Abstract

A Covid-19 pandemic is an event that occurs beyond the parties' control and the parties' fault. However, applying force majeure and hardship in the event of a failure to fulfill achievements in the work agreement is subjective and cannot be used as a general principle. Its application must be carried out by analyzing case by case because not all entrepreneurs are affected by the Covid-19 pandemic, which then causes entrepreneurs to be unable to fulfill their obligations as debtors in work agreements. The employment relationship between workers and the company must obtain legal protection. The method used in this research is normative juridical. Normative research is where the law is conceptualized as what is written in a statutory regulation (law is books) or the law is conceptualized as a rule or norm that is used as the basis for human behavior as a benchmark for good or bad. The purpose of this study is to obtain a solution to termination of employment due to the Covid-19 pandemic by applying the principle of force majeure or hardship in the employment agreement. Research findings suggest that the principle of hardship has not been regulated in positive law in Indonesia, so business activities in Indonesia in general still depend on the force majeure principle as a clause included in agreements and dispute resolution. Companies that terminate employment relations should be replaced by postponing regular work or renegotiating contracts known as hardship

Abstract

Grant is a unilateral agreement by a grantor that is carried out by the grantor to the grantee who gives goods free of charge to the grantee. This grant is carried out between the grantor and the grantee is still alive and well. In practice, there were many cases where grants were revoked or withdrawn by the grantor for certain reasons. Therefore, this study was conducted to determine the law of withdrawal of grants by the grantors. The research method used is juridical normative and the approach method used in the research is the library research approach. In Article 712 of the Sharia Economic Law Compilation explains that the grant property can be withdrawn by the grant if the grantee approves, whereas, in Article 212 Islamic Law Compilation, the grant cannot be withdrawn under any circumstances, except for a grant related to his child. issue of the difference between the withdrawal of grant property found in the Sharia Economic Law Compilation, if the grantee agrees and voluntarily returns the grant property that has been received and in the Islamic Law Compilation, the grant property can be withdrawn, namely a parent's grant to his child, this is because the grant property can be counted as inheritance as stipulated in Article 211 of Islamic Law Compilation. These two compilation laws are used and applied in the Religious Courts to resolve disputes for Muslim parties.

Abstract

This research examines the legal perspective of the inheritance rights of adopted children based on the Indonesian Civil Code. Inheritance is the transfer of property rights from a deceased person to living heirs, and in many cases, adopted children may be entitled to inherit from their adoptive parents. However, the status of adopted children in inheritance laws can be complex and raises various legal issues. The study explores the concept of adoption and its implications on the inheritance rights of adopted children. It analyzes relevant provisions of the Indonesian Civil Code and other related legal texts to understand the legal status of adopted children as heirs. The research also investigates the challenges and problems that may arise in determining the inheritance rights of adopted children, particularly when there are natural descendants or other adoptive children involved. By adopting a qualitative research approach, the study gathers data through legal document analysis and interviews with legal experts. The findings shed light on the legal intricacies surrounding the inheritance rights of adopted children and provide insights into the recognition and protection of their rights under the prevailing legal framework. The research contributes to the understanding of the legal complexities surrounding adoption and inheritance in Indonesia and highlights the importance of addressing these issues to ensure fair and just treatment of adopted children in matters of inheritance.

Abstract

This study analyzes the impact of OJK Regulation Number 11/POJK.03/2016 on the implementation of sharia banking business activities and its role in ensuring the sustainability of the sharia financial industry in Indonesia. The regulation aims to strengthen governance, risk management, and transparency in sharia banking while promoting alignment with Islamic principles. Employing a qualitative juridical analysis, this research evaluates the regulation's effectiveness and identifies challenges faced by sharia banking institutions, including resource limitations, knowledge gaps, and regulatory ambiguities. The findings reveal that while the regulation has significantly improved compliance, risk management, and public trust, challenges persist in its practical implementation. Recommendations include capacity building, regulatory clarity, and technological adoption to optimize the regulation's impact. This study contributes to the understanding of regulatory frameworks in Islamic finance and offers insights for enhancing the resilience and sustainability of Indonesia's sharia financial industry.

Abstract

Introduction: The company often uses the spread of the Covid 19 virus in Indonesia in carrying out the Termination of Employment (PHK). Force Majeure is regulated by Article 164 of Law No. 13 of 2003 on Manpower but does not regulate epidemics or diseases as force majeure. Hardship itself is not regulated, and this doctrine is not yet known in Indonesia, as evidenced by the lack of contracts implementing the hardship clause.Purposes of the Research: The purpose of this study is to provide legal protection for employees who have experienced termination of employment due to the Covid-19 pandemic based on the principle of hardship.Methods of the Research: The research method used is normative juridical or doctrinal law research. It is research that uses the approach of legislation in the governance and legal values that live in society.Results of the Research: The results of this study include two things, namely the principle of force majeure or hardship in termination of employment, Companies that terminate employment should renegotiate by delaying work or known as the hardship principle. Using the force majeure principle causes workers to be unable to carry out their obligations, namely doing work. Based on the freedom of contract, the hardship principle principle clause can continue to carry out the agreement for workers affected by Covid-19. While the second is the legal consequences of the Covid-19 pandemic on work agreements, basically, in resolving the legal consequences caused by the Covid-19 pandemic, honesty from the parties is needed. This principle is known as good faith. It greatly determines the condition of the Covid-19 pandemic in the termination of employment by the company so that the parties can renegotiate their work agreement.

Abstract

Indonesia is a highly diverse country, comprising a multitude of tribes, groups, races, and religions, and is endowed with a rich cultural heritage. The heterogeneity of Indonesian society provides the context for interfaith and other forms of marriage. The specific legislation that governs marriage is Law Number 1 of 1974. It is commonly assumed that Law No. 1/1974 requires immediate revision due to its outdated nature and inability to address contemporary issues pertaining to marriage. Consequently, there are numerous provisions within the Marriage Law that require amendment or addition. For instance, there is a need to introduce more robust penalties for those who violate the Marriage Law, whether they are involved in interfaith marriages, same-sex marriages, polygamous marriages, or marriages contracted without the requisite formalities. This study aims to examine the evolution of marriage law in Indonesia and the challenges it has faced. It employs a descriptive qualitative approach with a literature review. The findings reveal that Indonesia's marriage regulation has undergone three distinct phases, each characterised by its own set of issues. Additionally, the country's marriage law has experienced two distinct periods: one following independence and the other following the enactment of Marriage Law Number 1 of 1974.

Abstract

This research presents a bibliometric exploration of publication development in entrepreneurship education, aiming to elucidate trends, research focuses, and emerging opportunities within the field. Entrepreneurship education has gained prominence as a crucial discipline in academia and practice, reflecting the growing recognition of entrepreneurship's role in economic and societal advancement. Through bibliometric analysis techniques, including citation analysis, keyword analysis, and visualization methods, a comprehensive examination of scholarly publications related to entrepreneurship education from 1977 to 2023 was conducted. The findings offer insights into publication metrics, such as citation counts, author productivity, and impact indices, providing a nuanced understanding of the scholarly landscape. Visualization of term networks and trends revealed dominant research themes, evolving concepts, and potential research directions within entrepreneurship education. Practical implications derived from this study inform educators, policymakers, practitioners, and other stakeholders about curriculum design, policy formulation, and program implementation strategies to foster collaboration, innovation, and excellence in entrepreneurship education research and practice.

Abstract

Pendidikan kewirausahaan dapat mendorong perkembangan kemandirian di antara generasi muda. Mereka dapat memperoleh pemahaman bahwa mereka dapat mengambil kendali atas nasib mereka sendiri melalui usaha kewirausahaan. Perkembangan teknologi informasi dan komunikasi sangat berkontribusi pada kemajuan suatu bisnis, memberikan pelayanan yang semangat efektif dan efisien. Salah satu dampak yang paling dirasakan ialah bagaimana dengan kemajuan tersebut seharusnya dapat memberikan kesempatan bagi para pencari kerja untuk membuka seluas-luasnya lapangan pekerjaan baik untuk kebutuhan diri sendiri dan juga kebutuhan masyarakat luas lainnya. Penelitian ini bertujuan untuk mengetahui pengaruh pendidikan kewirausahaan dan mental kewirausahaan terhadap motivasi berwirausaha pada generasi muda di kelurahan Jodipan kecamatan Blimbing. Penelitian ini menggunakan metode kuantitatif, sedangkan pengumpulan data yang dilakukan dengan cara kuesioner yang dibagikan kepada 80 pelaku usaha di kelurahan Jodipan kecamatan Blimbing. Teknik analisis yang digunakan adalah analisis deskriptif dan analisis regresi berganda. Hasil penelitian ini menunjukkan bahwa secara parsial pendidikan kewirausahaan dan mental kewirausahaan berpengaruh positif dan signifikan terhadap motivasi berwirausaha pada generasi muda di kelurahan Jodipan kecamatan Blimbing. Generasi saat ini memasuki masa produktif yaitu pada tingkat usia tersebut dapat dibangun ambisi yang tinggi dengan tingkat kebebasan kemandirian dalam memutuskan sebuah pilihan untuk menggapai impian yang dinanti.

Abstract

Tepung tawar merupakan tradisi kearifan lokal yang sering digunakan sebagai mekanisme penyelesaian sengketa, termasuk dalam konteks tindak pidana. Tradisi ini mencerminkan pendekatan berbasis budaya yang menekankan perdamaian, rekonsiliasi, dan keharmonisan sosial. Dalam perspektif mediasi penal, tepung tawar memiliki potensi sebagai sarana penerapan Restorative Justice, yaitu pendekatan yang bertujuan memulihkan kerugian korban, menyelesaikan konflik secara damai, dan mendorong partisipasi aktif masyarakat adat. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif analitis untuk menganalisis peran tepung tawar dalam penyelesaian sengketa pidana. Hasil penelitian menunjukkan bahwa tepung tawar dapat memperkuat implementasi mediasi penal di Indonesia dengan mempertimbangkan aspek pemulihan hubungan sosial, penguatan nilai-nilai budaya, dan efektivitas penyelesaian sengketa yang mana penerapannya tidak hanya menyederhanakan proses penyelesaian sengketa tetapi juga mendorong partisipasi aktif dari kedua belah pihak, sehingga meningkatkan kemungkinan solusi yang saling menguntungkan, meskipun dalam pelaksanaannya terdapat hambatan-hambatan. Langkah solutifnya dapat dengan mengintegrasi tradisi tepung tawar dalam sistem peradilan formal sebagai langkah untuk mewujudkan keadilan yang inklusif dan humanis.
