Abstract

This study aims to explore and analyze the fulfillment of the biological rights of prisoners who maintain marriage in Makassar Class I Penitentiary using the Maqashid al-Sharia approach. This research was conducted through field studies and primary and secondary data collection. The main focus is to identify and evaluate the implementation of the biological rights of prisoners in the context of maintaining marriage in a prison environment. In the context of Maqashid al-Sharia, the concept of biological rights of prisoners, considers the principles of justice and balance in Islam. This study provides a comprehensive picture of how prisons in Makassar Class I treat inmates who try to maintain their marriages. In addition, this study also explains the impact and relevance of the fulfillment of biological rights on the welfare of prisoners and marital stability. The concept of fulfilling the biological rights of prisoners in review from Maqashid al-Sharia is carried out according to their respective capabilities. Unlike the case if the husband or wife is a prisoner who must languish in bars, of course, the fulfillment of biological rights cannot be optimized. The results showed that the reality of fulfilling the biological rights of prisoners in Makassar class I correctional institutions was limited based on the policy that applies to prisoners who still have a legal marriage bond only limited to visiting and communicating by telephone in order to maintain household harmony. The fulfillment of prisoners' biological rights in maintaining marriage in Makassar Class I Penitentiary has its own challenges, such as limited facilities and internal regulations of the institution. Maqashid al-Sharia's analysis provides a critical view of the implementation of prisoners' biological rights, emphasizing the importance of justice and fair treatment in accordance with Islamic principles.

Abstract

This research discusses about one of the customs or social traditions practiced by Muslim community in South Sulawesi. This tradition is called “Makkatte”. It is said that this tradition stems from the teachings of Islam, which includes a ceremony of female circumcision. It is well known that female circumcision has become subject for public debate and discussion in our present era, after the classical Muslim jurists agreed on its legitimacy, despite of their differences in its ruling, whether such a practice is considered a religious obligation or Sunnah. This research aims to define the Makkatte tradition and its status in the South Sulawesi community, in addition to its rule in the Islamic jurisprudence. This research adopts the descriptive and analytical method that allows researcher to obtain information, documents and folk narratives. This research also used field work method by making interviews with relevant sources and distributing questionnaires in 16 regions in South Sulawesi. One of the most important findings from this research is that Makkatte is a ceremony that includes ablution, pronouncement of shahada, reciting some verses of the Qur’an, and female circumcision. In its ritual process, Makkatte is most often performed by a person known as Sanro, which means midwife according to the Bugis language in Sulawesi. The majority of the Muslim community in South Sulawesi agreed that the tradition of Makkatte is an obligation on every female, as it includes shahada and circumcision. This study also affirms that the additional customary ceremonies to Makkatte does not affect the fact that it is in compliance with God Almighty's command to circumcise females.

Abstract

Penelitian ini bertujuan menganalisis fenomena penggunaan biro jodoh online dalam pencarian pasangan hidup di era modern, dengan tinjauan terhadap perspektif kaidah darurah dan analisis sosiologis. Fenomena ini mencerminkan perubahan dinamika sosial dalam proses perjodohan, yang memerlukan penyesuaian perspektif hukum dan sosial. Fokus penelitian adalah mengeksplorasi peran biro jodoh online sebagai alat pelengkap dalam pencarian pasangan hidup, serta bagaimana hal ini diterima dalam konteks sosial dan agama. Penelitian ini mengadopsi pendekatan kualitatif dengan teknik purposive sampling untuk menggali data secara mendalam. Responden terdiri dari individu berusia 24-35 tahun yang berstatus lajang, dengan wawancara sebagai metode utama pengumpulan data. Pendekatan interdisipliner digunakan dalam analisis data, melibatkan perspektif agama, sosial, dan budaya. Pendekatan historis juga diterapkan untuk merekonstruksi fenomena biro jodoh online secara sistematis dan objektif. Hasil penelitian menunjukkan bahwa biro jodoh online tidak dipandang sebagai metode utama untuk mencari pasangan hidup, melainkan sebagai alat pelengkap yang membantu individu membuka peluang menuju hubungan lebih serius. Penelitian ini menegaskan bahwa dalam konteks sosial saat ini, biro jodoh online dapat memberikan manfaat tertentu tanpa menggantikan preferensi individu dalam mencari pasangan langsung. Kajian ini juga menawarkan perspektif baru memahami praktik perjodohan modern dengan memadukan prinsip kaidah darurah dan dinamika sosial kontemporer. This study examines the phenomenon of online matchmaking agencies in finding life partners in the modern era, analyzed through the lens of darurah principles and sociological perspectives. It highlights changes in social dynamics that demand adjustments in legal and cultural frameworks. The study focuses on the role of online matchmaking as a supplementary tool in partner-seeking processes and its acceptance within social and religious contexts. Adopting a qualitative approach with purposive sampling, the research involved interviews with individuals aged 24-35 who are single. Data analysis incorporated interdisciplinary perspectives, including religious, social, and cultural views, alongside a historical approach to systematically reconstruct the evolution of online matchmaking agencies. The findings reveal that these platforms are not perceived as primary methods for partner searching but as complementary tools facilitating opportunities for meaningful relationships. While individual preferences for traditional matchmaking remain dominant, online agencies provide additional benefits by expanding social networks. This study offers insights into modern matchmaking practices by integrating darurah principles with contemporary social realities.

Abstract

The Appasili wedding tradition in Takalar Regency, South Sulawesi, has its uniqueness that is rarely found in other places. Appasili involves a series of distinctive rituals, such as marriage proposals, offerings, and joint celebrations, which show the importance of customs and rituals in the lives of the Takalar people. Each element in this tradition has a deep symbolic meaning, reflecting the cultural, spiritual, and social values ​​upheld in local society. The Appasili wedding process also highlights the important role of the extended family and community, showing solidarity and strong social integration in the celebration. This research aims to describe community perceptions and Islamic legal perspectives on this tradition. This research uses a qualitative approach and is field research with data collection techniques in the form of in-depth interviews with religious figures and traditional practitioners, as well as related documentation. The research results show that people view the Appasili tradition as a hereditary custom that is believed to perfect and cleanse a marriage. However, the impact is not uniform; Some traditional leaders believe that not carrying out Appasili will have a negative impact, while some people see it as a habit with no significant impact. From the perspective of Islamic law, the Appasili tradition is considered permissible (permissible) because it does not contain harm and is following the principle of "al-urf muhakkam" and includes ‘urf Shohih', namely habits that do not conflict with Sharia law'. This research recommends preserving traditions by the next generation and the need for attention from government agencies in providing an understanding of the importance of preserving these traditions.

Abstract

The correct application of Islamic law will provide security, peace and tranquility. Like kisas law and polygamy law include the values and principles of justice both conceptually and practically. The legal provisions must be understood correctly because they allow contextualization to occur which refers to the context of the times that are constantly changing. Then, this article is analyzed using the context of fiqh of justice. This resulting in the conclusion that kisas punishment can save lives, property, and human rights in general.
