdagangan orang dan pencegahan tindak pidana perdagangan orang melalui sosialisasi dan Focus Group Discussion (FGD) di Desa Silawan, Kecamatan Tasifeto Timur Kabupaten Belu. Kegiatan ini dilakukan dengan harapan tidak ada yang menjadi korban sekaligus mencegah agar masyarakat tidak menjadi oknum-oknum pelaku kejahatan tersebut. Setelah memberikan pemahaman, tim pengabdian juga melanjutkan dengan menguji pemahaman tersebut melalui pre-test dan post-test. Hasil dari kegiatan menunjukkan bahwa terdapat masyarakat Desa Silawan, Kecamatan Tasifeto Timur Kabupaten Belu yang pernah menjadi korban tanpa sadar karena itu perlunya dilakukan peningkatan pengetahuan, pemahaman serta kesadaran masyarakat akan hukum dan penanggulangan perdagangan orang.

Abstract

The Poka Indigenous People are part of the Manggarai community, also practicing matters related to Manggarai culture such as resolving land disputes between community members. This research was conducted to find out the role of Tu'a Golo in resolving disputes among the Indigenous People of the Poka Village, Longko Village, Wae Ri'i District, Manggarai Regency. Based on the results of the study, the role of Tu'a Golo in the Poka Indigenous People is to: Regulate and manage the socio-economic and cultural life of the community and resolve land boundary disputes of the Poka indigenous people. The role of Tu'a Golo in resolving land boundary disputes is as follows: 1) The role of Tu’a Golo in the dispute between Benyamin Bago and the Manggarai Regency Government. In this case, Tu'a Golo was presented by the police only as a witness. 2) The role of Tu’a Golo in the dispute between Alosius Sema and Benyamin Bago, namely: receiving and assessing community reports regarding the disputed dispute, leading the lonto leok event in resolving cases, summoning tu'a-tu'a panga and witnesses, leading the event of reviewing the location of cases, deciding cases, being a witness in a case. The decision of the old golo regarding the land boundary dispute between Alosius Sema and Benyamin Bago has binding force and applies to the parties, but is not final. According to the researcher, Tu’a Golo decision in the dispute between Alosius Sema and Benyamin Bago fulfilled the element of justice.

Abstract

. Land rights are rights that are obtained from a legal relationship between the right holder and the land, including space above the ground and or space under the ground. The understanding of land rights is one of the individual rights to land, namely rights that give authority to the holders of the rights, whether individually or also as a group of people collectively or as a legal entity, to use in the sense of controlling, using and or taking advantage of certain land parcels. Ownership of land must have legal certainty, both customary law and land law or positive law concerning the certainty of land rights as property rights so as not to cause conflict. The method used by the author in collecting data is through surveys, interviews and studies of primary literature (books that talk about soil) and secondary literature (supporting books). Survey is a quantitative research using the same structured questions for everyone, then all the answers obtained by the researcher are recorded, processed, and analyzed.
