Abstract

Tujuan penulisan mengenai aspek hukum dan lingkungan terkait kegiatan pertambangan di Indonesia, dengan fokus pada dampak pencemaran air. Undang-Undang Republik Indonesia Nomor 3 Tahun 2020 mengatur tahapan kegiatan pertambangan, termasuk tahap penyelidikan umum, eksplorasi, konstruksi, penambangan, dan pascatambang. Pencemaran lingkungan menjadi isu penting dalam konteks ini, seiring dengan perkembangan Peraturan Pemerintah Republik Indonesia Nomor 22 Tahun 2021 tentang Penyelenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup. Pencemaran lingkungan terjadi saat zat-zat berbahaya atau komponen lain masuk ke dalam lingkungan hidup, termasuk air, melampaui baku mutu yang ditetapkan. Dalam konteks pertambangan, aktivitas ini seringkali menjadi penyebab potensial pencemaran air. Penelitian ini dilaksanakan dengan pendekatan metode kualitatif deskriptif yang mencakup pendekatan perundang-undangan dan studi literatur. Hasil dari tulisan ini berfokus untuk memberikan pemahaman yang lebih mendalam tentang dampak kegiatan penambangan terhadap lingkungan di wilayah Kalimantan Tengah.

Abstract

Law Number 4 of 2024 on the Welfare of Mothers and Children reflects the state’s commitment to ensuring the protection of maternal and child rights, particularly during the first 1,000 days of life. However, its implementation faces various challenges, including regulatory inconsistencies with the Manpower Act and weak enforcement mechanisms at the operational level. This article aims to examine the gap between legal norms and practical implementation, as well as to assess the extent to which Law Number 4 of 2024 fills the existing legal vacuum in the protection of mothers and children in Indonesia. This study employs a normative juridical approach with qualitative analysis of relevant legislation and supporting documents. The findings indicate that the effectiveness of protection for working mothers and children depends significantly on intersectoral policy coordination, regulatory harmonization, and institutional capacity strengthening. Without concrete steps in policy integration and legal enforcement, the objectives of the law risk being unfulfilled. Therefore, comprehensive reform in implementation is necessary to ensure the law’s alignment with the state’s constitutional obligation to uphold the welfare of mothers and children. Abstract

Sexual violence is the most common case experienced by women when compared to physical and psychological violence that occurs in 2022. It is not uncommon for sexual violence to occur in educational environments, one of which is in universities. Several regulations were made in an effort to prevent and handle sexual violence, including Permendikbudristek Nomor 30 of 2021 concerning Prevention and Handling of Sexual Violence in Higher Education Environments, the Criminal Act on Sexual Violence, and supported in the Criminal Code Number 1 of 2023 This article was written with the aim that it is important to have knowledge and insight regarding the existence of comprehensive legal regulations as a legal umbrella in dealing with criminal acts of sexual violence. The issues raised in this article include legal regulations that can accommodate the needs of victims of sexual violence, how law enforcement officials respond in understanding cases of sexual violence, and legal analysis of the three regulations regarding sexual violence. The normative research method used in this paper is to identify the legal rules written in Law No. 12 of 2022 concerning Crimes of Sexual Violence, Criminal Code Number 1 of 2023, and Minister of Education and Culture Regulation Number 30 of 2021. The results of this research show that the UUTPKS accommodates the restoration of the rights of victims of sexual violence that were previously denied to the victims. Difficulty in describing sexual violence is an inhibiting factor in law enforcement in the field by law enforcement officers. Thus, it is very important to provide information to the public about criminal acts of sexual violence. Victims of sexual violence receive protection, treatment and assistance in efforts to restore their rights.

Abstract

Keberadaan Kawasan Taman Nasional merupakan salah satu usaha menjaga kelestarian ekosistem alami, flora, fauna, dan berbagai sumber daya alam, serta mengurangi dampak negatif manusia terhadap lingkungan. Insiden terbakarnya hutan yang terjadi di kawasan Taman Nasional Bromo Tengger Semeru yang disebabkan oleh kelalaian pengunjung saat melakukan sesi foto prewedding telah menyebabkan kerusakan lingkungan yang sangat serius, kerugian di bidang ekonomi, serta masalah sosial. Penelitian ini menggunakan metode penelitian hukum normatif yang melibatkan analisis peraturan perundang-undangan, teori hukum, prinsip-prinsip hukum, maupun yurisprudensi yang memiliki relevansi dengan topik yang sedang dibahas. Penelitian ini membahas mengenai analisis yuridis terhadap perlindungan kawasan taman nasional menurut UU No. 5 Tahun 1990 tentang Konservasi Sumber Daya Alam dan Ekosistemnya, bagaimana pertanggung jawaban hukum pelaku perusakan lingkungan hidup di kawasan taman nasional yang diatur dalam Undang-Undang ini serta berkontribusi memberikan suatu pandangan yang diharapkan dapat menyempurnakan regulasi mengenai Konservasi Sumber Daya Alam dan Ekosistem di Indonesia.

Abstract

To build a strong character within Indonesian society, particularly in the higher education environment, through the implementation of religious moderation today, it requires the involvement and collective commitment of the entire academic community, including lecturers, students, and educational staff. The implementation of religious moderation has a strong legal foundation, as it aims to prevent the spread of radicalism and extremism ideologies that are contrary to Indonesian laws and regulations, such as Law Number 12 of 2022 concerning Criminal Acts of Terrorism, as well as other legal provisions that prohibit actions threatening national security and the integrity of the Unitary State of the Republic of Indonesia (NKRI). This effort is carried out through the strengthening of national commitment based on the four national pillars: Pancasila, the 1945 Constitution, the Unitary State of the Republic of Indonesia (NKRI), and Bhinneka Tunggal Ika, all of which possess legal legitimacy as the foundation of national and state life. Secondly, the strengthening of attitudes of tolerance and respect for differences is pursued in accordance with the principles of human rights law guaranteed by the constitution, particularly Articles 28E and 28I of the 1945 Constitution. Thirdly, fostering a way of religious practice that respects the traditions and local cultures of Indonesia’s diverse society also reflects the protection of cultural rights within the framework of national law. The method used in this research is a qualitative method with a literature study approach, which enables the exploration of various legal instruments and government policies related to religious moderation in the higher education environment

Abstract

Environmental issues have become a global concern, including in Indonesia. One of the critical issues is the right to a clean, healthy, and sustainable environment, which is recognized as part of human rights under the Indonesian legal system. This right is explicitly stated in Article 28H paragraph (1) of the 1945 Constitution and further reinforced by Law Number 32 of 2009 concerning Environmental Protection and Management. However, in practice, the implementation of this right faces various challenges, including weak law enforcement, environmental degradation due to industrial activities, and the criminalization of environmental defenders. This research to analyze the legal standing of the right to a clean, healthy, and sustainable environment within Indonesia's legal system and to emphasize its recognition as a justiciable legal right. The research uses a normative legal method with a literature-based approach by exploring legal sources relevant to the issue. The findings indicate that the government has made efforts to fulfill this right through public education and the formulation of legal instruments. Nevertheless, these efforts remain insufficient to provide comprehensive legal protection. Therefore, there is a need to strengthen normative and institutional aspects and to enhance public participation to ensure the fulfillment of environmental rights as enforceable legal rights. Additionally, the formulation of supplementary regulations is necessary to reinforce existing laws and ensure environmental sustainability for future generations.
