Abstract

Globalization is growing rapidly affecting existing technology making many conveniences for society. bring positive and negative impacts in society. Slowly all forms of activity that were previously carried out manually are changing technology. This is also used by startup companies engaged in the fintech peer 2 peer lending or Pinjol business. consumer and public complaints about the theft of personal data on consumer loans, illegal access to consumer phone contact numbers, and also billing with threats and sexual harassment through social media belonging to consumers and relatives and families of consumer loans. Moreover, there are many illegal loan companies that trap their victims with high-interest loans that borrowers are unable to repay. This research uses a prescriptive legal method and examines law as a norm with misconceptions about legal protection. Secondary data becomes the main data. The specifications used are descriptive specifications. Theft of personal data with the aim of making threats and damaging a person's dignity is a crime that needs to be anticipated by Indonesian law.

Abstract

The heroes of Indonesian independence  fighters have tried hard to seize the rights of our nation's independence in order to get freedom from the invaders and gain recognition from the eyes of the world that Indonesia is an independent and sovereign nation. Indonesia became independent on August 17, 1945 and Indonesia established Pancasila as the state ideology including red and white flag as the state symbol. However, Indonesia needs a national identity and a language that is used for national communication as a sovereign, independent nation. As a result, Indonesian was chosen as the state's identity and as the unifying language on August 18, 1945. The Indonesian nation's identity, Indonesian, plays a significant part in demonstrating Indonesia's presence to the rest of the globe. Indonesian was created prior to independence, despite being declared the state language on August 18, 1945. Specifically, during the second youth congress, which took place on October 28, 1928, and which is also known as the Youth Pledge. Many things in the current globalization era are affected by the passing of time and the effects of globalization. One of them is the threat to the existence of Indonesian, the language that unites us. We communicate in a variety of foreign languages on a regular basis, and many people also combine these languages with Indonesian. As a result, we must preserve the Indonesian language and contribute to its existence. The younger generation should effectively protect the Indonesian language in the age of globalization, as stated in the youth oath.

Abstract

Trade balance is an important indicator to assess the economic balance of a country in international trade relations. Tariff policies, both import and export tariffs, play a significant role in influencing the dynamics of a country’s trade balance. Tariffs are used as a protection tool to safeguard domestic industries, control the flow of imported goods, and strengthen the competitiveness of domestic products in the global market. A reduction in import tariffs can increase exports and reduce trade deficits, while an increase in import tariffs has the potential to hinder exports and enlarge trade deficits. Similarly, export tariff policies can impact the ability of domestic products to compete in international markets. The interaction between import and export tariff policies also greatly determines the balance of a country’s trade balance, where disproportionate policies can trigger tariff retaliation from trading partner countries and worsen trade conditions. Therefore, a balanced and adaptive tariff policy strategy is required to support the stability of the trade balance and sustainable national economic growth.

Abstract

Tujuan penelitian ini adalah memberikan pengenalan tentang mediasi dan bagaimana tata cara serta proses penyelesaian sengketa bisnis menggunakan mediasi. Bisnis telah muncul sejak zaman dulu, dari mulanya menggunakan sistem barter sampai kini beralih menggunakan nilai uang. Kegiatan bisnis merupakan kegiatan yang dijalankan dengan melibatkan lebih dari 2 individu agar tercapai tujuan bersama, kegiatan bisnis yang dijalankan dengan jumlah transaksi kecil maupun besar setiap harinya tidak dapat dipungkiri memungkinkan terjadinya sengketa. Sengketa bisnis umumnya timbul akibat perselisihan pada saat melakukan kegiatan isi kontrak bisnis, perbedaan pendapat antara pihak yang terlibat dalam melakukan kegiatan bisnis, benturan kepentingan, adanya pelanggaran perundang-undangan, pelanggaran perjanjian bisnis yang telah disepakati yang semua hal ini dapat diartikan sebagai wanprestasi atau tindakan inkar janji. Salah satu cara menyelesaikan sengketa dengan cara damai adalah mediasi yaitu penyelesaian sengketa dengan musyawarah yang akan dibantu oleh pihak ketiga (ke-3) sebagai pihak netral yang tidak memihak siapapun. Tahap mediasi sebagai penyelesaian sengketa bisnis memiliki 4 proses. Mediasi menjadi cara penyelesaian sengketa bisnis yang mengutamakan kedamaian dan kesepakatan bersama bagi pihak yang terlibat.
