Abstract

Metode penelitian yang dipergunakan oleh peneliti adalah metode penelitian yuridis normatif dengan sifat penelitian deskriptif dimana meneliti data sekunder untuk mencari jawaban atas dua permasalahan, yaitu: 1. melihat bagaimana ketentuan hukum yang mengatur pelaku tindak pidana pencucian uang dari hasil tindak pidana korupsi di Indonesia; dan 2. melihat bagaimana ketentuan hukum dalam sistem pembuktian tindak pidana pencucian uang hasil dari tindak pidana korupsi sudah sesuai serta memenuhi rasa keadilan dan kepastian hukum. Berdasarkan hasil penelitian ditemukan dua kesimpulan, yaitu: 1. Sistem pembuktian tindak pidana pencucian uang yang tidak diketahui predicate crime tidak wajib dibuktikan terlebih dahulu menurut undang-undang No. 8 Tahun 2010 Tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang. Seharusnya pembuktian terhadap predicate crime harus dibuktikan terlebih dahulu atau dibuktikan bersamaan dengan tindak pidana pencucian uang sebagai tindak pidana turunannya sehingga digabung penyidikan dan penuntutanya dalam bentuk kumulatif. 2.Penyidik dan Penuntut KPK dalam pembuktian tindak pidana pencucian uang yang predicate crime tidak diketahui sesuai dengan pengertian dan formulasi hukum mengenai tindak pidana pencucian uang pada Pasal 69, 74, 75, 77 dan 78 UU TPPU No 8 tahun 2010 maka langsung atau tidak langsung hal tersebut telah membuka ruang untuk terjadinya permasalahan atau persoalan hukum.

Abstract

The development of Indonesia's transportation system is a community need. Given the rather dominant role played by land transport, it is imperative that land transport ensure that traffic is safe, orderly and smooth in order to ensure a smooth flow of various activities in the realization of the public interest. And how to be efficient. Traffic accident frequency. Many of the causes of traffic accidents are caused by negligence and human error, and these traffic accidents have resulted in many losses, such as damage to public facilities and casualties. The research methods used by the authors are prescriptive laws that research library materials or secondary data. The approaches used by the authors are the legal approach and the case approach. A legal approach is taken by directly examining the laws and regulations relevant to the legal issue under investigation. Approaching the case, the author analyzes Court Decision No.665/Pid.B/PN.JKT.PST. Article 311 of the Road Traffic Transport Law No.22 of 2009 precluded the application of Articles 338 and 359 of the Penal Code by the existence of regulations on traffic accident norms and criminal penalties as a special case for traffic accidents. Abstract

The bank's activity as an intermediary is to collect and distribute funds in the form of credit. Creditors in providing credit to debtors adhere to the principle of prudence, because creditors are faced with credit risk. For this reason, banks in providing credit to debtors have several conditions that must be met, including the existence of guarantees, both material (material) and immaterial (individual) guarantees. One form of individual guarantee is a guarantor (borghtoct), which is found in the case of the Supreme Court's Decision on Bankruptcy and PKPU. The research method used is normative research with a statutory approach. The results of the study found that the petitioned bankruptcy case was rejected or at least declared unacceptable because the PKPU applicant did not have legal standing because the facility agreement underlying the debt was legally invalid and therefore null and void, as well as the company guarantee deed as well as the legal limit.

Abstract

Penyelesaian sengketa dalam asuransi marine cargo seringkali melibatkan pertimbangan yang kompleks terkait dengan hukum yang berlaku. Salah satu aspek krusial dalam penyelesaian sengketa ini adalah penerapan klausul choice of law, yang menentukan hukum yang akan mengatur perjanjian asuransi. Di Indonesia, penerapan choice of law dalam penyelesaian sengketa asuransi marine cargo menjadi fokus perhatian utama, mengingat kompleksitas hukum yang terlibat serta peran pentingnya dalam menentukan hak dan kewajiban para pihak. Oleh karena itu, penelitian yang bersifat yuridis terhadap penerapan choice of law dalam penyelesaian sengketa asuransi marine cargo di Indonesia menjadi relevan dan penting untuk dilakukan. Penelitian ini menggunakan penelitian hukum yuridis normatif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang dan kasus. Peneliti menggunakan sumber data sekunder dengan melakukan pengumpulan data melalui analisis dokumen atau tinjauan pustaka. Metode analisis data yang digunakan dalam penelitian ini adalah kualitatif dengan kerangka berpikir deduktif. Dengan demikian, penelitian ini didasarkan pada analisis hukum yang berlaku dan studi kasus untuk mendapatkan pemahaman mendalam tentang masalah yang diteliti. Pilihan jalur penyelesaian sengketa, seperti arbitrase atau litigasi, juga memengaruhi proses dan hasil penyelesaian. Pendidikan dan pelatihan yang memadai bagi hakim dan pengacara diperlukan untuk meningkatkan kemampuan hakim dalam menangani kasus-kasus yang kompleks. Dalam konteks keabsahan perjanjian asuransi marine cargo yang menggunakan klausul pilihan hukum dalam hukum perdata Indonesia, beberapa aspek perlu dipertimbangkan dengan mendalam. Prinsip kebebasan berkontrak harus diakui, namun harus sesuai dengan batasan yang ditetapkan oleh hukum perdata Indonesia. Perlindungan konsumen juga harus dijamin, dengan perusahaan asuransi bertindak dengan itikad baik dan memberikan informasi yang jelas kepada pemegang polis. Penegakan hak-hak pemegang polis oleh pengadilan dan penyelesaian sengketa yang memperhatikan prinsip-prinsip keadilan dan kepastian hukum merupakan bagian integral dari perlindungan konsumen dalam transaksi asuransi. Dengan mempertimbangkan semua aspek ini secara cermat, pihak-pihak yang terlibat dalam perjanjian asuransi dapat memastikan perlindungan yang memadai dan penyelesaian sengketa yang adil

Abstract

Sustainable tourism village certification is one of the sustainable tourism certification products issued by the Indonesian Sustainable Tourism Certification Council. The sustainable tourism village certification program was initiated by the Ministry of Tourism and Creative Economy in 2020 aimed at developing sustainable tourism in Indonesia. Penglipuran Tourism Village has community-based and sustainable tourism management, but the management's human resources need to be strengthened. Meanwhile, sustainable management requires specific knowledge and skills to reduce the negative impacts of tourism. The aim of this research is to analyze efforts to protect the management of Tourism Villages through sustainable tourism village certification based on Law of the Republic of Indonesia no. 10 of 2009 on Tourism. This research is normative legal research with a statutory approach, analysis of legal concepts (analytical conceptual approach), and case study methods supported by secondary data. Researchers found that the role of sustainable tourism village certification as a condition for business standardization in the form of business certification was studied in the form of preventive and repressive legal protection means. Preventive legal protection is regulated in Article 19 and Article 52 of Law No. 10 of 2009 on Tourism. Repressive legal protection is regulated in Articles 27, 62, 63 and 64 of Law No. 10 of 2009 on Tourism.

Abstract

In relation to fulfilling their daily needs, the position and existence of consumers in a dominant society are under businessmen. This has caused the potential loss of customers due to the actions of businessmen. It is not unusual for businessmen to exploit consumers for their interests and advantages without thinking and often neglecting the rights of consumers. This has given rise to disputes between consumers and businessmen that need to be resolved thoroughly and fairly, with legal certainty. The Act No. 8 of 1999 concerning consumer protection has regulated the resolution of consumer disputes which can be carried out outside the court through the Consumer Dispute Settlement Agency (BPSK). The existence of BPSK as a consumer dispute resolution institution does not seem to provide maximum protection to consumers because there are many problems, including the process and procedures for resolving disputes at BPSK. Based on the results of the research and analysis carried out, it is concluded that the resolution of consumer disputes through BPSK in terms of time is relatively faster because it has to be decided within a maximum of 21 working days compared to resolving consumer disputes through general courts which take years. But on the other hand, many problems exist related to the existence of BPSK as a consumer dispute resolution institution, including in the institutional sector, BPSK human resources, inconsistent laws, and so on.
