Abstract

The role of a mediator is crucial in facilitating understanding among parties involved in a dispute. Mediators aid the parties in comprehending each other's perspectives regarding the contested issues and subsequently assist them in making objective assessments of the overall situation during negotiation processes. This research specifically aims to identify the legal standing, both in civil law and Islamic law, concerning the disputed issue of child custody with the assistance of a neutral third party (mediator). The research employs a qualitative method, involving the collection, analysis, and comprehensive interpretation of narratives. Legal materials obtained from literature reviews and legal approaches are analyzed using systematic interpretation techniques. The research findings highlight that the mediator's ability significantly influences the success of mediation. If mediation fails to reach an agreement, the mediator submits a written notification to the presiding judge, who then informs the panel judge handling the case. The disputing parties are expected to appear at the scheduled hearing, and the trial process continues as usual.

Abstract

Para ulama sepakat memenuhi kebutuhan nafkah istri merupakan suatu kewajiban dalam Islam, walaupun masih terjadi silang pendapat mengenai standar nafkah yang layak. Kelalaian dalam memberi nafkah menjadi hutang dan Istri dapat mengajukan fasahk nikah ke pengadilan. Namun Islam menganjurkan setiap nafkah yang diberikan itu harus bersumber dari sesuatu yang halal. Lalu bagaimana hukum nafkah yang diberikan dari penjualan barang haram? Dalam penelitian ini ingin mengkaji lebih dalam bagaimana pandangan tokoh ulama Kota Lhokseumawe tentang hukum menafkahi istri dari hasil penjualan barang haram. Dalam kajian ini menggunakan penelitian kepustakaan (library research) dengan pendekatan kualitatif. Sebagai bahan primer dalam penelitian ini adalah hasil penelitian lapangan berupa wawancara dengan sepuluh orang informan yang berlokasi di Kota Lhokseumawe. Hasil penelitian ini menyimpulkan bahwa pandangan tokoh ulama Kota Lhokseumawe tentang hukum menafkahi istri dari hasil penjualan barang haram adalah haram. Namun terkait kewajiban yang dilakukan suami, para tokoh ulama Kota Lhokseumawe berbeda pendapat tentang status nafkah tersebut. Dari sepuluh (10) informan yang diwawancarai, ada lima (5) yang mengatakan gugur kewajiban suami, dan terdapat lima (5) ulama yang mengatakan tidak gugur kewajiban suami dengan berbagai argumen yang mereka kemukakan. Sedangkan dalam hukum Islam hukum nafkah yang diberikan adalah haram karena cara mendapatkannya dari usaha yang haram. Dalam masalah kewajiban suami dapat dikatakan tidak gugur karena nafkah hukumnya wajib maka memakan yang halal juga wajib, dari saling keterikatan antara dua hal yang wajib ini maka member nafkah yang halal dan baik pun hukumnya wajib.

Abstract

Empirical facts show that the number of sexual violence in various forms is increasing, while victims still experience difficulties in obtaining protection which is the responsibility of the State. Sexual violence experienced by women is a manifestation of historical inequality in power relations between men and women and is a structural obstacle to achieving social justice, peace and sustainable self-development. The aim of this research is to analyze the protection of women from acts of sexual violence that fulfills the benefits and is gender equitable for women. Through a normative juridical method with a statutory approach and legal principles, research was conducted sourced from secondary data, reinforced by interviews coded via NVivo R1. The results of the research show that the strong patriarchal viewpoint in Indonesian society gives rise to gender inequality and is a contributing factor to sexual violence against women. Sadly, this action is still considered an immoral act by some people. Victims still experience revictimization due to society's mindset that does not side with women as victims and instead blames them for triggering sexual violence. For this reason, it is hoped that all elements of society will no longer be permissive regarding the issue of sexual violence, so that efforts are needed to make socio-cultural changes in Indonesia, one of which is through gender reconciliation by applying the principle of mubindah in life. So that sexual violence can be eliminated and victims can be protected.
