Abstract

This study examines the implementation of the use of force by Indonesian National Police (Polri) officers in handling mass demonstrations, focusing on the application of Regulation of the Chief of the Indonesian National Police Number 1 of 2009. Using a normative juridical method, the research analyzes statutory provisions, legal doctrines, and selected empirical cases from West Papua to assess compliance with the principles of legality, necessity, proportionality, and accountability. The findings indicate that, although the regulatory framework has formally adopted international human rights standards and a graduated use-of-force model, significant gaps persist between normative rules and operational practice. In several documented incidents, coercive measures such as tear gas, rubber bullets, and mass arrests were applied prematurely, without sufficient de-escalation efforts or transparent post-action accountability. These shortcomings are influenced by structural weaknesses in internal oversight, limited professional training, and an institutional culture that prioritizes security over dialogue-based policing. The study concludes that strengthening external oversight mechanisms, enhancing human rights-based training, and reforming organizational culture are essential to align police practices with democratic principles and international standards on the use of force

Abstract

Penelitian ini dilaksanakan di Manokwari, bertujuan untuk mengetahui proses eksekusi jaminan fidusia setelah putusan MK No. 18/PUU-XVII/2019 bilamana debitur wanprestasi dan perlindungan hukum bagi kreditur yang diberikan UU Jaminan Fidusia setelah putusan MK No. 18/PUU-XVII/2019. Data yang diproses selama penelitian dianalisis secara kualitatif kemudian disajikan secara deskriptif yaitu dengan menjelaskan, menguraikan dan menggambarkan sesuai dengan permasalahan yang berhubungan dengan penelitian. Hasil penelitian menunjukan bahwa: (1) Pengaturan eksekusi objek jaminan fidusia sebelum adanya Putusan Mahkamah Konstitusi diatur di dalam Pasal 29 sampai pada Pasal 34 Undang-Undang No 42 Tahun 1999 tentang Jaminan Fidusia, namun setelah adanya putusan MK No 18/PUUXVII/2019 menyatakan bahwa sertifikat jaminan fidusia tidak mempunyai kekuatan eksekutorial tanpa adanya kesepakatan para pihak antara Debitur dan Kreditur mengenai konsep cidera janji atau wanprestasi, dan Debitur tidak secara sukarela menyerahkan objek jaminan fidusia. (2)Perlindungan hukum bagi Kreditur/ penerima jaminan fidusia ketika Debitur/pemberi jaminan fidusia melakukan cidera janji (wanprestasi) dalam hal Debitur tidak dengan sukarela menyerahkan objek benda yang dijadikan jaminan fidusia pasca putusan MK No 18/PUU-XVII/2019, maka Kreditur/ penerima jaminan fidusia dapat mengajukan permohonan pengangkatan penangguhan atas hak eksekusinya sesuai dengan mekanisme yang berlaku pada Pasal 57 Ayat (3), Ayat (4), dan Ayat (5) Undang-Undang No 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang.

Abstract

This article examines the position of intellectual property rights (IPR) within the national legal framework as a mechanism to strengthen innovation and accelerate the process of industrialization aligned with the principles of sustainability. The discussion focuses on reinforcing the legal protection framework for creative works and technological discoveries in relation to the achievement of Sustainable Development Goal 9 (SDG 9), which emphasizes the importance of infrastructure development, inclusive industrial growth, and the enhancement of technological capacity. This study adopts a normative legal approach through literature review of statutory regulations, international legal instruments, and national policy frameworks from various jurisdictions. The findings reveal that the conceptualization of IPR must be broadened—from a solely protective mechanism to an integral component of the legal infrastructure for development. Institutional disparities, structural barriers, and limitations in legal access continue to obstruct the strategic role of IPR in many developing countries, including Indonesia. Accordingly, there is a pressing need for policy frameworks that are open, equitable in access, and responsive to the needs of informal-sector innovators. Legal protection for IPR must be coupled with principles of benefit-sharing and distributive justice in the governance of innovation outputs. These findings suggest the urgency of redesigning the national IPR system to substantively support sustainable development objectives.
