Abstract

Child marriage in the digital era is an interesting fact because this type of marriage is classified as sexual violence. However, child marriage is very common in Indonesia because of many factors. Child marriage in the digital era is known to have triggered many problems, such as reproductive health problems, domestic violence, and divorce. However, considering child marriage as a criminal offense of sexual violence (TPKS) as stated in Law Number 12 of 2022, is unwise. Departing from this issue, this research identifies three reasons why child marriage cannot be categorized as sexual violence in the digital era. The results of this paper show that child marriage in Indonesia is inevitable due to three main arguments: Islamic teachings permit child marriage, the high number of marriage dispensations, and the TPKS Law focuses more on protecting women, not the spouses of child marriage perpetrators. Another cause of child marriage is poor education in the digital era, coupled with poor understanding of the importance of self-protection from promiscuity in the digital era among community members. Education on gender equality and reproduction also has not been properly applied. Finally, marriage guidance for teenagers and prospective brides in the digital era has not been implemented yet.

Abstract

This study aims to comprehensively evaluate the temporal trends of the literature, academic collaborations, and the most cited works in the field of Islamic law and women by employing a bibliometric analysis method. For the sample scope of the study, academic articles indexed in the Web of Science database between 2003 and 2023 were analysed. The findings indicate that research on Islamic law and women is concentrated in specific geographical regions, interdisciplinary approaches have been increasingly adopted, and periodic fluctuations are observed in academic production. The results reveal that the highest academic output is produced in countries such as the United States, Turkey, Malaysia, Indonesia, and the United Kingdom. However, despite Turkey’s high publication productivity, its international citation rates remain low. A significant portion of the studies focuses on the intersection of gender and legal perspectives. Mir-Hosseini’s work, with 130 citations, is the most frequently referenced article. Another notable finding is the limited academic collaboration in the field of Islamic law, as most studies are conducted as individual research endeavours. The findings suggest that the issue of women's rights within the context of Islamic law requires more interdisciplinary studies and that academic production should enhance its international visibility. Future research is recommended to incorporate empirical datasets, integrate studies in local languages into the international academic literature, and increase regional comparisons. This study offers a valuable resource for understanding the intellectual structure of academic production on Islamic law and women, and aims to serve as a guide for future research.

Abstract

This study aims to examine the incorporation of Indonesian fiqh into the Islamic higher education curriculum and its impact on fostering moderate attitudes among students. The research highlights the importance of ijtihad (independent reasoning) in adapting Islamic law to the contemporary needs of Indonesian society, emphasizing values such as gender equality, interfaith harmony, and democratic principles. The study employs a qualitative method, analyzing the curriculum content and its practical applications in three prominent Islamic universities: UIN Syarif Hidayatullah Jakarta, UIN Walisongo Semarang, and UIN Sunan Gunung Djati Bandung. Results indicate that the Indonesian fiqh curriculum is expected to significantly contributes to shaping students' moderate attitudes by promoting respect for human dignity, inclusivity, and adaptability. The curriculum encourages students to integrate religious, social, cultural, and state morals, fostering a balanced and comprehensive understanding of Islamic teachings. Themes such as women's emancipation and interreligious relationships are emphasized, highlighting the relevance of Islamic principles in modern contexts. Practical applications through social activities, community service, and leadership opportunities further reinforce these values, enabling students to act as agents of change. In conclusion, the Indonesian fiqh curriculum plays a crucial role in nurturing well-rounded, moderate, and compassionate individuals. By aligning with national needs and promoting inclusive values, it ensures that students are equipped to navigate and positively contribute to a diverse and dynamic society. This holistic approach fosters peace, harmony, and national development, making the Indonesian fiqh curriculum an essential component of Islamic higher education.
