Abstract

Narkotika di dunia dan di Indonesia sudah ada sejak 2000 MS, dan di Indonesia sudah ada sejak zaman kolonial Belanda yang menjajah Indonesia selama 3,5 Abad. Indonesia dengan hukum positifnya telah memberikan pengaturan sejak Indonesia merdeka yaitu ditetapkannya Undang-Undang Nomor 9 tahu 1967 tentang Narkotika, begitu terlalu lama perubahan dilakukan yaitu pada tahun 1997. Undang-Undang Narkotika baru ada perubahan, maka ditetapkan Undang-Undang Nomor.22 tahun1997 tentang Narkotika menentukan hukuman mati bagi pelaku pengedaran Narkotika, dan dirubah lagi dengan ditetapkan Undang-Undang Nomor.35 tahun 2009 tentang Narkotika, baru pelaksanaan eksekusi dapat dilakukan terhadap pengedar narkoti, dalam undang-undang ini dalam Pasal 64 ayat 1 dan 2 menetapkan Badan Narkotika Nasional (BNN) untuk melakukan pencegahan terhadap pengedar dan pengguna narkoba, dan melakukan rehabilitasi. Dalam melakukan pencegahannya dibantu oleh masyarakat dan BNN Provinsi dan Kabupaten dan kota seluruh Indonesia. Kata Kunci: Pengedar, Narkoba, Rehabilitasi

Abstract

Restorative justice merupakan pendekatan dalam sistem peradilan pidana yang mengutamakan pemulihan hubungan antara korban, pelaku, dan masyarakat, alih-alih hanya fokus pada penghukuman. Konsep ini sangat relevan dalam konteks peradilan anak, yang memandang anak sebagai individu dalam proses tumbuh kembang dan membutuhkan pembinaan. Di Indonesia, penerapan restorative justice diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (SPPA), dengan mekanisme diversi sebagai salah satu instrumen utamanya. Meskipun telah memiliki landasan hukum yang jelas, penerapannya menghadapi berbagai tantangan, termasuk kurangnya pemahaman aparat penegak hukum, terbatasnya fasilitas pendukung, dan stigma negatif masyarakat terhadap anak yang terlibat tindak pidana. Penelitian ini bertujuan untuk menganalisis penerapan restorative justice, kendala-kendala yang dihadapi, serta peluang pengembangannya. Diharapkan, dengan pemahaman yang lebih baik, dapat ditemukan solusi untuk menciptakan sistem peradilan pidana anak yang lebih berkeadilan dan berpihak pada kepentingan terbaik anak.

Abstract

Import regulation is a crucial instrument within national economic policy, playing a significant role in controlling the inflow of foreign goods while safeguarding the sustainability of domestic industries. From the perspective of Indonesian economic law, import policies are not solely aimed at fulfilling domestic market demands but are also designed to maintain a balance between trade liberalization and national interests. This study seeks to examine the legal framework governing import activities as well as the various forms of protection provided to domestic products. The research employs a normative juridical method, utilizing both statutory and conceptual approaches, supported by a comprehensive review of legal literature and secondary data sources. The findings indicate that the Indonesian government has implemented a range of protective measures, including tariff-based instruments such as import duties, as well as non-tariff measures like quotas, technical standards, and the Domestic Component Level (TKDN) policy. These mechanisms are intended to strengthen the competitiveness of local industries and reduce dependency on imported goods. However, in practice, several challenges persist, including regulatory inconsistencies across sectors, weak enforcement mechanisms, and external pressures from global trade regimes that emphasize market openness. These issues highlight the need for more adaptive, integrated, and sustainable policies to ensure a proper balance between protecting domestic industries and fulfilling international trade commitments.

Abstract

The application for name change due to religious conversion based on the Stipulation of Cibinong District Court Number 87/Pdt.P/2024/PN Cbi was filed by the applicant who wanted to change his name from Christian to a name that reflected his new identity as a Muslim, in line with his decision to embrace Islam. This name change was filed through a voluntary petition because it did not involve other parties who were legally disadvantaged. This study aims to analyze the procedure based on the population administration law and the extent to which the state provides protection for the right to identity and freedom of religion in the name change process. and to find out the legal considerations of judges in determining name changes due to religious conversion. The method used is normative juridical with statutory approach and case study. The results of the study show that the name change application must be based on a court decision as stipulated in Article 52 of Law Number 23 of 2006 concerning Population Administration which has been amended to Law Number 24 of 2013. The stipulation confirms that the positive law in Indonesia provides space and protection for the expression of beliefs through changes in legal identity, as long as it is done according to legal procedures. The state is obliged to respect and facilitate it as a form of juridical recognition of the personal rights of citizens to live life in accordance with their beliefs. This process also reflects the role of the judiciary in maintaining the balance between legal certainty, administrative order, and respect for human rights within the framework of the national legal system.

Abstract

This study aims to examine the juridical aspects of Value Added Tax (VAT) disputes arising from the sale of foreclosed collateral (Agunan yang Diambil Alih/AYDA) by financing institutions after the debtor’s receivables have been written off and the sale proceeds recorded as recovery income. The legal issue focuses on whether such a transaction constitutes a taxable supply under VAT law and how recovery income should be treated under accounting and tax regulations. The research employs a normative juridical method, combining statutory and conceptual approaches, and utilizes secondary data derived from tax legislation, accounting standards, and tax court decisions. The study reveals that the Directorate General of Taxes (DGT) interprets AYDA sales as taxable transactions, while taxpayers argue that these transactions merely recover losses rather than generate new economic value. From an accounting perspective, recovery income is treated as non-operational income, while under tax law, it is already subject to income tax (PPh). The findings conclude that the sale of AYDA should not be subject to VAT, as it does not constitute a new supply of goods; however, since the issuance of Government Regulation No. 44 of 2022 and Minister of Finance Regulation No. 41/PMK.03/2023, AYDA sales have been explicitly classified as taxable transactions

Abstract

This study examines the legal protection aspects of electronic land certificates under the implementation of Ministerial Regulation ATR/BPN No. 1 of 2021 at the Bogor City Land Office. Employing a qualitative descriptive approach with an empirical juridical method, the research analyzes normative foundations, implementation mechanisms, and practical challenges. Data were collected through interviews, field observations, and literature review. The findings reveal that electronic certificates possess strong legal legitimacy supported by digital signatures and encrypted data storage. However, several obstacles remain, including inadequate digital infrastructure, limited digital literacy among the public, and concerns about cybersecurity. Strengthening legal frameworks, improving technical readiness, and increasing public awareness are essential to ensuring effective legal protection and public trust in the digital land administration system.

Abstract

Investment has an important role in driving economic growth in Indonesia, as one of the main pillars of the economic system. Investment not only provides opportunities for individuals to gain financial benefits but also contributes to the creation of jobs and the improvement of people's welfare. However, stock investments do not always go according to expectations especially when mistakes or violations of the law occur that can harm shareholders. In case Number 188/Pdt.G/2024/PN Bgr, where the lawsuit was declared Niet Ontvankelijk Verklaard due to a formal defect, namely the incompatibility of the name of the attorney. This raises questions about the legal basis for the decision and its implications for the legal protection of the parties. This research aims to analyze the legal basis used by the judge in declaring the lawsuit inadmissible and its legal consequences for legal protection in investment disputes. Using a normative juridical research method with a statute approach and case approach, this research examines regulations such as Article 118 HIR, Article 1365 of the Civil Code, and court decisions. The results showed that the judge based the decision on the inconsistency of the identity of the attorney, which was considered to violate the formal requirements, so that the lawsuit was not examined for substance. As a result, the plaintiff loses access to substantive justice, creates legal uncertainty, and has the potential to reduce investor confidence, which is contrary to the principle of investor protection in Law No. 25 of 2007. This research emphasizes the need for a balance between procedural formality and substantive justice.
