Abstract

Pembelian produk menggunakan paylater di shopee merupakan salah satu bentuk muamalah yang sedang trend di Indonesia. Pengabdian ini bertujuan untuk memberikan informasi tentang hukum pembelian produk melalui shopee dengan cara membayar nanti (paylater) dan pengenaan denda akibat keterlambatan pembayaran tagihan paylater di Shopee menurut perspektif Hukum Islam. Adapun sasaran diseminasi ini adalah anggota Komunitas Emak Blogger Solo dan masyarakat umum. Akad yang dilaksanakan pada praktik pembelian produk dengan cara membayar paylater di Shopee adalah akad Qardh. Pada praktik pembelian dengan paylater ini terdapat bunga minimal 2,95%. Sehingga pembelian produk di Shopee menggunakan paylater merupakan bentuk muamalah yang tidak diperbolehkan. Pengenaan denda akibat keterlambatan pembayaran tagihan paylater yang bersifat fluktuatif dan tidak sesuai dengan biaya administrasi sebenarnya maka denda ini tidak sesuai dengan prinsip syariah. Metode pelaksanaan program ini melalui diskusi interaktif dengan penyampaian informasi secara langsung kepada Komunitas Emak Blogger Solo mengenai penggunaan shopee paylater. Pengabdian ini penting dilakukan karena hasil diseminasi diulas oleh para blogger yang menjadi peserta berupa reportase tulisan dan video, sehingga masyarakat mendapat informasi mengenai hukum shoppe pay later dalam perspektif Hukum Islam.

Abstract

The amendment of the Sharia Court position within the Indonesia’s public court jurisdiction is contained in Article 27 of Law Number 48 of 2009 concerning Judicial Powers where the existence of the Sharia Court is no longer stated to be included in the scope of the special court within this law. The amendment set different tone from what is contained in Law No. 4 of 2004 which in the elucidation of Article 15 states that, the Sharia Court is part of a special court. The problematic issue of Sharia Court's absolute authority in Aceh province under Indonesia judicial system is also the main study discussed in this article. At the end of the article, suggestions for improvement are also presented in order to strengthen the position of the Sharia Court in Indonesia judicial system.

Abstract

This article aims to analyze the methodology of royalty distribution in divorce cases and assess Decision Number 16/Pdt.G/2024/PTA.JK, regarded as the first legal precedent in Indonesia for dividing royalties as joint marital property upon court-declared dissolution of marriage. The analysis is based on John Rawls's and MH Kamali's theories of justice. Using normative research methods, the article examines statutory provisions regulating the rights and obligations of divorcing couples and evaluates the court decision in question. The findings indicate that royalties qualify as joint marital property since they are intangible assets derived from rights. The division of joint property is carried out equally, in accordance with Articles 96 and 97 of the Islamic Law Compilation. This decision reflects justice for the parties involved, as both contributed to the song creation process.

Abstract

This study analyzes aims to determine the legal basis and considerations of the judge in the case of annulment of marriage based on Decision Number 1332/Pdt.G/2024/PA.Klt as well as the regulations regarding the proof of the element of coercion which is the basis for annulment of marriage. This article is a normative legal research conducted by reviewing various legal regulations in the form of laws, regulations, and literature containing theoretical concepts then connected to the problems to be discussed. The approach of this article uses a case study approach (case approach) and a conceptual approach (conceptual approach) based on the Klaten Court Decision Number 1332/Pdt.G/2024/PA.Klt which has permanent legal force. Based on the research results, it was found that the Judge's consideration in the decision to annul a marriage due to coercion refers to Article 6 paragraph (1) of Law Number 1 of 1974 concerning Marriage as amended by Law Number 16 of 2019 and Article 71 letter f of the Compilation of Islamic Law where a marriage can be annulled if the marriage is carried out with an element of coercion and without the consent of both prospective bride and groom. In addition, the Panel of Judges assessed that the Plaintiff's witness statement did not meet the material requirements of evidence because it was only in the form of testimonium de auditu in accordance with Article 171 HIR and Article 1907 of the Civil Code so that it did not have the power of proof, the judge ex officio ordered the Plaintiff to take a suppletoir oath which was deemed to meet the formal and material requirements and was related to the main point of the main point of the case.
