Abstract

The obstacles faced by micro, small, and medium enterprises (MSMEs) in participating in public procurement even though they are legal entities are related to the system, culture, and human resources implementing public procurement. The first obstacle is Indonesia's rigid and inflexible public procurement system. The qualification requirements set by the government often do not match the capabilities of MSMEs. In addition, the lack of internet network access support in the regions makes it difficult for MSMEs to participate in the procurement of goods and services. The second obstacle is the culture of corruption, collusion, and nepotism (KKN) that is still inherent in the Indonesian bureaucracy. Goods and services procurement is one of the biggest contributors to corruption cases in Indonesia. The third barrier is the limited human resources, both in terms of numbers and competencies, owned by MSMEs. MSMEs often have inadequate quality of human resources, especially in terms of knowledge and skills in the field of goods and services procurement. The research method used is normative juridical with a statutory approach and conceptual approach. The purpose of this research is to find out what causes MSEs to be difficult to participate in the procurement of government goods and services even though they are legal entities. This research is expected to contribute to the development and improvement of the public procurement system, so that in practice it can involve more micro, small, and medium enterprises, especially those that already have legality and meet technical requirements.

Abstract

Elections are a means of exercising popular sovereignty guaranteed in the constitution. Constitutionally, the legislative election system adopted by Indonesia is a proportional representation system variant of the "list proportional reprecentation" (LPR) with an open list model. However, the Supreme Court Decision Number 57/P/HUM/2019 has changed the paradigm of election. The purpose of this study was to determine the implications of the Supreme Court's Decision Number 57/P/HUM/2019 on the electoral system in Indonesia. The research method is normative by using the statutory approach and conceptual approach to analyze qualitatively. The results showed that, a constitutional election system based on the mandate of the Constitutional Court Decree Number 22-24/PUU-VI/2008 is a proportional election system with an open list model, where the vote acquisition is based on the principle of "most votes" meaning that if the candidate wins the most votes the first cannot be inaugurated for some reason, it is automatically replaced by the second most votes winner, and so on. However the Supreme Court Decree Number 57/P/HUM/2019 states that the replacement of legislative candidates who are unable to remain remains the discretionary authority of the leadership of political parties. To avoid confusion in understanding the electoral system paradigm, in the future the Indonesian state must have the courage to apply the latest variant, "mixed member proportional" (MMP).

Abstract

Substansi pelaksanaan pemilu adalah wujud pelaksanaan hak konstitusional warga negara sekaligus hak konstitusional partai politik yang dijamin oleh UUD 1945. Pasal 6 ayat (2) UUD 1945 memberikan hak konstitusional bagi partai politik peserta pemilu untuk mengusulkan pasangan calon presiden dan wakil presiden, namun hak tersebut tidak bisa digunakan sebab terhalang dengan persyaratan ambang batas pencalonan presiden (Presidential threshold). Penelitian ini memfokuskan pada hak konstitusional partai politik dalam mengusulkan pasangan calon presiden dan wakil presiden dengan menggunakan metode penelitian normatif serta pendekatan perundang-undangan dan pendekatan konseptual guna menganalisis permasalahan yang hendak dikaji. Hasil dan pembahasan menyimpulkan bahwa Partai politik peserta pemilu berhak mengajukan pasangan calon presiden dan wakil presiden secara sendiri-sendiri (independent) tanpa presidential threshold. Hal itu merupakan jaminan konstitusional Pasal 6A ayat (2) berbunyi: “pasangan calon presiden dan wakil presiden diusulkan oleh partai politik atau gabungan partai politik sebelum pelaksanaan pemilihan umum”. Sebab norma presidential threshold bukan merupakan persyaratan konstitusional yang dikehendaki oleh para pemurus konstitusi. Sebaliknya keberlakuan norma presidential threshold hanya dilandasi basis argumentasi politik.
