Abstract

Artikel ini mengkaji bagaimana paradigma konstruktivisme Guba dan Lincoln dapat diterapkan untuk menganalisis penalaran hukum dalam putusan pengadilan pada kasus Ferdy Sambo, sebuah perkara pidana menonjol yang melibatkan pembunuhan berencana oleh seorang perwira tinggi Kepolisian Republik Indonesia. Pertanyaan penelitian utama yang diajukan adalah: bagaimana faktor sosial dan kontekstual membentuk konstruksi realitas hukum dalam putusan pengadilan melalui pendekatan konstruktivisme? Penelitian ini menggunakan pendekatan kualitatif dengan metode studi dokumen terhadap putusan pengadilan pada tingkat pertama, banding, dan kasasi. Paradigma konstruktivisme, yang menekankan relativisme dan konstruksi bersama atas makna, digunakan sebagai kerangka analisis untuk memahami bagaimana hakim menafsirkan fakta hukum dan membentuk narasi hukum. Hasil penelitian menunjukkan bahwa putusan hukum tidak sepenuhnya didasarkan pada norma hukum formal, tetapi turut dipengaruhi oleh persepsi hakim, tekanan opini publik, dan wacana institusional, sehingga membentuk realitas hukum yang bersifat sosial dan tidak sepenuhnya objektif. Studi ini menyimpulkan bahwa paradigma konstruktivisme dapat memperluas pemahaman terhadap keadilan. Namun, hal tersebut sekaligus mengungkap keterbatasan dalam pencapaian kepastian hukum dalam konteks perkara yang bersifat politis dan sarat perhatian publik. Abstract This paper investigates how Guba and Lincoln’s constructivist paradigm can be applied to analyze judicial reasoning in the case of Ferdy Sambo, a high-profile criminal proceeding involving premeditated murder by a senior Indonesian police official. The central research question posed is: how do social and contextual factors shape the construction of legal reality within court decisions in the Sambo case through a constructivist lens? Utilizing a qualitative, document-based analysis of court rulings at the district, appellate, and supreme court levels, this study examines how judges interpret legal facts and construct legal narratives. The constructivist paradigm, which emphasizes relativism and the co-construction of meaning, provides a framework to understand how legal decisions are influenced not only by statutory provisions but also by socio-political dynamics and institutional discourse. Findings reveal that legal judgments are shaped through multi-actor interactions, including judicial perception, media framing, and public sentiment, reflecting a socially constructed reality rather than a purely objective legal truth. This study concludes that while constructivist analysis offers a broader understanding of justice, it also highlights the inherent limitations in pursuing legal certainty within highly politicized and publicized legal contexts.

Abstract

The study tries to find out basic principle of regulations related to shariah repurchase agreement investment that can provide legal certainty to the parties and the mechanism of Shariah repurchase agreement transactions. In answering the problems, the research method used is to analyze the positive laws (ius constitum) which are supported by literature studies as a reinforcement of existing regulations. The results of this study are that the legal certainty of Shariah repurchase agreement investment in the capital market can be achieved through the legal substance that has been ratified through regulations, executive, and supervisory in Shariah repurchase agreement activities in the capital market. This investment activity gets legality based on the fatwa of the National Sharia Board-Indonesia Council of Ulama. while the mechanism of Shariah repurchase agreement transactions in the capital market is the same as the transaction of repurchase agreements in general, it's just that what distinguishes it is in terms of actors who must run their companies based on Sharia Principle or has Sharia units, the securities invested based on the sharia principle and the contract used is al-bai' ma'a al-wa'd bi al-syira'. Then there is an Shariah Capital Market Expert as a party or institution that provides an assessment related to the application of Shariah principles by investors in the Indonesian Capital Market.

Abstract

Public conflicts involving both religious and economic sentiments, such as the case of the "religious seller" (Gus Miftah) and the "ice tea seller," (Sunhaji) present unique challenges that are often difficult to resolve through formal law. This study aims to analyze the settlement of cases between religious sellers and iced tea sellers based on Pancasila justice. The type of research used is normative-empirical research with a philosophical, conceptual, and socio-legal approach. The legal materials used are primary and secondary, which are then analyzed using qualitative descriptive techniques. The results of the study show that the settlement of cases between religious sellers and ice tea sellers reflects the values of Pancasila justice because it is able to provide substantive justice for the parties. This is based on the mechanism of case settlement through deliberation, which is part of the values of divine justice and humanity and also society, one of which is mutual forgiveness between the two parties. The religious seller received social sanctions from the community for his insults, which were considered a warning from God and the community. Meanwhile, the iced tea seller received rewards from God and society in the form of material and immaterial support for what he experienced. Thus, this case represents justice for both parties in the context of Pancasila justice, which encompasses divine, humanitarian, and social justice.

Abstract

Penetapan Peraturan Menteri Kelautan dan Perikanan Nomor 1 Tahun 2025 tentang Tata Cara Penyelenggaraan Nilai Ekonomi Karbon Sektor Kelautan melegitimasi pengembangan ekonomi karbon biru di Indonesia. Kebijakan ini membuka peluang ekonomi baru tetapi juga memunculkan kekhawatiran mendasar mengenai keadilan dalam distribusi manfaatnya bagi komunitas pesisir. Penelitian ini bertujuan untuk menganalisis pembagian manfaat (Benefit Sharing Mechanism) dalam regulasi tersebut menggunakan teori keadilan John Rawls. Melalui penelitian hukum normatif dengan pendekatan undang-undang dan filsafat, dengan teknik analisis deskriptif kualitatif. Hasil menunjukkan bahwa pembagian manfaat karbon biru dalam peraturan tersebut yang berbasis kinerja selaras dengan keadilan John Rawls dari aspek keadilan prosedural yang didasarkan pada koordinasi. Namun, dari aspek keadilan substantif regulasi tersebut belum dapat menjamin bahwa manfaat akan diterima oleh masyarakat pesisir. Hal ini disebabkan oleh mekanisme negosiasi yang rentan terhadap ketimpangan kekuasaan serta tidak adanya batas minimal yang jelas untuk pembagian manfaat. Oleh karena itu, diperlukan kebijakan dengan mengadopsi prinsip Persetujuan Atas Dasar Informasi Awal Tanpa Paksaan (Free, Prior and Informed Consent (FPIC)), serta menetapkan mekanisme pembagian manfaat yang lebih melindungi dan memihak masyarakat pesisir.
