Abstract

The urgency of the protection of domestic products in supporting economic value and increasing market competitiveness plays a large role through the registration of intellectual property rights (E-IPR). The existence of intellectual property in providing legal security for domestic products was essential for its certainty and safety. This should be done asa precaution in anticipation of unhealthy business rivalries and a minimizing of counterfeit products in the market. The methods used in supporting this study through normative research using a constitutional and case approach. Additionally, it sustained the legal source from primary and secondary data and was analyzed using descriptive analysis methods. The purpose of research is to determine the extent to which intellectual property rights protection has played in supporting the success of domestic products in the market. In view of the high presence of domestic products, the intellectual property rights registration is required by governments and stakeholders through the creation of domestic products to ensure early legal awareness of the resulting creativity needed to protect them by intellectual property. The implementation of intellectual property e-rights (E-IPR) is part of the economic laws of development because it includes efforts to enhance and develop domestic products and thus protect the state, improve the competiting power of the product, and create social welfare.

Abstract

Persaingan pasar global yang semakin ketat mengharuskan pelaku usaha harus memberikan perlindungan dan jaminan atas karya intelektualnya untuk bisa diterima di pasar internasional. Indonesi dan China merupakan negara anggota world trade organization (WTO) yang sudah lama bergabung dalam meramaikan pasar global. Untuk bisa bersaing dan diterima dalam menghasilkan produk, kedua negara tersebut memiliki sistem perlindungan karya intelektual khusus indikasi geografis yang berbeda. Penulisan ini menganalisa mengenai perbedaan diantara kedua negara tersebut dalam penerapan system perlindungan indikasi geografis dengan metode penelitian normative yang didukung dengan data sekunder serta pendekatan yuridis normative sebagai bahan referensi. Indonesia menganut 2 (dua) system yang terdiri dari sistem konstitutif dan deklaratif, sedangkan China menganut system Merek Dagang dan Sistem SAQSIQ (State Administration of Quality Supervision, Inspection and Quarantine). Jadi, masing-masing negara memiliki sistem yang berbeda sesuai dengan aturan yang dimiliki dan dikembangkan dengan pedoman yang sama yaitu Perjanjian Trade Related Aspect of intellectually Property right (TRIPs).

Abstract

The urgency of intellectual property protection is the main key in increasing competitiveness in global competition. Sragen Regency has great potential to obtain legal protection on intellectual property sourced from the industrial and tourism sectors. This qualitative and normative study used secondary data and a normative juridical approach. Based on the analysis with Law Number 20 of 2016 on Brands and Geographical Indications, Sragen Regency has products to be protected with geographical indications, namely the Sangiran Stone craft located at the Museum Manusia Purba Sangiran. This condition strengthens geographical indications in Sragen as intellectual property considering that the tourism sector has a very large correlation with the industrial sector. Dissemination can be carried out by the government and stakeholders as a form of encouragement and support for groups of business actors in the Sragen area so that they are aware of the law and understand the essence of law so that they can obtain legal protection for Sangiran stone crafts through geographical indications as intellectual property in Sragen Regency.Keywords: Geographical indications, Intellectual Property, Tourism
