Abstract

Meningkatnya angka perceraian secara tidak langsung berdampak pada anak. Penelitian ini bertujuan untuk mengeksplorasi tindakan mantan suami yang tidak membayar biaya pemeliharaan (hadhanah) kepada anaknya dikaji dari prespekti Perlindungan Anak serta Faktor tindakan mantan suami yang tidak membayar biaya pemeliharaan (Hadhanah) kepada anaknya. Metode penelitian ini menggunakan jenis penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Teknik pencatatan dalam penelitian dengan mengumpulkan bahan hukum yang relevan dengan masalah yang diangkat dan dibaca kemudian dikelompokkan sebelum diinterpretasi. Bahan tersebut dianalisis dengan metode kualitatif. Penelitian ini menghasilkan kesimpulan bahwa mantan suami yang tidak menjalankan kewajibanya untuk membayar biaya pemeliharaan (Hadhanah) kepada anaknya adalah termasuk tindakan penelantaran yang telah memenuhi unsur pasal 76B dan/atau pasal 76C Undang-undang Nomor 35 tahun 2014 tentang perubahan atas Undang-undang nomor 23 tahun 2002 tentang perlindungan anak adapun yang menjadi faktornya adalah kondisi mantan suami yang tidak mempunyai uang karena sudah tidak bekerja lagi, mantan suami sudah memiliki keluarga baru sehingga lebih fokus menjalankan kewajiban terhadap keluarga barunya tersebut, sudah enggan berkomunikasi dengan mantan istri bahkan berhubungan lagi dengan keluarga mantan istri serta persoalan mental tanggung jawab mantan suami yang sengaja tidak memberikan nafkah (Hadhanah) kepada anaknya padahal mampu secara finansial.

Abstract

Freedom of speech is a fundamental human right in democratic systems, including in Indonesia, which is guaranteed by the 1945 Constitution of the Republic of Indonesia. However, despite being protected by the constitution, this freedom is not absolute and needs to be limited in certain cases to maintain public order, national security, and the rights of others. This study aims to analyze how freedom of speech is regulated in Indonesia's constitutional law, and how the state maintains the balance between individual freedom and public order. Using a normative research method, this study examines the legislation related to freedom of speech, such as the 1945 Constitution, the Electronic Information and Transactions Law (UU ITE), and relevant Constitutional Court decisions. Limitations on freedom of speech in Indonesia are regulated based on international legal principles that recognize freedom of expression, with the caveat that this right can be limited for the sake of public interest, morality, and national security. The findings of this study indicate that while freedom of speech is a crucial right in democracy, the state has the authority to limit this freedom under certain conditions. These limitations must be applied proportionally and in accordance with the principles of a democratic rule of law. The state plays a vital role in creating a balance between freedom of speech and public order, ensuring that this freedom can be maximized without undermining the social and political stability of the country.

Abstract

This research aims to determine the obstacles in managing village assets as well as regional government policies in overcoming obstacles to managing village assets. This research method uses empirical legal research with a sociological juridical approach. As for the research results that obstacles in managing village assets include village assets, especially village treasury land, which are mostly controlled by third parties, unequal potential for village assets, inharmonious conditions of village government, difficulty in making decisions in determining the fair value of village assets, not actually including the results of village asset management. into the APBDes. As for the government's policies in overcoming these obstacles, the DPRD and the regional government periodically carry out synergistic activities through Focus Group Discussions (FGD) to unravel problems in managing village assets, the government together with the DPRD always receive complaints and mediate to find solutions related to obstacles in managing village assets, The DPRD encourages regional governments through sub-districts to provide assistance in submitting minutes of the handover of the position of village head in relation to the inventory of village assets, and the Government together with the DPRD carry out studies to amend or adjust Regional Regulations or Regent Regulations regarding village asset management according to input from the village government with prior implementation. comprehensive study.

Abstract

This research focuses on the political education about presidential threshold or the threshold of votes that a political party must obtain in an election to be able to nominate a presidential candidate. The presidential threshold regulates the minimum requirements for submitting presidential and vice presidential candidates, namely that 20% of the votes of a political party or combination of political parties must be obtained. To explore this study, the researchers formulated the problem as follows: What are the basic considerations in determining the 20% presidential threshold? With the aim of knowing and analyzing the basis for considering the 20% presidential threshold in selecting presidential and vice presidential candidates in Indonesia..The results of the research show that a. in consideration of determining the presidential threshold, it does not match the essence of its initial objectives, because it only benefits the majority party and in its preparation it is not in accordance with the aspirations of strengthening the presidential system and simplifying the party.
