Abstract

Law is a tool for regulating the lives of society, characterized by its coercive and obligatory nature to follow existing rules. Law is created for the benefit of the general public and contains norms of life as a guide for social interaction. The death penalty is the most severe punishment in terms of sanctions for extraordinary criminal offenses such as narcotics, premeditated murder, terrorism, and crimes against national security. However, the implementation of the death penalty in Indonesia has become controversial due to its violation of Human Rights (HR) and the right to life guaranteed by Article 28A, paragraph (1) of the 1945 Constitution. Despite the recent updates in the latest Criminal Code (KUHP) that introduce a probation period of 10 years, pros and cons continue to arise regarding the application of the death penalty. Various perspectives on the death penalty exist, with some considering human rights and principles of justice. Nevertheless, the death penalty must be applied with caution and in consideration of human rights

Abstract

The insurance and reinsurance industry plays a crucial role in managing financial risks in society. However, when a reinsurance company that provides protection to insurance companies loses its business license, it can lead to significant legal complexities. This article discusses two critical aspects related to this issue. First, the impact of the revocation of the business license of a reinsurance company on insurance companies and their obligations to policyholders. This situation creates uncertainty regarding the ability of insurance companies to fulfill policyholder claims. Second, how the legal system can provide protection for all parties involved. This includes the role of regulatory authorities in the insurance industry, insurance contract provisions governing rights and obligations, and compensation mechanisms. Emphasis is also placed on the role of legal experts in assisting insurance companies and policyholders in understanding their rights and navigating any necessary legal processes. Through proper legal understanding and protection, market stability in insurance and policyholder trust can be preserved in this complex situation

Abstract

Pencemaran laut adalah salah satu masalah yang sangat serius karena dapat merusak lingkungan, alam dan kualitas air. Hal ini dapat terjadi karena masuknya material seperti limbah, bahan kimia, tumpahan minyak, dan lain sebagainya. Jumlah minyak montara yang tumpah per hari diperkirakan sekitar 500.000 barel minyak selama 74 hari Hal ini sangat merugikan negara Indonesia khususnya masyarakat Nusa Tenggara Timur. Permasalahan yang akan diteliti dalam penelitian ini adalah seberapa besar pertanggungjawaban Australia terhadap Laut Timor akibat kebocoran minyak Montara dan bagaimana menyelesaikan sengketa antara Indonesia dan Australia mengenai pencemaran di Laut Timor. Metode penelitian normatif merupakan metode yang digunakan dalam penelitian ini. Hasil penelitian ini adalah bentuk tanggung jawab negara Australia atas pencemaran Laut Timor akibat tumpahan minyak Montara bersifat mutlak atau tanggung jawab mutlak, penyelesaian sengketa saat ini sedang berada di tahap negosiasi yang dilakukan antara Indonesia dan Australia.

Abstract

The role of judges in upholding justice and humanity is the core of a functioning legal system. Judges have the responsibility to uphold justice, provide fair legal protection to all individuals, and ensure that human rights are respected during the judicial process. In fulfilling their duties, judges must possess integrity, intelligence, and sensitivity to moral values. They must also be able to withstand political, economic, and social pressures that may affect their independence. Furthermore, judges need to understand and apply the law wisely according to the social, cultural, and political contexts. Amidst the complexity of globalization and technological advancements, the role of judges becomes increasingly important in ensuring that justice and humanity are upheld in a changing legal system. Therefore, judges must continuously improve themselves through education, training, and self-reflection to better fulfill their duties effectively.

Abstract

Acquisition of shares in a business often occurs when one company buys shares of another company. This article discusses the juridical aspects of share acquisition in the context of a Limited Liability Company (PT) by analyzing legal regulations, the rights and obligations of parties, and the legal protection of shareholders. As well as the legal impacts that may arise as a result of the transaction, by reviewing legal issues that may arise in the acquisition of shares, such as unfair business competition, legal protection of shareholders. Through this understanding, this article aims to provide a deeper understanding of the legal regulations governing share acquisition in the context of limited liability companies by explaining their implications in the business environment.

Abstract

Corporate criminal liability policies have been implemented as a legal instrument aimed at preventing and combating corruption crimes in Indonesia. This policy is part of the government's efforts to strengthen corporate governance and enhance business integrity. However, the effectiveness of implementing this policy remains a subject of debate among legal experts and practitioners. Some critics argue that the policy has not significantly reduced corruption cases involving corporations. Factors such as lax law enforcement, gaps in regulations, and the inability of supervision systems are the main obstacles in the implementation of this policy. Additionally, a lack of awareness and commitment from corporate entities in applying principles of good corporate governance also influence the effectiveness of this policy. Therefore, there is a need for evaluation and improvement in the implementation of corporate criminal liability policies to be more effective in preventing corruption crimes in Indonesia.

Abstract

The Deposit Insurance Agency (LPS) plays a vital role in addressing systemic risks in the Indonesian banking sector. With its mandate as a deposit insurer, LPS provides certainty to bank customers in facing potential bank failures. Additionally, LPS also contributes to strengthening financial system stability by providing protection to customer deposits in crisis situations. Through strict supervision and regulation policies, LPS mitigates risks that could disrupt banking sector stability. Furthermore, LPS also enhances public trust in the banking sector by guaranteeing customer deposits. Thus, LPS not only serves as a financial security guard for individual customers but also acts as a frontline defender in maintaining overall financial system stability in Indonesia.
