Abstract

The principle of equality before the law is a crucial basis for protecting human rights, including for people with disabilities. However, its implementation still faces challenges in realizing substantive equality in the eyes of the law. This research aims to analyze studies of legal protection for people with disabilities through principles equality before the law with a thematic qualitative meta-analysis approach to identify dominant themes, trends and research gaps. This research uses a meta-analysis method by collecting data from 20 relevant simulation studies from 2018 to 2024. These studies were selected based on predetermined inclusion and exclusion criteria. Data were analyzed qualitatively thematically to identify dominant themes, patterns and relationships between themes. Thematic analysis yielded three main themes: (1) Accommodation and accessibility, (2) Access to justice, and (3) Awareness and participation. The Accommodation and Accessibility theme is the most dominant theme, showing the importance of ensuring the physical environment, information and technology are accessible to people with disabilities. The access to justice theme highlights the need for a justice system that is inclusive and fair for people with disabilities. Meanwhile, the awareness and participation theme emphasizes the importance of increasing public awareness and participation of people with disabilities in the decision-making process. This research concludes that legal protection for people with disabilities is through principles equality before the law still requires continued efforts. Further research is needed to explore underrepresented themes, such as health rights, property rights, and protection in emergency situations. In addition, research also needs to evaluate the effectiveness of the interventions and policies proposed in these studies.

Abstract

Pemutusan hubungan kerja di Indonesia harus dilaksanakan sesuai dengan peraturan dan undang-undang yang berlaku untuk menghindari potensi konflik. Pemutusan hubungan kerja ini terbagi menjadi beberapa kategori, yaitu: pemutusan yang dilakukan oleh perusahaan, pemutusan atas inisiatif pekerja, pemutusan otomatis karena masa berlaku perjanjian kerja telah berakhir, serta pemutusan berdasarkan keputusan pengadilan, misalnya karena perusahaan dinyatakan pailit melalui putusan pengadilan. Pemutusan Hubungan Kerja (PHK) akibat kepailitan perusahaan merupakan isu krusial yang mempengaruhi hak-hak pekerja. Dalam konteks hukum ketenagakerjaan di Indonesia, perlindungan terhadap pekerja yang terdampak PHK perlu dioptimalkan untuk menjamin keadilan dan kesejahteraan. Penelitian ini bertujuan untuk menganalisis efektivitas perlindungan hukum terhadap pekerja yang mengalami PHK akibat kepailitan serta mengidentifikasi hambatan dalam implementasinya. Melalui pendekatan yuridis normatif dan analisis kasus, penelitian ini menemukan bahwa perlindungan hukum seringkali terkendala oleh kurangnya kepatuhan perusahaan terhadap kewajiban pembayaran hak pekerja, proses hukum yang lambat, serta pemahaman yang minim terhadap regulasi yang berlaku. Oleh karena itu, dibutuhkan upaya optimalisasi melalui penegakan hukum yang tegas, peningkatan mekanisme pengawasan, serta penyusunan kebijakan yang lebih pro-pekerja. Dengan demikian, diharapkan perlindungan terhadap pekerja yang terdampak PHK akibat kepailitan dapat diwujudkan secara efektif dan berkeadilan.

Abstract

ABSTRACT The armed conflict in Myanmar has escalated since the military coup in 2021. In this armed conflict, many civilian casualties have fallen and civilian facilities have been destroyed. This type of research is normative legal research with a descriptive prescriptive nature. This scientific article consists of three sub-discussions. First, this scientific article discusses international regulations governing the protection of Myanmar civilians when a non-international armed conflict is taking place. Second, it discusses gross human rights violations committed by the Military Junta against Myanmar civilians when in conflict with the Rebel Forces. Third, it discusses international mechanisms that can be carried out to resolve the conflict and protect Myanmar civilians. The results of this study state that the armed conflict between the Rebel Forces fighting against the military junta in Myanmar territory meets the elements of a Non-International Armed Conflict as stipulated by International Humanitarian Law. Since the 2021 military coup, there have been many gross human rights violations by the military junta, including attacks on demonstrators, torture, cutting off access to aid, and indiscriminate airstrikes. International mechanisms that can be used to resolve this problem include conducting diplomatic intervention and international community political resolution, implementing accountability for enforcing international legal instruments, and conducting humanitarian intervention and civil protection.
