Abstract

Zakat, infaq, shadaqah (ZIS) as funding sources in Islam, were not able to solve Indonesian muslim’s sosio-econimic problem yet. According some studies, the potential amount of ZIS reached 100 bilion per year. This problems were caused by two factor, muzakki and amil. Muzakki still not trully believe in amil to distribute funds zakat , infaq , and shadaqah to mustahik. In other side, LAZ as frontier operator, was not optimal in digging and distributing the potential of zakat. To create public trust, LAZ has to optimize its functions, based on four basic prinsipals: the principle of faith, the moral principle, the principle of institutions, and principle menajemen .   Zakat, infaq, shadaqah sebagai sumber-sumber pendanaan sosial dipandang belum mampu menyelesai- kan persoalan-persoalan sosio-ekonomi yang dihadapi masyarakat muslim di Indonesia. Padahal, ber- dasarkan sejumlah penelitian, potensi dana ZIS di Indonesia mencapai 100 miliyar lebih per tahunnya. Hal ini disebabkan oleh dua faktor, yaitu faktor muzakki dan faktor amil zakat. Muzakki belum percaya sepenuhnya terhadap amil, untuk mendistribusikan dana zakat, infaq, maupun shadaqah kepada mustahik. Selain itu, lembaga amil yang berperan sebagai operator, belum optimal dalam menggali dan mendayagunakan potensi zakat. Untuk menumbuhkan kepercayaan masyarakat terhadap LAZ, perlu dilakukan optimalisasi peran dan fungsi amil berdasarkan prinsip rukun iman, prinsip moral, prinsip lembaga, dan prinsip menajemen.

Abstract

Suka rela merupakan salah satu prinsip ajaran Islam dalam aktivitas ibadah maupun muamalah. Asas suka rela juga diimplementasikan dalam bidang perkawinan sebagaimana ditegaskan dalam beberapa hadits Rasulullah SAW. Indikator yang digunakan yaitu isarat “diam” dari calon mempelai perempuan. Namun, tidak jarang hadits tentang indikator ini dipahami secara parsial dan manafikan konteks sosio-historisnya. Wali sering kali melakukan hegemoni dan pemaksaan terhadap perempuan yang ada di bawah perwaliannya,tanpa memperhatikan kondisi psikologisnya, perubahan sikap, dan hak-hak dasarnya dalam perkawinan. Penggunaan sebuah isyarat pada dasarnya harus disepakati terlebih dahulu oleh pemberi isyarat dan penerima isyarat dalam proses dialogis. Sebagaimana yang dicontohkan Rasulullah SAW pada saat menerima peminangan dari Ali bin Abi Thalib.

Abstract

Underage marriage is still a problem for developing countries, including Indonesia. Various national and international research shows that the model has the potential marriage has increased in the decade ahead. In Indonesia, the marriage age limit set is 19 years for men and 16 years for women. Only, this limitation may file a dispensation remained unfulfilled by marriage to the religious court. The absence of standards in the Marriage Act opened the opportunity for the judges to make a decision based on its own initiative, which tends to refer to the texts  of fiqh. The implication, most requests are always granted dispensation, so that it  is as a causative factor of underage marriage.

Abstract

This article intents to examine the civil rights of children outside of married arising from Constitutional Court Decision No. 46 / PUU-VIII / 2010 review by justice aspects. This article is normative juridical research with a qualitative approach to the primary legal materials, namely Law No. 1 of 1974 on Marriage and the constitutional Court Decision No.46 / PUU-VIII / 2010. While the secondary legal materials such as books, journals, research related to children outside of married. Before the decision of the Constitutional Court No. 46/PUU-VIII/2010 was issued, children outside of marriage do not get the personal law rights, both the principles of Islamic justice and the West, as well as human rights perspective. After the emergence of Constitutional Court Decision No. 46 / PUU-VIII / 2010, children outside married have the same status as a legitimate child, with the requirement to have medical evidence.Artikel ini bertujuan mengkaji hak-hak keperdataan anak luar kawin yang muncul akibat Putusan Mahkamah Konstitusi No. 46/PUU-VIII/2010 ditinjau dari aspek keadilan. Artikel ini merupkan hasil penelitian yuridis normatif dengan pendekatan kualitatif dengan bahan hukum primer yaitu Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Sedangkan bahan hukum sekunder berupa buku, jurnal, penelitian terkait anak luar kawin. Sebelum putusan Putusan Mahkamah Konstitusi No. 46/PUU-VIII/2010 dikeluarkan, anak luar kawin tidak mendapatkan hak-hak keperdataannya secara adil. Baik menurut prinsip keadilan Islam, Barat, maupun perspektif HAM. Pasca munculnya Putusan Mahkamah Konstitusi No. 46/PUU-VIII/2010, anak luar kawin memiliki kedudukan yang sama dengan anak sah, dengan syarat memiliki bukti medis.

Abstract

The  existence  of  a  religion  in  the  modern  era,  is  determined  by  its  velocity  to  respond and resolve the problems of life creatively, by means of ijtihad, with a wide range of its methodology.  A  progressive  steps  have  been  carried  out  by  Indonesian’s  scholars  by giving rights to the relics of a foster child by testament wajibah, regulated in article 209 compilation of Islamic law. Though it is never cached prearranged classical fiqh. Thus, even though in its development of article 209 hasn’t been able to reflect justice. Therefore, the part that was accepted by the adopted child may be smaller than the other heirs, regardless of contributions or services that have been given a foster child to adoptive parents Eksistensi suatu agama di era modern, ditentukan bagaimana merespon dan menyelesaikan problem kehidupan secara kreatif dengan cara ijtihad, dengan berbagai macam metodologinya. Langkah  progresif  telah  dilakukan  oleh  ulama  Indonesia  dengan  memberikan  hak  dari harta peninggalan kepada anak angkat melalui wasiat wajibah, yang diatur dalam Pasal 209 Kompilasi Hukum Islam. Padahal hal ini tidak pernah diatur sebelumnya di dalam khazanah  fiqh  klasik.  Meskipun  dimikian,  dalam  perkembangannya  Pasal  209 belum mampu mencerminkan keadilan. Sebab, bagian yang diterima oleh anak angkat bisa jadi lebih kecil dari bagian ahli waris lain, tanpa mempertimbangkan kontribusi atau jasa yang telah diberikan anak angkat kepada orang tua angkatnya.

Abstract

This research is motivated by the enthusiasm of the Malang City Government to promote the certification of waqf land whose legal status is uncertain. Data shows that certified wakaf land is only 45.6% while certified wakaf land is still 54.4%. The main purpose of this study is to describe the factors that cause uncertified waqf land in Malang City, to illustrate the real efforts of the Malang City Government to increase public legal awareness, and to analyze the Malang City community's views on endowment land certification. using legal awareness theory. The results showed that the factors behind uncertified waqf land were the low level of legal awareness of the people of Malang City, high costs, and long complicated procedures for obtaining certificates. Therefore, the government has introduced a number of policies to resolve the problem, such as legal education and free registration of waqf land. Finally, the analysis of legal awareness theory shows that the people of Malang City have an intermediate range of legal awareness due to the cognitive level of legal regulation, the content of cognitive level regulation, legal attitude, and legal behavior Penelitian ini dilatarbelakangi oleh antusiasme Pemerintah Kota Malang untuk mempromosikan sertifikasi tanah wakaf yang status hukumnya masih belum pasti. Tujuan artikel ini adalah untuk mendeskripsikan faktor-faktor yang menyebabkan tanah wakaf tidak bersertifikat di Kota Malang, untuk menggambarkan upaya nyata pemerintah Kota Malang untuk meningkatkan kesadaran hukum publik, dan untuk menganalisis pandangan masyarakat Kota Malang tentang sertifikasi tanah wakaf. Hasil penelitian menunjukkan bahwa faktor-faktor di balik tanah wakaf tidak bersertifikat adalah rendahnya tingkat kesadaran hukum masyarakat Kota Malang, biaya tinggi, dan prosedur rumit panjang untuk mendapatkan sertifikat. Oleh karena itu, pemerintah telah memperkenalkan beberapa kebijakan untuk menyelesaikan masalah, seperti pendidikan hukum dan pendaftaran gratis untuk tanah wakaf. Akhirnya, analisis teori kesadaran hukum menunjukkan bahwa masyarakat Kota Malang memiliki rentang kesadaran hukum menengah karena tingkat kognitif regulasi hukum, isi regulasi level kognitif, sikap hukum, dan perilaku hukum.Kata Kunci: waqf tanah; sertifikat; kesadaran hukum

Abstract

COVID-19 has brought significant changes in people’s lives, especially in the economic sector. As a financial tool for the people, Zakat is expected to be a source of community welfare in the pandemic era. Well-managed zakat is expected to be able to provide jobs for the affected community. This article aims to describe the revitalization of productive zakat in zakat management institutions in East Java during the COVID-19 pandemic. It is a juridical-empirical research. The study’s primary data were the results of semi-structured interviews with the Zakat Managers at BAZNAS East Java, Nurul Hayat Malang, and YDSF Malang. This study indicates that the mentioned zakat institutions have distributed zakat productively, although it has not run optimally. The problems include the lack of understanding and assistance, as well as the less varied productive zakat program. This will be easily overcome by managing productive zakat professionally involving partner institutions that are consistent in mentoring and development. This article may enrich the literature of productive zakat management and provide some recommendations to implement the zakat management more effective.COVID-19 membawa perubahan signifikan dalam kehidupan masyarakat, khususnya di sektor ekonomi. Zakat sebagai piranti keuangan umat diharapkan mampu menjadi sumber kesejahteraan masyarakat di era pandemi. Zakat yang dikelola secara produktif diharapkan mampu menyediakan lapangan pekerjaan bagi masyarakat yang terdampak. Artikel ini bertujuan mendeskripsikan revitalisasi zakat produktif di institusi pengelola zakat di Jawa Timur pada masa pandemi COVID-19. Artikel ini berdasarkan hasil penelitian yuridis-empiris. Data primer penelitian adalah hasil wawancara dengan para manajer zakat di BAZNAS Jawa Timur, Nurul Hayat Malang, and YDSF Malang. Studi ini menunjukkan bahwa lembaga zakat yang disebutkan telah mendistribusikan zakat secara produktif, meskipun belum berjalan secara maksimal. Persoalan yang dihadapi antara lain adalah lemahnya pemahaman dan rendahnya pendampingan, serta program zakat produktif yang kurang variatif. Hal tersebut akan mudah diatasi dengan pengelolaan zakat produktif secara profesional yang melibatkan lembaga mitra yang konsisten dalam pendampingan dan pengembangan. Artikel ini dapat memperkaya literatur pengelolaan zakat produktif dan memberikan beberapa rekomendasi untuk melaksanakan pengelolaan zakat secara lebih efektif.

Abstract

Green sukuk is a contemporary-era sharia investment revolution that accommodates environmental aspects. Integrating Sustainable Financing in green sukuk can be an alternative investment platform contributing to sustainable development. The concept paradigm is relevant for strengthening the proportional construction of green sukuk law in Indonesia. The study aimed to analyze the concept of sustainable financing as the legal basis for implementing green sukuk in supporting sustainable development programs in Indonesia. The study used normative legal research methods. This research approach used a conceptual approach through reasoning the concepts of sustainable financing, green sukuk, and other concepts relevant to the topic of study to strengthen the discussion argument. The study showed that there are 2 (two) components of the relevance of the Sustainable Financing paradigm as the basis for implementing green sukuk in Indonesia. First, the implementation of green sukuk in various countries has rules that accommodate sustainable financing in response to climate change problems. Second, the sustainable financing Paradigm is relevant as a source of green sukuk legal construction to strengthen the policy basis for implementing environmentally sound investment in Indonesia. The urgency of the regulation is to increase investment commitments that can increase environmental resilience, alleviation of social problems and business transparency in contributing to sustainable development in Indonesia.

Abstract

Child marriage in the digital era is an interesting fact because this type of marriage is classified as sexual violence. However, child marriage is very common in Indonesia because of many factors. Child marriage in the digital era is known to have triggered many problems, such as reproductive health problems, domestic violence, and divorce. However, considering child marriage as a criminal offense of sexual violence (TPKS) as stated in Law Number 12 of 2022, is unwise. Departing from this issue, this research identifies three reasons why child marriage cannot be categorized as sexual violence in the digital era. The results of this paper show that child marriage in Indonesia is inevitable due to three main arguments: Islamic teachings permit child marriage, the high number of marriage dispensations, and the TPKS Law focuses more on protecting women, not the spouses of child marriage perpetrators. Another cause of child marriage is poor education in the digital era, coupled with poor understanding of the importance of self-protection from promiscuity in the digital era among community members. Education on gender equality and reproduction also has not been properly applied. Finally, marriage guidance for teenagers and prospective brides in the digital era has not been implemented yet.

Abstract

This study aims to analyze the differences in fatwas among scholars in the Middle East and South East Asia (Indonesia and Malaysia) towards various Islamic Banking Contracts products and assess the implementation of maqâshid al-sharia within the variety of fatwas mentioned. This study employed a qualitative approach and fatwas from the Middle East and South East Asia as the primary data, while the secondary data were obtained from books on Muaamalah Fiqh and Islamic Banking. The data were garnered based on a literature review with a content analysis technique. The descriptive-inductive method with a reflective way of thinking is used for data exposure, leading to the following findings: 1) There are differences in fatwas towards three Islamic Banking contracts: a) The determination of the deposit contract in the Middle East is stipulated in a qardh contract in a non-investment account; meanwhile, in South East Asia it is stipulated in a wadiah contract; b) in terms of Murâbahah contract, some of the Middle East scholars forbid it, while, some of South East Asian scholars and few scholars from Middle East allow it, and; c) in terms of the al-Ijarah al-muntahiyyah bi al-tamlik, most of Middle East Scholars forbid it, but South East Asian scholars allow it; 2) The implementation of maqâshid sharia within differences of fatwas among scholars has been appropriately implemented in accordance with Islamic law specified under contracts in Islamic banking products in Muslim countries.
