Abstract

Dalam fikih disebutkan ada tiga larangan mewarisi, salah satunya adalah perbedaan agama (ikhtilāf al-dayn). Jumhur fukaha berpendapat bahwa antara muslim dan non-muslim tidak saling mewarisi. Namun, ada fukaha yang membolehkan muslim mewarisi non-muslim, tetapi tidak sebaliknya. Dalam konteks kekinian, Al-Qaraḍāwi berpendapat sama dengan minoritas fukaha. Penulis tertarik meneliti bagaimana metode ijtihad yang dilakukan sehingga menghasilkan kesimpulan yang berbeda antara jumhur dan minoritas fukaha. Kemudian antara minoritas fukaha dengan Al-Qaraḍāwi yang menghasilkan kesimpulan yang sama. Metode ijtihad tersebut dianalisis dengan menggunakan empat teori yaitu; teori asas keadilan dan maslahat, teori ta’abbudi dan ta’aqquli, teori mu’aqqad dan mu’abbad, serta teori takhṣīṣ. Metode yang digunakan adalah metode deskriptif analisis, dengan teknik data liblary research (penelitian kepustakaan). Dari hasil penelitian diketahui bahwa: (1) hadis larangan mewarisi antar agama adalah hadis ahad, dan hadis ahad itu merupakan ẓannī al-wurūd; (2) semua fukaha sepakat bahwa non-muslim tidak bisa mewarisi muslim. Terjadi perbedaan pendapat mengenai hukum muslim mewarisi non-muslim, akibat adanya perbedaan metode ijtihad. Minoritas fukaha dan Al-Qaraḍāwi membolehkan muslim mewarisi non-muslim, namun ada perbedaan dalam metode ijtihad yang ditempuh. Minoritas fukaha yang diwakili Ibnu Taimiyah dan Ibnu Qayyim melakukan takṣīṣ, sedangkan Al-Qaraḍāwi melakukan takwil; (3) Al-Qaraḍāwi tidak konsisten dengan pandangannya yang menyebutkan bahwa maslahat dalam pewarisan adalah menguatkan ikatan keluarga. Karena secara logika lurus, larangan dzimmī —sebagai hasil dari takwil lafaz kafir— untuk menerima warisan dari muslim, hanya memandang maslahat secara sepihak, serta rawan terjadinya keretakan hubungan dalam keluarga; (4) kebolehan mewarisi antara muslim dengan non-Muslim, tidaklah bertentangan dengan prinsip umum Al-Quran yang universal.

Abstract

Understanding religion (fiqh al-din) is more specific than just knowing religion (al-'ilm bi al-din). Understanding religion will not be realized except by knowing the content and secrets of religion. The science that includes understanding the intentions contained in religious texts is in the study of maqāshid. Among the ways to produce a moderate understanding is to combine particular texts (nashus juz'iyyah) with global intentions (maqāshid kulliyyah). Then the principle that is used as the basis for understanding the text is to look at the difference in meaning in worship and muamalah and distinguish between fixed goals (maqāshid) and changing means (wasīlah). As a sharia area, minorities live in peace in Aceh, there is no conflict between Muslims and non-Muslims. However, the problem has occurred in the internal circles of Muslims in the last ten years as a result of the religious understanding of the Acehnese Muslims. Therefore, it is necessary to look at the concept of moderation in Islamic studies and how urgent the maqāshid al-syarīah approach is to strengthening religious moderation in Aceh. This research is field research with qualitative methods, while the data analysis uses descriptive-analytic with the maqāshid al-syarīah approach. The results show that religious moderation in Islamic studies is not a new thing, known as wasathiyah al-Islām. Then there are not a few who think that the internal moderation of Muslims in Aceh has not been going well and there is still a need for further strengthening and socialization related to religious moderation.

Abstract

Penegakan hukum terhadap kejahatan cyber crime merupakan tantangan yang kompleks dalam konteks perkembangan teknologi informasi dan transaksi elektronik. Studi ini bertujuan untuk memberikan tinjauan yuridis serta menganalisis implementasi Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik dalam penegakan hukum terhadap kejahatan cyber crime. Metode penelitian yang digunakan adalah analisis dokumen dan studi pustaka untuk mengumpulkan data tentang peraturan hukum yang berkaitan dengan kejahatan cyber crime serta studi implementasi Undang-Undang Nomor 11 Tahun 2008. Hasil analisis menunjukkan bahwa kejahatan cyber crime, termasuk tindak pidana yang kompleks, memunculkan berbagai tantangan dalam penegakan hukum. Meskipun demikian, Undang-Undang Nomor 11 Tahun 2008 memberikan landasan hukum yang penting untuk menangani kejahatan tersebut. Penegakan hukum cyber crime juga memerlukan kerjasama erat antara pihak kepolisian dan penyedia layanan internet (ISP) serta kesadaran hukum masyarakat. Kesimpulannya, penegakan hukum terhadap kejahatan cyber crime memerlukan pendekatan yang holistik dan terpadu, dengan penguatan peraturan hukum yang relevan dan upaya preventif yang efektif. Implementasi Undang-Undang Nomor 11 Tahun 2008 menjadi landasan yang penting dalam membangun kerangka kerja untuk penegakan hukum yang lebih efektif terhadap kejahatan cyber crime.

Abstract

The old maqāshid theory which still survives and is popular among ushuliyūn, there are five known as al-dharūriyyāt al-khamsah. The discourse to add al-dharūriyyāt al-khamsah to aldharūriyyāt al-sittah or al-sab'ah and so on, has been rolled out by ushuliyūn figures, although the addition received mixed responses. One of the additional discourses is to make hifzhu al ‘irdh part of al-dharūriyyāt. Such discourse has been offered by Tāj al-din al-subki in the book jamâu al-jawāmi’, as well as At-Thūfi and Al-qarāfi, only Al-qarāfi is not so strict. The modern figure who offered the idea back was Yusuf Al-Qaradhawi who later received a positive response from Muhammad Ahmad Al-Qayatī in his dissertation. Al-Syāthibi makes hifzhu al-‘irdh included in the category of hifzhu al-nafs. Likewise AlGhazali and Ibn Al-Hajib did not make hifzhu al-‘irdh included in the category of al-dharūrīy. This attitude is supported by modern maqāshid figures including Ibn ‘Āsyur, Ramadan Al-Buthi and Ahmad Al-Raisuni. In addition there is also a third opinion offered by Ibn Zaghibah ‘izz Al-Din who made hifzhul al-'irdh part of dharuriyat but not in the kulliyah category but included in the juz’iyyah category. The study was conducted using descriptive analysis methods, with data library research techniques (library research), the approach taken was a sociological approach. The results of the study note that: (1) the existence of times and technology that is so fast and 'radical', indirectly affect social and legal changes; (2) the existence of ikhtilāf among ushuliyūn and related modern figures to make hifzhu al-‘irdh as the category of al-dharūriy or al-hājiy; (3) with the social transformation that is so fast, then the discourse makes hifzhu al-sebagaiirdh as categorical al-dharūriy is a necessity.
