Abstract

The mukhabarah bil mudharabah contract originates from a combination of two contracts, namely the mukhabarah contract and the mudharabah contract which are combined into one in the sugar cane farming partnership model. The formation of this contract is a new thing that is used as an effort to increase national sugar production by forming fair cooperation based on sharia contracts, however, the concept related to mukhabarah bil mudharabah contracts has not been concretely accommodated in statutory regulations, so this research aims to examine the regulation of mukhabarah bil mudharabah contracts in sugar cane farming partnership based on an epistemogical perspective. The research method used is normative juridical with a statutory and conceptual approach. The theory used is stufenbau theory. The results of this research indicate that at the meta-norm and grundnorm level there is already a legal basis for regulation regarding mukhabarah bil mudharabah contracts. The legal basis for regulating these contracts is also found at the level of Staatsfundamentalnorm norms and the level of Staatsgrundgezets norms, namely in the basic state regulations contained in Article 29 paragraph (2) of the 1945 Constitution, but at the next level there are only regulations regarding mudharabah contracts, while the mukhabarah contract has not been specifically regulated in the statutory regulations or other regulations below it.

Abstract

Moving the National Capital (IKN) from Jakarta to the Nusantara East Kalimantan requires very large costs. Through Law Number 3 of 2022 concerning the National Capital, the government has determined alternative financing other than that sourced from the APBN, one of which is sharia crowdfunding which is part of creative financing. Sharia crowdfunding as a source of funding for IKN Nusantara is a new thing that has not been specifically regulated, so there is a need for a review of sharia crowdfunding arrangements. The research method used is normative juridical with a statute, conceptual and historical approach. The results of this research show that the basis for regulating sharia crowdfunding as a source of funding for Indonesian IKN is generally in accordance with the tiered norm theory, but in particular it is still not in the form of an MUI Fatwa so it needs to be accommodated in legislation that has authoritative power so that it can be binding on the community.Pemindahan Ibu Kota Negara (IKN) dari Jakarta ke Nusantara Kalimantan Timur memerlukan biaya yang sangat besar. Melalui Undang-Undang Nomor 3 Tahun 2022 tentang Ibu Kota Negara, pemerintah menetapkan alternatif pembiayaan selain yang bersumber dari APBN, salah satunya yaitu crowdfunding syariah yang menjadi bagian dari creative financing. Crowdfunding syariah sebagai sumber pendaan IKN Nusantara merupakan hal baru yang belum diatur secara khusus, sehingga perlu adanya telaah terhadap pengaturaan crowdfunding syariah. Metode penelitian yang digunakan itu yuridis normatif dengan pendekatan perundang-undangan, konseptual dan historis. Hasil peneltian ini menunjukkan bahwa dasar pengaturan crowdfunding syariah sebagai sumber pendanaan IKN Nusantara secara umum telah sesuai dengan teori norma berjenjang, namun secara khusus masih dalam belum bentuk Fatwa MUI sehingga perlu diakomodir dalam peraturan perundang-undangan yang memiliki kekuatan autoritatif sehingga dapat mengikat bagi masyarakat.

Abstract

The issue of food security in Indonesia through the Department of Agriculture has been designated as a policy priority in agricultural development. This is due to the lack of adequate food availability for the community as shown d by the continued import of staple food ingredients from other countries, especially rice that is the main food source for the Indonesian people. The price of rice is increasing due to the decline in rice harvest area and also driven by the impact of El Nino, so that efforts are needed to maintain food security. This research is based on the concept of mudharabah bil mukhabarah which combines the rules of Islamic law and positive law in Indonesia that are applied to agricultural cooperation as an effort to maintain food security. The research method used in this research is a normative legal research type with a statutory and conceptual approach. The results of the research are that cooperation based on a mudharabah bil mukhabarah agreement combines three parties, namely (1) the Government (BULOG) as a provider of capital in the form of fertilizer, superior plant seeds and agricultural equipment, (2) the land owner who provides agricultural land, and ( 3) Cultivator farmers who manage agricultural land using the expertise, energy and time they have. The harvest results in this collaboration are sold back to BULOG and the profits are distributed to the parties according to the ratio agreed at the beginning of the agreement, so that food supplies can be met with fairness, transparency and sustainability in every transaction and relationship between the parties in maintaining national food security.
