Abstract

Relinquishment of land rights is the relinquishment of legal relations between the holders of land rights and the land under their control by providing compensation on the basis of deliberation. Letter of Waiver of rights is evidence that is made with the aim of releasing land rights. A letter of release of customary land rights (dati) is applied in the same way as the release of land rights in general, as enforced in accordance with Government Regulation No. 24 of 1997 concerning Land Registration. The process of registering customary land rights (dati) is based on the release of customary rights (dati) issued by the customary land owner (dati) as the basis for rights. So based on the release of land rights, it can be registered at the Ambon City Land Office to obtain proof of land ownership or certificates. The letter of release of customary land rights (dati) issued by the customary State Government in Ambon City is binding as long as it is carried out based on applicable customary law and can be proven the basis of ownership rights to customary land (dati) from the customary land owner (dati) that issues the release letter the land rights. However, as long as it cannot be proven valid, the letter of release of land rights does not have binding power, thus the release of the customary land rights (dati) becomes invalid and the certificate can be canceled.

Abstract

Regarding land acquisition by humans (land tenure), Indonesia has its own history of the occurrence of various complex land tenure categories. Each land tenure category each has a characteristic setting regarding land ownership and ownership, and management objectives. This can be seen in Indonesian society in each area of residence other than the Indonesian people, the land also affects the government which in this case the government has the authority to control the land in use and intended for the community but the fact that the community is at a disadvantage by the government. thus how is the development of customary land which in the past was not registered, then in the present many customary land must be registered if registered so that the status of the land that was originally customary land changed status to property rights, then how to protect land adat which does not register what the impact of these lands will be in the future.

Abstract

Ownership rights to land as a type of property right are very important for the state, nation, and people of Indonesia as an agrarian society which is developing towards industrial development and so on, but land is the basic life for humans. Various existing governance concepts, its validity as a basis for agrarian management must be tested again. With these actions, it is hoped that there will be synergy between agrarian issues and an environmentally based management orientation. The aim of the service is to provide legal understanding related to agrarian law based on local wisdom and environmental law in small island border areas. The Service Method is carried out in a lecture by each presenter, the presenter is given time to present the material, after that the participants are invited to ask problems or questions which are then answered in turn by the presenters according to the problem being asked. The results of this community service activity are one form of tridharma activity for educators to play a role in resolving problems that occur in the community, especially regarding Agrarian Law Based on Local Wisdom and Environmental Law on Small Border Islands through legal counseling that discusses the customary rights of customary law communities. encounters development, resulting in changes in the community's living environment.

Abstract

Introduction: Land ownership has become a primary need, but in the process of land ownership there are still problems. Basically, the acquisition of land rights according to the Decree of the Minister of Agrarian Affairs Number 21 of Article 1 Point 1, the acquisition of land is carried out by transferring land rights or through the delivery of release of land rights followed by granting rights. But this activity is not carried out in its entirety so that it will cause problems in granting rights to the community. Purposes of the Research:  This research was conducted in Sanahu Village, Elpaputih District, West Seram Regency. This village prioritizes and gives importance to matters relating to customary land. However, based on the dinamics of the community, transactions carried out by the community should be carried out in accordance with the provisions of the legislation governing land registration in order to obtain legal certainty in the transactions carried out and aim for orderly administration in land sector. Methods of the Research: This research method is empirical juridical research that uses primary and secondary data. The legal materials used are primary legal materials, secondary legal materials with questionnaire and interview methods, data collection techniques with literature studies and field studies. Data processing and analysis techniques use descriptive analytical data analysis by identifying, classifying, then analyzing and describing according to the hierarchy. Results of the Research: Based on have not carried out the first land the results of the interviews, it is known that some people in Sanahu village do not know about the sale and purchase practices that should be taken in order to obtain legal certainty from the sale and purchase transactions carried out. This should be done based on the provisions of Article 19 paragraph 2 of the UUPA, Article 37 of PP 24 of 1997 concerning land registration. As a result, in the event of problems related to previous land transactions, the community had to resolve themselves in a family manner, either without or with assistance from local officials. As a result, the people of Sanahu village have not carried out the initial registration and maintenance of land registration data properly. Because land administration is not orderly, if there are land issues in transactions carried out either by transferring rights or encumbering rights, there will be problems in the future and limit land owners in carriying out legal actions.

Abstract

Masyarakat adat merupakan salah satu segmen riil dalam kehidupan Berbangsa dan Bernegara dan memiliki berbagai kepentingan yakni kepentingan politik, ekonomi, budaya, hukum, politik, perekonomian, sejarah dan hak atas kehidupan otonom. Masyarakat adat juga memiliki lingkungan alam dan kekayaan alam yang terkandung di dalamnya serta kebebasan untuk mengelola serta memanfaatkan sumberdaya alam secara arif. Tujuan penulisan ini adalah untuk mengetahui Eksistensi Masyarakat Hukum adat dalam pengelolaan sumber daya alam wilayah kecil pulau- pulau perbatasan. Metode penelitian ini adalah metode penelitian normatif dengan menggunakan pendekatan peraturan perundang – undangan dan studi Pustaka, teori dan asas- asas hukum.

Abstract

Abstrak: Kegiatan PKM dengan judul “Interaksi Menyoal Hak Kekayaan Intelektual dengan Pelaku Usaha Mikro Batik Khas Maluku di Kota Ambon” bertujuan untuk: (1). Mengimplementasikan hasil penelitian terdahulu dengan permasalahan mengenai pendaftaran hak cipta sebagai jaminan perlindungan hukum motif batik, (2). Sebagai bentuk edukasi dan peningkatan pemahaman hukum khususnya di bidang HKI bagi Pelaku UMKM Batik Khas Maluku di Kota Ambon. PKM ini menggunakan metode pelaksanaan berupa kegiatan diskusi dengan masing-masing Pelaku UMKM Batik melalui sharing dan berbagi ilmu pengetahuan hukum. Kegiatan PKM ini memberikan manfaat melalui peningkatan pemahaman pelaku UMKM Batik di Kota Ambon mengenai aspek hukum HKI dalam rangka untuk memberikan perlindungan terhadap hasil karya merupa motif-motif batik khas Maluku yang dihasilkan oleh pelaku UMKM. Melalui kegiatan diskusi dan sharing ilmu antara tim pengabdian dan pelaku UMKM ini, ditemukan bahwa inisiatif dan kerja keras dari Pelaku UMKM untuk menghasilkan karya batik khas Maluku sangat tinggi, tetapi masih perlu didukung oleh pemahaman hukum HKI untuk melindungi karya tersebut, karena seringkali beberapa motif batik khas Maluku yang diambil oleh pihak lain untuk digunakan secara melawan hukum dan dianggap sebagai milik mereka. Oleh sebab itu, perlu juga peran serta semua elemen baik itu masyarakat, pelaku UMKM, pemerhati UMKM, pemerintah daerah bahkan perguruan tinggi untuk mengupayakan perlindungan hukum di bidang HKI dalam rangka meningkatkan pemahaman hukum masyarakat secara umum dan secara khusus pelaku UMKM. Interaction on Intellectual Property Rights with Maluku Batik Small and Medium-Sized Enterprises Actors in Ambon CityAbstract: The community service activity entitled " Interaction on Intellectual Property Rights with Maluku Batik Small and Medium-Sized Enterprises Actors in Ambon City" aims to (1). Implementing the results of previous research with problems regarding copyright registration as a guarantee of legal protection for batik motifs (2). It is a form of education that increases understanding of the law, especially in the field of IPR for Maluku Typical Batik MSMEs in Ambon City. This community service uses the implementation method in the form of discussion activities with each Batik MSME actor through sharing and sharing legal knowledge. This Community Service activity provides benefits by increasing the understanding of Batik MSME actors in Ambon City regarding the legal aspects of IPR in order to protect the work of Maluku typical batik motifs produced by MSME actors. Through discussion and knowledge-sharing activities between the community service team and MSME actors, it was found that the initiative and hard work of MSME actors to produce typical Maluku batik works were very high. However, they still needed to be supported by an understanding of IPR law to protect these works because, often, some batik motifs typical of Maluku were taken by other parties to be used against the law and considered their own. Therefore, it is also necessary to have the participation of all elements, be it the community, MSME actors, MSME observers, regional governments, and even universities, to seek legal protection in the field of IPR in order to increase understanding of public law in general and specifically MSME actors.
