Abstract

Disparities in judges' decisions in human trafficking cases indicate inconsistency in delivering verdicts for similar or related cases. The primary objective of this study is to identify various factors influencing the differences in judges' decisions in human trafficking cases, including how judges assess the elements of the case, consider aggravating and mitigating circumstances, and apply the law appropriately to realize justice in court rulings. The research method used is normative juridical, with data collection techniques including the study of court decisions from the Palangka Raya District Court, books, and scientific journals. The research findings show that there are several disparities in judges' rulings on similar cases. In the judicial process, a judge's conviction is based on legally valid and admissible evidence. Sentences, such as imprisonment and fines, are influenced by various factors, including mitigating conditionslike young age, confession, remorse, and the defendant's attitude during the trial. Disparities in rulings occur due to differences in judges' convictions and the lack of clear guidelines insentencing.

Abstract

ABSTRAKPerubahan iklim telah menjadi faktor utama dalam meningkatkan risiko dan luasnya kebakaran hutan dan lahan, serta memicu peningkatan emisi gas rumah kaca. Larangan membakar hutan dan lahan diatur diberbagai peraturan perundang-undangan baik di tingkat nasional maupun lokal antara lain melalui UU Kehutanan, UU Perkebunan, UU Perlindungan dan Pengelolaan Hidup serta ditingkat daerah diatur dengan Peraturan Daerah dan Peraturan Gubernur. Namun demikian peraturan-peraturan tersebut belum memberi ruang bagi Masyarakat Hukum Adat untuk mempraktikkan kearifan lokal mengolah lahan. Masih ada anggota masyarakat terutama masyarakat hukum adat yang ditangkap karena aktivitas membakar walaupun dengan cara kearifan lokal, bahkan dipertanyakan legalitas keberadaan anggota masyarakat tersebut sebagai masyarakat hukum adat. Karena itu perlu dicari solusi yang tepat bagi upaya pengendalian kebakaran lahan dengan tetap mempertahankan eksistensi masyarakat adat dan ketahanan pangannya. Penelitian ini merupakan langkah awal untuk menjawab tantangan tersebut dengan mengidentifikasi pertentangan norma (gap) peraturan nasional dan daerah terkait kebakaran hutan serta pertentangan peraturan tersebut dengan kebutuhan serta kearifan lokal masyarakat. Metode yang digunakan dalam penelitian ini adalah jenis penelitian hukum normatif dengan metode pendekatan perundang-undangan, dan asas. penelitian ini menemukan bahwa telah diterbitkan Peraturan daerah untuk mengatur pengakuan dan perlindungan masyarakat hukum adat sebagai dasar legalitas eksistensi mereka, serta diterbitkannya Peraturan Gubernur yang mengatur larangan dan perbolehan bagi masyarakat hukum adat untuk membakar dan mempertahankan ketahanan pangannya, namun demikian masih terdapat pasal yang bertentangan dengan peraturan kehutanan. Hasil dari studi ini dapat menjadi rekomendasi kepada para pemangku kepentingan serta stakeholders di daerah agar mampu mengeluarkan kebijakan yang nantinya mampu menyelaraskan dan memperhatikan hak asasi manusia dan lingkungan.Kata kunci: kebijakan; pengendalian kebakaran hutan dan lahan; masyarakat hukum adat; perubahan iklim AbstractClimate change has become a major factor in increasing the risk and extent of forest and land fires, as well as triggering an increase in greenhouse gas emissions. The prohibition on burning forests and land is regulated in various laws and regulations at both national and local levels, including through the Forestry Law, Plantation Law, Life Protection and Management Law and at the regional level it is regulated by Regional Regulations and Governor regulations. However, these regulations do not yet provide space for Indigenous Peoples to practice local wisdom in cultivating land. There are still community members, especially traditional law communities, who are arrested for burning activities even though they use local wisdom, and the legality of the existence of these community members as traditional law communities is even questioned. Therefore, it is necessary to find the right solution for efforts to control land fires while maintaining the existence of indigenous communities and their food security. This research is the first step to answer these challenges by identifying conflicting norms (gaps) in national and regional regulations related to forest fires as well as conflicts between these regulations and the needs and local wisdom of the community. The method used in this research is a type of normative legal research with a statutory and principled approach. This research found that a regional regulation has been issued to regulate the recognition and protection of customary law communities as the basis for the legality of their existence, as well as the issuance of a Governor's Regulation which regulates the prohibition and permission for customary law communities to burn and maintain their food security, however there are still articles that conflict with this. forestry regulations. The results of this study can be used as recommendations to stakeholders and regional stakeholders to be able to issue policies that will be able to harmonize and pay attention to human rights and the environment.Keywords: policy, forest and land fire control, indigenous peoples, climate change.

Abstract

Pendidikan memegang peran penting dalam pembangunan manusia dan peningkatan kualitas hidup bangsa. Salah satu bentuk pengabdian nyata dalam pendidikan di Indonesia adalah melalui program Kuliah Kerja Nyata (KKN) yang diadakan setiap tahun di Universitas Palangka Raya. Salah satu KKN Reguler dilaksanakan di Desa Tumbang Nusa dengan Tema KKN “UPR BERKONTRIBUSI, DESA BERINOVASI” pada desa Tumbang Nusa tersebut dilaksanakan program kerja yang telah kami buat yaitu desa bebas stunting. Stunting adalah kondisi kekurangan gizi kronis yang secara signifikan mempengaruhi perkembangan fisik dan kognitif anak-anak. Program pengabdian kepada masyarakat ini bertujuan untuk mencegah stunting di Desa Tumbang Nusa, Kecamatan Jabiren Raya, Kabupaten Pulang Pisau. Program ini mencakup berbagai kegiatan seperti edukasi gizi, pemeriksaan kesehatan, dan penyediaan makanan bergizi. Hasil menunjukkan adanya peningkatan yang signifikan dalam pemahaman dan praktik masyarakat terkait gizi dan kesehatan anak.

Abstract

This study examines the phenomenon of power asymmetry between the executive and legislative branches in the legislative process in Indonesia after the amendment of the 1945 Constitution, which has resulted in the weakening of the role of the House of Representatives (DPR) as a lawmaker. The study aims to analyze the weakening of the DPR's position and the implications of power asymmetry on the quality of national legislation. The methods used are a juridical-normative and a juridical-empirical approach, with qualitative analysis of secondary data in the form of legislative documents, meeting minutes, and literature reviews. The study's results reveal two main findings. First, the DPR has been weakened since the amendment of the 1945 Constitution due to the executive's dominance in controlling the National Legislation Program (Prolegnas) agenda and party coalitions, with 91% of the 48 laws for the 2020-2024 period originating from executive initiatives, making the DPR more of a ratification mechanism than an independent lawmaker. Second, this asymmetry of power has serious implications for the quality of legislation, which lacks transparency and public participation, as seen in the case of the Job Creation Law, which was declared conditionally unconstitutional, and the high number of judicial reviews at the Constitutional Court (more than 1,700 petitions), which indicates a systemic failure of the legislative system. These findings emphasize the need to reformulate the roles and working mechanisms between the DPR and the President to ensure a more balanced, participatory, and accountable legislative process.

Abstract

The case of sexual intercourse against children is a serious crime that causes physical, psychological, and social impacts on the victim, so that the fulfillment of the right to restitution is a crucial element in legal protection for children, because it plays a role in the victim's recovery effort to return their condition as close as possible to the state before the crime occurred. This study aims to analyze the implementation of restitution for child victims of sexual intercourse in the jurisdiction of the Palangka Raya District Attorney's Office and examine the role and efforts of prosecutors in optimizing the implementation of restitution, including the factors that hinder it. The research method used is empirical legal research with a sociological juridical approach, which is carried out through a literature study of laws and court decisions, as well as interviews with relevant law enforcement officials, then analyzed qualitatively. The results of the study indicate that although restitution has been regulated normatively in various laws and regulations, its implementation has not been optimal due to the limited economic capacity of the perpetrator, the low understanding of victims and their families regarding the right to restitution, and the less than optimal coordination between prosecutors, law enforcement officials, and the Witness and Victim Protection Agency. This study concludes that optimizing restitution requires strengthening regulations, institutional readiness, and strong synergy between prosecutors, investigators, judges, and the LPSK so that protection can be realized effectively.
