Abstract

The principle of judicial independence is part of the judicial power. Judicial power is independent of state power to conduct judiciary to uphold law and justice based on Pancasila and the 1945 Constitution, for the implementation of the legal state of the Republic of Indonesia, as requested Article 24 of the 1945 Constitution principle of judicial independence in carrying out his duties as a judge, it can give you the sense that judges in performing their duties of judicial power should not be bound by any and / or pressured by anyone, but free to do anything. The principle  of judicial independence is an independence or freedom possessed by the judiciary for the creation of a decision that is both objective and impartial. The Indonesian judges understand and implement the meaning of judicial independence as a responsible freedom, freedom in order corridor legislation applicable to the principal duty of the judicial authorities in accordance procedural law and regulations in force without being influenced by the government, interests, pressure groups , print media, electronic media, and influential individuals.

Abstract

Prinsip dari negara hukum (rechtstaat) adalah adanya jaminan kepastian, ketertiban dan perlindungan hukum yang berdasarkan pada kebenaran dan keadilan tersebut memberikan kewajiban kepada negara, untuk memberikan pengakuan, jaminan, perlindungan, dan kepastian hukum, yang adil serta perlakuan yang sama dihadapan hukum kepada warga negara. Salah satu bentuk pelayanan negara kepada rakyatnya yaitu negara memberikan kesempatan kepada rakyat untuk memperoleh tanda bukti atau dokumen hukum yang berkaitan dalam hukum perdata, untuk keperluan tersebut diberikan kepada Pejabat Umum yang dijabat oleh Notaris. Minuta atas akta tersebut menjadi milik negara yang harus disimpan sampai batas waktu yang tidak ditentukan. Dalam melaksanakan tugas jabatannya, terkadang seorang Notaris berhadapan dengan permasalahan hukum, walaupun telah berhati-hati dan sesuai dengan peraturan perundang-undangan. Permasalahan hukum tersebut dapat membawanya sampai pada tahap pemeriksaan oleh aparat penegak hukum, baik pihak penyidik, penuntut umum, atau hakim, dimana hal tersebut dibutuhkan untuk kepentingan proses peradilan. UUJN telah menempatkan Notaris sebagai pejabat umum yang menjalankan profesi hukum, karena itu perlu mendapatkan perlindungan hukum adalah Notaris sebagai suatu profesi bukan Notaris sebagai pribadi.The existence of assurance, order and legal protection that is based on truth and justice has been the principle of constitutional state (rechtstaat). It requires the state to provide fair recognition, security, protection, legal certainty and equal treatment of law to its citizens. One of state services to its people is providing them opportunity to obtain proof or legal documents pertaining to civil law. For those purposes, officials known as public notary handles the proof or documents. Minuta of the deed establishment belongs to state that must be kept until the unspecified time limit. A notary sometimes deals with legal issues in carrying out his duties although has been cautious with legislation. The legal issues may bring the notary to stage of investigation by law enforcement officials, whether dealing with investigator, prosecutor, or judge, where it is necessary for the judicial process. UUJN has regarded notary as a public official who runs the legal profession and they should get legal protection because notary is regarded as professional job not as personal.

Abstract

The regulation in the Marriage Law Chapter 29 Verse (1) after Constitutional Court Decision Number 69/PUU/XII/2015 has been change into the process of marriage agreement. In the marriage agreement that legalized into Constitutional Court Number 69/PUU/XII/2015 can only be made before the marriage takes place. However, when the Constitutional Court Decision Number 69/PUU/XII/2015 arrives, a marriage agreement can be made as long as the marriage has taken place. The decision of the Constitutional Court Number 69/PUU/XII/2015 also gives a new authority to the Notary to be able to ratify the marriage agreement. Article 29 paragraph (1) of the Marriage Law after the Constitutional Court Decision Number 69/PUU/XII/2015 has provided changes after the Constitutional Court Decision Number 69/PUU/XII/2015 regarding the form of the marriage agreement in the form of a written agreement and must be ratified by the employee The marriage registrar has often been misinterpreted as an authentic deed, resulting in disharmony of implementing regulations related to the form of the marriage agreement.

Abstract

This community service is entitled "Prevention and Handling of Domestic Violence from a Legal Perspective". In family life it is undeniable that conflict can occur in family relationships, conflict resolution should be resolved properly by realizing and understanding the feelings, personality and emotional control of each family member so that happiness in the family is realized. Healthy conflict resolution occurs when each family member does not prioritize personal interests, look for the root of the problem and make solutions that are mutually beneficial to family members through good and smooth communication. But on the other hand, conflicts that exist in the family, can happen badly so that it can lead to domestic violence (KDRT). This outreach activity was carried out using the problem inventory method, lectures, discussions and direct questions and answers with the participants. This activity was successful and has the potential to be followed up into a more concrete and contributive agenda. This community service was carried out on January 27, 2022 at the Head of the Muslimat Nahdahtul Ulama Branch of Karangpring Village, Sukorambi District, Jember Regency. The form of the activity is counseling, by providing socialization on Law Number 23 of 2004 concerning the Elimination of Domestic Violence, with the aim of forming the public to know and understand the law while at the same time fostering community sensitivity and solidarity. Abstract

PT Asuransi Jiwasraya (Persero) experienced liquidity pressure so that the company's equity was recorded at negative IDR 23.92 trillion. This condition caused turmoil for policyholders to ask for clarification on this matter from PT. Asuransi Jiwasraya related to payment of insurance claims. For this reason, PT Asuransi Jiwasraya provides an alternative restructuring and based on the PT Asuransi Jiwasraya (Persero) Restructuring Acceleration Team, the number of policyholders participating in the Jiwasraya policy restructuring program until January 18, 2021 reached 102,856 participants. PT Asuransi Jiwasraya (Persero) is a BUMN where BUMN cannot be bankrupt, so the quick step taken by the government is to restructure customer policies for a new company, namely the IFG Life company. The type of research in the research used is normative juridical research, which is carried out with a statutory and conceptual approach. The result is PT. Asuransi Jiwasraya (Persero) is a step taken by the central government as the largest shareholder because it is a state-owned company. As a result of the legal restructuring of the policy on the customer, the legality of the insurance policy is no longer valid between PT. Asuransi Jiwasraya (Persero) with its customers when the customer has agreed to carry out a policy restructuring. Abstract

Banks are one of the most important financial institutions and have a large role in the economic life of society, considering that banks are one of the people's choices that can provide credit facilities. Problems in the field are increasingly complex with various sources of data used as a reference to find answers from the processes carried out by researchers so that this problem approach method is a sub-method to be able to solve a problem. The auction principles based on the auction regulations include the principle of publicity, the principle of competition, the principle of certainty, the principle of accountability, the principle of efficiency, the principle of balance and the principle of justice in the land auction object, even though there is a certificate of title. on valid Land and SKPT, one of the principles that has not been implemented except for the principle of certainty because it does not involve BPN in taking care of the existence of the object prior to auctioning to find out the location of the land. Abstract

Ketentuan Pasal 29 ayat (1) UU Perkawinan pasca Putusan Mahkamah Konstitusi Nomor 69/PUU/XII/2015 memberikan perubahan dalam pembuatan perjanjian perkawinan dimana sebelumnya perjanjian perkawinan hanya dapat dibuat sebelum perkawinan berlangsung menjadi dapat dibuat sebelum, pada saat dan selama perkawinan berlangsung. Selain itu Putusan Mahkamah Konstitusi Nomor 69/PUU/XII/2015 memberikan kewenangan baru kepada Notaris untuk mengesahkan perjanjian perkawinan. Pasal 29 ayat (1) UU Perkawinan pasca Putusan Mahkamah Konstitusi Nomor 69/PUU/XII/2015 terkait bentuk perjanjian perkawinan dalam bentuk perjanjian tertulis dan disahkan oleh Pegawai Pencatat Perkawinan seringkali salah dimaknai sebagai akta autentik, sehingga terjadi ketidaharminisan peraturan pelaksanaan terkait dengan bentuk dari perjanjian perkawinan.

Abstract

Kemajuan revolusi 4.0 mendasari terciptanya cryptocurrency, secara universal awalnya cryptocurrency memanglah dimaknai hanya sebagai mata uang belaka, namun dikala ini telah mengalami perluasan sudut pandang maupun fungsinya. Perihal itu dibuktikan dengan telah digunakannya cryptocurrency sebagai suatu jaminan; berlandaskan perihal itu maka dapat dikonsipsikan bahwasanya cryptocurrency dapat dipergunakan sebagai objek jaminan fidusia. Selaras perihal itu, maka diperlukannya kajian mendalam terkait penggunaan cryptocurrency sebagai objek jaminan fidusia; pokok permasalahannya yaitu keistimewaan serta kepastian hukum penggunaan cryptocurrency sebagai objek jaminan fidusia. Tujuan dari penelitian ini ialah memperoleh korelasi antara cryptocurrency dengan jaminan fidusia. Teknik peradilan normatif, undang-undang, dan konseptual digunakan dalam metodologi penelitian ini. Hasil penelitian ini yakni crytocurrency yang dipergunakan sebagai jaminan fidusia tidak melanggar norma hukum yang sudah ada dan berlaku, alhasil dapat dikatakan sah karena selaras dengan teori dari Roscoe Pound yang menyatakan bahwasanya di mana hukum selaku alat pembaharuan masyarakat. Cryptocurrency mempunyai keisitimewaan sebagai komoditi yang mempunyai hak atau kepentingan, berbentuk digital aset dan dapat dimiliki oleh perseorangan maupun badan hukum; serta dapat diklasifikasikan kedalam hukum kebendaan yang bersifat memberikan jaminan sepanjang dapat dibuktikannya hak kepemilikannya, sehingga dapat digunakan sebagai terobosan atau perkembangan dalam hukum jaminan, khususnya sebagai objek jaminan fidusia. Cryptocurrency yang digunakan sebagai jaminan fidusia akan berlaku asas droit de suit (Pasal 1 angka 1 UU.4/1999); penjaminan atas cryptocurrency berlaku asas publisitas (Pasal 11 UU.4/1999 jo. PP.21/2015). Senyampang perihal itu, cryptocurrency hanya dapat dipergunakan sebagai jaminan tambahan bukan sebagai jaminan pokok, karena sifat cryptocurrency memliki harga yang sangat flutuatif.
