Abstract

The relationship between law and medicine is crucial in the process of proving someone's guilt because not all aspects of knowledge can be mastered by a judge. In this case, the role of a doctor is vital in helping reveal the condition of evidence in the form of a human body or human body parts in a trial. The role of forensic doctors is very significant in handling criminal cases by revealing evidence that can be in the form of a human body or body parts, as well as providing an assessment of the causal relationship between the victim and the perpetrator of the crime through a post-mortem report, which provides an overview for the judge. Through their medical knowledge and forensic skills, forensic doctors help uncover facts related to criminal cases, especially in cases of death or physical violence. By conducting post-mortem examinations, autopsies, and preparing post-mortem reports, they provide medical evidence that is crucial for the investigation and criminal evidence process in court.

Abstract

As time goes by, the challenges in raising and nurturing children are becoming increasingly complex. Cases of juvenile delinquency leading to dangerous behavior are becoming more frequent, such as student brawls, drug abuse, bullying, and promiscuity that can lead to pregnancy and abortion. This study employs a normative approach. The context of children in conflict with the law is crucial for distinguishing criminal liability for children from that for adults. This is because while all actions by adults constitute crimes, they constitute delinquency for children. This study identified challenges in the implementation of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (UU SPPA), such as a lack of understanding among law enforcement officials about the concept of restorative justice and a lack of rehabilitation facilities in the regions. The results of this study emphasize the important role of families, schools, and communities in preventing criminal acts by children and the need to optimize diversification and rehabilitation policies.

Abstract

The rapid development of technology has had an impact on changes in people's lifestyles, where things can be done quickly and easily using online-based services or using the internet network, whether in terms of shopping transactions, booking hotels, paying electricity bills, train tickets, plane tickets, or making money or capital loan transactions online. The method used is normative legal research with a library research approach, which examines literature, laws and regulations, and relevant legal documents. The results of the study show two main findings. First, illegal online loan providers can be held accountable civilly, criminally, and administratively. In the civil realm, they are required to compensate for losses based on Article 1365 of the Civil Code. In the criminal realm, perpetrators can be charged with articles related to extortion, misuse of personal data, and fraud. Meanwhile, administratively, the OJK has the authority to impose sanctions such as license revocation and access blocking based on POJK No. 77/POJK.01/2016. Second, delinquent debtors who utilize illegal online loans to commit fraud, such as identity falsification or fictitious loans, can be charged with Article 378 of the Criminal Code if there is evidence of malicious intent. The implications of this research are the need to increase public awareness of the right to personal data privacy, strengthen law enforcement, and update policies in accordance with the dynamics of the digital era.

Abstract

The contribution of forensic medicine to the results of forensic examinations, such as autopsies, plays a crucial role in identifying key evidence and determining the cause of death. By adhering to professional ethics and standards, forensic doctors help uphold justice and the integrity of the legal system. The method used in this study is normative. This law enforcement is carried out in the form of valid evidence in the form of letters and statements according to experts. therefore the relationship between the two cannot be separated. Investigators, expert doctors, and other law enforcement officers work together to coordinate with each other so that each stage in proving a case produces results in the form of concrete evidence, so that it can be used as a consideration for decisions to be taken by judges in court. The role of forensic medical assistance is very necessary to find the material truth in murder cases in order to clarify the criminal case and obtain valid evidence, but the role of forensic medicine is not always successful, there are also obstacles that occur.

Abstract

The issue of bullying among children is becoming a serious concern due to its psychological impact, which can lead to severe mental disorders such as anxiety, depression, and even suicidal thoughts. In Indonesia, despite the existence of the Child Protection Law, the implementation of policies regulating the protection of children from bullying still faces various challenges. This study aims to examine the impact of bullying on children's mental health and identify the legal protection mechanisms available to reduce the risk of suicide due to bullying. This study uses a qualitative approach, with data collection methods through literature studies and document analysis, including data from the Indonesian Child Protection Commission (KPAI) and relevant laws and regulations. The findings show that bullying in Indonesia, whether verbal, physical, social, or cyberbullying, has a significant psychological impact on children, increasing the potential for suicide. This study emphasizes the need to strengthen child protection policies and implement more effective psychological support for victims of bullying. In conclusion, this study makes an important contribution to understanding the relationship between bullying and children's mental health, and encourages the improvement of policies and more robust reporting systems in schools to prevent suicide among children who are victims of bullying.

Abstract

Developments in the field of information and communication technology have created great opportunities for online interaction, but have also increased the potential for sexual violence to occur on the internet. The aim of this research is to analyze how criminal law in Indonesia handles cases of sexual violence that occur online, examine the role of digital security policies in providing protection for victims, and evaluate how effective the regulations that have been implemented in the field are. Using a descriptive-analytical method, this study shows that legal instruments such as the Sexual Violence Crime Law, the Information and Electronic Transactions Law, and the Criminal Code have provided adequate normative foundations to ensnare perpetrators and protect victims. However, its effectiveness is still hampered by the limited ability of authorities to collect digital evidence, the community's low level of digital literacy, and a lack of coordination between the government, digital platforms and organizations assisting victims. Policies regarding digital security have a crucial role in prevention and recovery efforts, but their implementation is still not running optimally. This research emphasizes the importance of systemic strengthening through increasing apparatus capabilities, adaptive policy updates, cross-sector collaboration, and empowering victims to ensure comprehensive protection in the digital world.
