Abstract

This study aims to analyze the effectiveness of customs services in Indonesia from a legal perspective, utilizing a normative juridical approach. It examines the regulatory framework governing customs operations, identifies implementation gaps, and assesses enforcement mechanisms. Key areas of focus include bureaucratic inefficiencies, transparency issues, technological integration, and compliance enforcement. The findings highlight significant challenges in the current customs service framework, such as lengthy procedures, corruption, and inadequate use of technology. Recommendations are proposed to streamline procedures, enhance transparency, invest in technology, strengthen enforcement, and adopt international best practices. These improvements are essential for aligning Indonesia's customs services with international standards and supporting economic growth through enhanced trade facilitation.

Abstract

This study analyzes the impact of OJK Regulation Number 11/POJK.03/2016 on the implementation of sharia banking business activities and its role in ensuring the sustainability of the sharia financial industry in Indonesia. The regulation aims to strengthen governance, risk management, and transparency in sharia banking while promoting alignment with Islamic principles. Employing a qualitative juridical analysis, this research evaluates the regulation's effectiveness and identifies challenges faced by sharia banking institutions, including resource limitations, knowledge gaps, and regulatory ambiguities. The findings reveal that while the regulation has significantly improved compliance, risk management, and public trust, challenges persist in its practical implementation. Recommendations include capacity building, regulatory clarity, and technological adoption to optimize the regulation's impact. This study contributes to the understanding of regulatory frameworks in Islamic finance and offers insights for enhancing the resilience and sustainability of Indonesia's sharia financial industry.

Abstract

Masyarakat di wilayah lingkar tambang sering kali menghadapi tantangan manajemen keuangan akibat fenomena "pendapatan instan" yang memicu perilaku konsumtif dan ketergantungan pada sektor ekstraktif yang fluktuatif. Program pengabdian masyarakat ini bertujuan untuk mentransformasi pola pikir masyarakat di Kabupaten Konawe Utara dari orientasi konsumsi menjadi investasi melalui model edukasi dan pendampingan partisipatif. Menggunakan metode Asset-Based Community Development (ABCD), program ini melibatkan tahapan asesmen, edukasi perencanaan keuangan, dan pendampingan praktis pembukuan serta investasi. Hasil evaluasi menunjukkan lonjakan signifikan pada skor rata-rata literasi keuangan dari 42,5% menjadi 88,2%. Selain peningkatan pengetahuan, program ini berhasil memicu perubahan perilaku nyata, seperti pembukaan 45 akun tabungan berjangka dan digitalisasi UMKM melalui QRIS. Integrasi teori behavioral finance dengan kearifan lokal terbukti efektif mereduksi gaya hidup hedonisme dan membangun kemandirian ekonomi masyarakat melalui pembentukan kelompok "Sadar Keuangan".

Abstract

The emergence of decentralized Web3 architectures fundamentally disrupts traditional territorial monetary sovereignty, thereby challenging the constitutional mandate of state-controlled currency. This study examines the normative collision between algorithmic decentralization and state-centric monetary frameworks under the Indonesian Constitution. Employing a doctrinal legal methodology through statutory, conceptual, and functional comparative approaches, this research analyzes the central bank digital currency as a critical constitutional defense mechanism. The findings indicate that the Financial Sector Omnibus Law positions the digital fiat as a sovereign instrument to restore macroeconomic control against transnational private stablecoins. Furthermore, balancing anti-money laundering obligations with constitutional privacy rights explicitly requires a regulation-by-design architecture, specifically implementing tiered anonymity. The institutionalization of digital fiat necessitates precise legal agency attribution within permissioned smart contracts to prevent algorithmic immunity. Ultimately, this regulatory integration represents a manifestation of digital constitutionalism, renegotiating the cyberspace social contract to ensure monetary stability while proportionally protecting all fundamental civic rights.

Abstract

Perkembangan Artificial Intelligence (AI) telah membawa perubahan signifikan dalam proses penciptaan karya intelektual, termasuk karya tulis, seni, musik, dan konten digital. Kemampuan AI menghasilkan karya secara mandiri menimbulkan berbagai persoalan hukum, khususnya terkait status pencipta, kepemilikan hak cipta, dan bentuk perlindungan hukum terhadap konten yang dihasilkan. Di Indonesia, Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta masih berorientasi pada konsep human authorship, sehingga belum secara eksplisit mengatur perlindungan hukum terhadap karya yang dihasilkan oleh AI. Penelitian ini bertujuan untuk menganalisis perlindungan hak cipta terhadap konten yang dihasilkan oleh Artificial Intelligence berdasarkan hukum positif Indonesia, mengidentifikasi kekosongan norma yang ada, serta merumuskan model penguatan regulasi yang adaptif terhadap perkembangan teknologi. Penelitian menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, Bahan hukum yang digunakan terdiri atas bahan hukum primer berupa peraturan perundang-undangan dan bahan hukum sekunder berupa jurnal ilmiah, buku, dan dokumen hukum yang relevan. Hasil penelitian menunjukkan bahwa pengaturan hak cipta di Indonesia belum memberikan kepastian hukum mengenai status karya yang dihasilkan AI, terutama terkait penentuan pencipta dan kepemilikan hak cipta. Oleh karena itu, diperlukan reformulasi pengaturan melalui klasifikasi antara AI-assisted works dan AI-generated works, penetapan parameter kontribusi kreatif manusia (threshold of human contribution), serta pengaturan penggunaan karya berhak cipta sebagai training data. Reformasi tersebut diharapkan mampu memberikan kepastian hukum sekaligus mendukung perkembangan inovasi teknologi secara berkelanjutan.
