Abstract

The government obligates halal certification for all products across Indonesia to capture the larger halal market. In 2025, Indonesia's total consumption of goods and services will reach US$ 330.0 billion. Modernity that requires society to increase economic and religious feasibility is a good combination for capitalists. This modernity has subsequently transformed into a halal lifestyle and has penetrated various sectors of the life of the modern Muslim community. However, Foucault says that power is a determining factor for the discourse that develops in society. The qualitative methods and unstructured observation completed with library data as sources will reveals the practice of power in disseminating the discourse of halal products using the Foucault’s power-knowledge. In practice, various efforts have been made by the government as the ruler by issuing various regulations as instruments of discourse. There was a discipline of halal products in the form of supervision carried out by the government in which society became the agent for monitoring halal products. Normalization is also carried out by imposing sanctions on products deemed not under regulations. The examination is the last step in the discipline of halal products by the government. This article concludes that government already makes halal-oriented as the new Muslim behaviour. Hence, the decline of religious diversity becomes a new threat as long as the halal issue is held by the only authority.

Abstract

This article contends that the principle of mu'âsyaroh bil ma'rûf has been inadequately interpreted, primarily due to its frequent application solely to men, resulting in the neglect and discrimination against women in conceptual formulation and validation. By positioning both men and women as equal participants in defining maqâshid al-syarî'ah, a fairer understanding of mu'asyaraoh bil ma'ruf can be achieved. This qualitative research seeks to redefine the interpretation of mu'âsyarah bil ma'rûf in the Qur'an through the Maqâshid Syarî'ah cum-Mubâdalah approach, integrating the critical concept of mashâlih al-'ibâd in kulliyât al-khams and the Mubâdalah perspective. The Maqâshid al-Syarî'ah cum-Mubâdalah methodology entails merging Maqâshid al-Syarî'ah theory with a perspective emphasizing mutual respect between genders. This study adopts a library research methodology. The findings reveal that, through the Maqâshid al-Syarî'ah cum-Mubâdalah approach, it can be inferred that: 1) mu'asyarah bil ma'ruf extends beyond marital relations to encompass interactions that uphold human values for all individuals; 2) apart from hifdz al-nafs (preservation of life), mu'asyarah bil ma'ruf also encompasses other elements including hifdz al-din (preservation of religion), hifdz al-mal (preservation of wealth), hifdz al-'aql (preservation of intellect), and hifdz al-nasl (preservation of lineage); 3) adherence to the five elements of maqashid sharia is obligatory for both parties engaging in interactions, rather than being imposed solely on one party.

Abstract

This study examines the value of religious moderation in the Salafi movement on social media in Indonesia. The label of radical movement attached to the Salafi group has been considered a threat to the country's integrity. Their propaganda and schooling, especially on social media, contain some content that will cause social separation. The government mainstreams the campaign for religious moderation to counter radicalism. Hence, several organizations have been dissolved by the government because they are considered dangerous. However, the question is whether all groups linked to Salafi are hazardous and threaten the country's integrity. This article will solve this question using qualitative descriptive research. This research is equipped with a content analysis method. The results found three variants of the Salafi group spread in social media. The three variants are purist, haraki, and jihadist. The three variants have their style, even though purificating Islamic thought is the starting point of their agenda. By referring to the religious moderation indicators by the Ministry of Religious Affairs (nationalism, tolerance, non-violence, and accommodative to local culture), it can be concluded that: First, not all Salafi groups commit acts of violence; Second, not all Salafi groups are anti-nationalism; Third, several Salafi groups have moderate values in their teachings even though they can not be considered as moderate groups.

Abstract

This article examines the influence of polarity in religious understanding on attachment to halal certification in Indonesia. In 2024, there were 3,237,167 products that have been certified halal, with 58.5% being self-declared as halal and the remaining 41.5% being regular halal certificates. This number has more than tripled since 2019, when there were just 963,411 halal-certified products. The high increase in the number of halal-certified products is directly proportional to the high halal awareness of Indonesian Muslims. Previous studies have not explicitly addressed the concept of halal as understood by the Indonesian Muslim community, which possesses a diverse range of religious interpretations. This article reveals the typology of Indonesian Muslim religious understanding and its influence on attachment to halal certification. This research used quantitative methods by distributing questionnaires to Indonesian Muslim respondents with conservative, moderate, and progressive religious categorizations. Respondents in this study were aged 18-60 years, and included both men and women. Data were analyzed using the ANOVA technique using SPSS 29.0.1. The results show a significant value (0.008), indicating a difference in attachment to halal certification between conservative, moderate, and progressive groups, with the highest attachment average amongst conservative Muslims (33.46).

Abstract

This article explores the regulation of halal tourism in Indonesia, focusing on the roles of the main Islamic organizations in Indonesia, namely the Indonesian Ulema Council (Majelis Ulama Indonesia, MUI), Nahdlatul Ulama (NU), and Muhammadiyah. Prompted by the ongoing debates surrounding the relationship between modernity and Islam in the context of halal tourism, this research analyses fatwas issued by these organizations and various local regulations in Indonesia. The study finds that the three organizations respond to halal tourism issues with differing approaches, with MUI dominating the discourse. MUI and NU tend to adopt exclusive stances, while Muhammadiyah demonstrates a more inclusive and flexible approach. The dominance of MUI fatwas is reflected in their frequent citation and integration into various local regulations related to halal tourism, indicating significant influence in shaping regional policies. Drawing on Michel Foucault’s theory of power/knowledge, this article concludes that the dominance of MUI fatwas in shaping the discourse of halal tourism regulation leads to a more exclusive society through the process of shariatization. This phenomenon reflects the influence of knowledge and policy control by Islamic institutions, directly or indirectly impacting the landscape of halal tourism regulation in Indonesia. Artikel ini mengeksplorasi regulasi pariwisata halal di Indonesia dengan memfokuskan pada peran organisasi Islam utama di Indonesia, yakni Majelis Ulama Indonesia (MUI), Nahdlatul Ulama (NU), dan Muhammadiyah. Penelitian ini dipicu oleh kompleksitas perdebatan terkini seputar hubungan antara modernitas dan Islam dalam konteks pariwisata halal. Melalui analisis fatwa dari ketiga organisasi Islam dan sejumlah peraturan daerah di Indonesia, penelitian ini menemukan bahwa ketiga organisasi tersebut merespons isu pariwisata halal dengan pendekatan yang berbeda, di mana MUI mendominasi diskursus tersebut. MUI dan NU cenderung mengadopsi sikap eksklusif, sementara Muhammadiyah menunjukkan pendekatan yang lebih inklusif dan fleksibel. Dominasi fatwa MUI tercermin dalam seringnya fatwa tersebut dirujuk dan diintegrasikan ke dalam berbagai peraturan daerah terkait pariwisata halal. Hal itu menandakan pengaruh yang signifikan dalam pembentukan kebijakan daerah. Dengan merujuk pada teori kuasa pengetahuan Michel Foucault, artikel ini berkesimpulan bahwa dominasi fatwa MUI dalam membentuk diskursus regulasi pariwisata halal mengarah pada masyarakat yang lebih eksklusif melalui proses syariatisasi. Fenomena ini mencerminkan pengaruh kontrol pengetahuan dan kebijakan oleh lembaga-lembaga Islam, yang secara langsung atau tidak langsung memengaruhi lanskap regulasi pariwisata halal di Indonesia.
