Abstract

The phenomenon of “no viral no justice” that emerged on social media reflects the pessimistic attitude of the Indonesian society towards law enforcement. People have found a new legal culture in law enforcement, particularly by using social media as a tool for social control (civil engagement). However, the participation of the public on social media has had negative impacts due to the lack of alignment between legal awareness and emotional reactions to the law. The excessive reliance on emotional reactions has created an unhealthy legal culture and can influence the law enforcement system. The urgency of this research is driven by the increasingly alarming condition of law enforcement in Indonesia, which has led to public participation (people power) that tends to influence and hinder the law enforcement process. The pressures imposed on law enforcement authorities create legal uncertainty and undermine justice itself. Therefore, the discussion on the role of social media as a tool for the public's pursuit of justice in law enforcement in Indonesia is important and relevant for further study. This research aims to examine the influence and relationship of democratic public participation through social media in realizing the three fundamental legal values: justice, certainty, and utility. The research methodology used in this study is socio-legal research. The findings demonstrate that public participation through social media in monitoring the law enforcement process is essential in achieving justice, certainty, and utility. To minimize the emergence of an unhealthy new legal culture (monitoring) in society, it is necessary to enhance legal awareness and conduct targeted monitoring based on thoughtful thinking, reasoning, and argumentation.

Abstract

The proliferation of offers from perpetrators providing “loan jockey” services exploit the anxiety experienced by online lending borrowers who have defaulted, with the intent of trapping them. This study aims to analyze the relationship between victims and perpetrators, particularly unscrupulous providers of such services, and to propose law enforcement strategies and victim protection measures from a victimological perspective. This research employs a normative juridical (doctrinal) method, utilizing both statutory and conceptual approaches. The findings indicate a close and reciprocal relationship of victimization between perpetrators and victims. Users of “loan jockey” services often not only contribute to the occurrence of criminal acts against themselves but may also accelerate such acts. Efforts to combat the increasing prevalence of these perpetrators through criminal law policy alone are insufficient. Alternative strategies are necessary, including the fulfilment of victims’ rights and obligations through a victimological approach. This approach is expected to enhance legal awareness and foster a sense of responsibility among potential and actual victims to remain vigilant and protect themselves. The study contributes theoretically by developing a digital victimology framework based on the interactive relationship between victims and perpetrators. Practically, it offers victim protection strategies focused on improving legal literacy and risk awareness in the digital space. Ultimately, this research expands the scope of victimology in addressing the evolving nature of crime in the digital era. Keywords: Online Loan Jockeys; Victims; Victimology.

Abstract

This study examines the tension between investor protection and money laundering risks within Indonesia’s regulatory framework for special debt instruments, particularly in the implementation of Patriot Bonds and Merah Putih Bonds. The central issue concerns the granting of legal protection for the purchase of such special debt instruments, which may potentially restrict criminal prosecution, civil claims, the use of data as a basis for tax assessment, and the use of evidence in judicial proceedings. This study aims to analyze whether such protection can still be regarded as a legitimate investment policy instrument or whether it risks creating a safe harbor for non-transparent funds, thereby conflicting with anti-money laundering principles and tax transparency. This study employs a normative legal research method using statutory, conceptual, and historical approaches. The legal materials examined include laws and regulations governing finance, taxation, money laundering offenses, as well as international standards established by the Financial Action Task Force (FATF) and principles of tax transparency. The analysis is conducted qualitatively through systematic and prescriptive interpretation to assess the compatibility of the regulatory framework governing special debt instruments with the principles of the rule of law, accountability, and financial system integrity. The findings demonstrate that investor protection is necessary to enhance market confidence; however, excessively broad protection may weaken law enforcement, tax oversight, and the prevention of money laundering. This study concludes that the regulatory regime for special debt instruments should incorporate risk-based safeguards to maintain their attractiveness to investors without compromising transparency, accountability, and legal certainty.
