Abstract

This research aims to find similarities and differences as well as the relevance of the theory of human needs according to Ash-Syāṭibī and Abraham Maslow. This research uses qualitative methods with the type of literature study. The theory used is benefit theory with a comparative approach. The data used is secondary data in the form of books written directly by ash-Syāṭibī and Abraham Maslow. This research foundthat ash-Syāṭibī's theory with a time span of emergence that is far from Maslow's theory still has significant relevance to Maslow's theory of needs. Ash-Syāṭibī's theory has the advantage of being inclusive in accepting changes in human needs in the future as a result of advances in science and technology. On the other hand, Maslow's theory is limited and closed, so that if one day a new need arises, apart from the five hierarchies of needs that have been expressed, then the new need needs to be created in a new hierarchy because it is not suitable to be included in one of the existing hierarchies, because the existing hierarchy is closed and limited. However, ash-Syāṭibī's theory regarding human needs is still implicit, not explicit like Abraham Maslow's theory. This is the weak point of Ash-Syāṭibī's theory when compared to Abraham Maslow's theory, besides that Ash-Syāṭibī has not revealed the needs of modern humans such as the need for esteem and the need for self-actualization into the hierarchy of maqāṣid al-Syarīah that he compiled Penelitian ini bertujuan untuk menemukan persamaan dan perbedaan serta relevansi teori kebutuhan manusia menurut asy-Syāṭibī dan Abraham Maslow.

Abstract

This research aims to review the boundaries of aurat in fiqh, followed by creating new boundaries according to the results of linguistic interpretation and the maqāṣid asy-syarīah approach. This research uses qualitative methods in the form of literature study with a language (lughawī) and maqāṣid asy-syarī'ah (maqāṣidī) approach. This research defines the aurat as a part of the body that must be covered for human benefit. The results of the research formulate the limits of intimate parts according to Qs. al-Nur: 30-31 are: (1) genitals, both for men and women; (2) especially for women: parts of the body that are usually worn with jewelry but are not shown to other people, such as the top of the ankle which is usually worn with ankle bracelets, the ear which is usually worn with earrings, the top of the wrist which is usually worn with bracelets, and neck to chest where a necklace is usually worn; and (3) especially for women: head to chest (hair, ears, neck and breasts are genitalia, except for the face because it is the part of the body that is usually exposed). The linguistic interpretation of the verse shows that the limits of the aurat in Qs. al-Nur: 30-31 is more appropriate to interpret it with its original meaning (maknā al-wadh'i) or the meaning of its common usage (maknā isti'māl). The research results also show that determining the boundaries of the aurat in fiqh cannot be separated from cultural influences (Arab culture), where these boundaries do not bind everyone from different clothing cultures as long as the determined boundaries are still in accordance with maqāṣid asy-syarīah.

Abstract

The research examines the legal implications of the sale of inherited land conducted without the consent of all heirs, viewed from the perspectives of Islamic law and positive law in Indonesia. The issue arises from the frequent occurrence of unilateral transactions over jointly owned inheritance property, which often leads to disputes due to a lack of legal awareness and improper understanding of the status of undivided inheritance. This research is positioned as a normative-empirical legal study, aiming to analyze both legal norms and their implementation in society. The discussion is carried out through a comparative approach between Islamic law, which emphasizes principles of justice, maslahah, and mutual consent (ridha), and positive law, particularly the Civil Code and agrarian regulations, which require agreement among co-owners for valid legal transactions. The findings indicate that, under Islamic law, such transactions are considered fasid (defective) and potentially invalid due to the absence of full authority and consent, while under positive law, they may be declared null and void or voidable, and can give rise to civil liability, including compensation claims. Both legal systems fundamentally uphold the principle of joint ownership and the necessity of collective approval, thereby highlighting the importance of legal certainty and protection for all heirs. This study also underscores the need for greater legal awareness and stricter supervision in land transactions involving inherited property

Abstract

This study aims to analyze the influence of online gambling on rural social dynamics and identify forms of social capital erosion in Jambu Rejo Village, Sumber Harta District, Musi Rawas Regency. The research employed a qualitative approach using a case study design. Data were collected through observation, in-depth interviews, and documentation involving 16 informants, including village officials, religious leaders, community leaders, youth leaders, active online gamblers, former gamblers, and family members of gamblers. Data analysis followed the interactive model of Miles, Huberman, and Saldaña, consisting of data reduction, data display, and conclusion drawing. The findings reveal that online gambling has significantly contributed to the erosion of social capital within the community. This erosion is reflected in declining social participation, weakened social interaction, reduced social trust due to debt-related problems and financial losses, increasing family conflicts, declining social solidarity, and weakened social control over deviant behavior. The study confirms that online gambling affects not only individual economic conditions but also the structure of social relationships and the social resilience of rural communities. Therefore, strengthening social capital through digital literacy programs, revitalization of community social activities, and enhanced roles of families and community leaders is essential to mitigate the negative impacts of online gambling.
