Abstract

AbstractThis essay analyzes philanthropic contributions in Indonesia and Malaysia, two nations with extremely different cultural histories, with a focus on literary studies. In the essay, the concept of charity is discussed along with how it has influenced Islamic culture in the two countries. Additionally, it examines the effects of historical, religious, and sociocultural contexts on the parallels and differences between Malaysian and Indonesian philanthropic cultures. The ideas of sadaqah, zakat, and waqf all include charitable giving in Indonesia; amal jariah and baitulmal do the same in Malaysia. Despite the fact that they approach philanthropy in different ways, both Indonesia and Malaysia have been able to establish exceptional initiatives that have a significant impact on society. Some of the challenges involved in putting philanthropy into practice in Indonesia and Malaysia, including a lack of collaboration between philanthropic groups and the government and a lack of accountability and transparency in the administration of philanthropic funding. Finally, this study provides a fascinating comparison of the significance of generosity in Malaysia and Indonesia, twonations with very different cultural traditions. The report addresses case examples of philanthropy in health and education, as well as the challenges that both countries faced when philanthropy was implemented.Keywords : Indonesia, Malaysia, Philanthropic AbstrakEsai ini menganalisis kontribusi filantropi di Indonesia dan Malaysia, dua negara dengan sejarah budaya yang sangat berbeda, dengan fokus pada studi sastra. Dalam esai ini, konsep amal dibahas bersama dengan bagaimana hal tersebut mempengaruhi budaya Islam di kedua negara. Selain itu, esai ini juga mengkaji pengaruh konteks sejarah, agama, dan sosiokultural terhadap persamaan dan perbedaan budaya filantropi Malaysia dan Indonesia. Di Indonesia, gagasan sedekah, zakat, dan wakaf mencakup pemberian amal; di Malaysia, amal jariah dan baitulmal melakukan hal yang sama. Terlepas dari kenyataan bahwa mereka melakukan pendekatan filantropi dengan cara yang berbeda, baik Indonesia maupun Malaysia telah mampu membangun inisiatif luar biasa yang memiliki dampak signifikan pada masyarakat. Beberapa tantangan yang dihadapi dalam mempraktikkan filantropi di Indonesia dan Malaysia adalah kurangnya kolaborasi antara kelompok-kelompok filantropi dan pemerintah serta kurangnya akuntabilitas dan transparansi dalam pengelolaan dana filantropi. Akhirnya, penelitian ini memberikan perbandingan yang menarik tentang pentingnya kedermawanan di Malaysia dan Indonesia, dua negara dengan tradisi budaya yang sangat berbeda. Laporan ini membahas contoh-contoh kasus filantropi di bidang kesehatan dan pendidikan, serta tantangan yang dihadapi kedua negara ketika filantropi diimplementasikan. Abstract

This study examines the evolving dynamics of minority groups within Turkey's shifting political landscape, from Atatürk's secular reforms to the rise of Islamist ideology under Erdoğan's leadership. It traces Turkey's political transformation from the decline of the Ottoman Empire through the establishment of a secular republic and the recent resurgence of Islamic influence in governance. The research employs qualitative methods, including historical analysis and case studies, to explore how these political shifts have impacted minority rights, cultural expressions, and societal integration. Findings reveal that both secularization and Islamization processes have presented challenges for minority communities, albeit in different ways. The study highlights the ongoing tension between modernization, traditional values, and religious identity in shaping Turkey's national character and its treatment of minority groups. This research contributes to broader discussions on the role of religion in public life, the limits of secularism, and the complexities of managing diversity in modern nation-states.

Abstract

The purpose of this study is to investigate Islamic legal reform in Indonesian family law. A literature review and document analysis served as the foundation for the study. The research process began with a survey of the literature, which included a selection of books, academic papers, earlier studies, and pertinent government documents about the reform of Islamic family law. The purpose of this literature review was to comprehend the background, evolution, and application of family law reform in the context of Islamic law. A comparative study technique was used in the second part of the research to compare Indonesian Islamic family law with Islamic family laws in other nations that have enacted comparable reforms. The comparative study's findings revealed regional variations and convergences in approaches to the reform of Islamic family law. Without using the interview approach, the research attempts to provide a thorough knowledge of the evolution of Islamic family law reform in the environment under investigation by blending document analysis and literature evaluation.

Abstract

This article examines Indonesia's urgent need to update Islamic family law to reflect modern dynamics, technological advancements, and universal justice principles. The primary goal of reform is to elevate women's status by upholding, defending, and expanding their rights in line with Sharia law. The research methodology examines the history and foundation of family law reform in the context of Islamic law through a review of the literature and document analysis. The primary forces behind Islamic law reform in Indonesia include the need to close legal gaps, the effects of economic globalization, and the influence of reformed Islamic legal thought. The study's conclusions include the identification of a number of particular areas within Islamic family law that need to be changed, such as women's rights in the home, divorce, and inheritance. In order to address gender inequality and create a society that is more inclusive and just, these reforms are thought to be essential first steps.

Abstract

This research examines the idea of the rule of law in the theory of absolute liability and the perspective of Islamic law in Indonesia through comparative and conceptual analysis techniques. To compare and contrast the two, this research integrates the idea of the rule of law from general theory with the understanding of Islamic law. This research emphasizes the state’s initiative to incorporate the ideas of Islamic law into its legal framework. While the idea of the rule of law and the principles of Islamic law are relevant, combining the two presents both opportunities and obstacles. This research is innovative in how it blends these ideas in Indonesia’s diverse environment. The findings from this research can help create an inclusive and just rule of law.

Abstract

This comparative study investigates the transformations taking place within the Islamic legal framework in Malaysia and Qatar, examining in depth the evolution of the law and the impact of socio-cultural factors. It undertakes a detailed mapping of the complex legal developments in the two countries by analyzing legal codes, delving into historical perspectives, and examining contemporary adaptations. Through this approach, the research reveals how Malaysia and Qatar have reconceptualized their Islamic legal systems. By focusing on similarities, differences and significant transitions in the realm of Islamic law, this study highlights the diverse approaches adopted by the two countries in interpreting and implementing Islamic law, explaining the differences in interpretation and application of the law. The main objective of this study is to provide a comprehensive overview of the evolution of Islamic law in Malaysia and Qatar.

Abstract

This study examines the differing views on mut'ah (temporary) marriage between the Ja'fari and Sunni schools of Islamic jurisprudence through a comparative analysis of their legal reasoning methodologies. Employing qualitative research methods including textual analysis of primary sources, historical examination, and comparative legal analysis, the study explores the origins of these divergent interpretations and their implications for contemporary Muslim societies. The findings reveal that differences in scriptural interpretation, hadith authentication, and legal principles contribute to the contrasting positions on mut'ah marriage. While the Ja'fari school considers it permissible based on Quranic verses and certain hadith, Sunni schools generally prohibit it, citing abrogation and potential social harms. The study highlights how these differing views reflect broader patterns of legal pluralism in Islamic jurisprudence and impact contemporary debates on gender, marriage, and religious authority in Muslim communities. By critically evaluating arguments from both traditions, this research contributes to a more nuanced understanding of Islamic legal diversity and its ongoing negotiation in modern contexts.

Abstract

This study examines the perceptions of religious leaders on the legality of out-of-court divorce in Central Lombok using a qualitative approach and field research methodology. Primary information was collected through in-depth interviews with religious leaders and community leaders who have expertise in divorce issues. To obtain precise and comprehensive data, face-to-face interviews were conducted. In addition, this research utilized qualitative methodology to present secondary information on Islamic law and affirmative divorce law. Among the secondary data used were court decisions, legislation related to divorce, legal literature, and court decisions. This research examines the perspectives of religious authorities, Islamic legal ideas, and legal provisions that support out-of-court divorce through primary and secondary data collection. This approach is expected to provide a thorough understanding of the religious authorities' point of view and outline the actual circumstances surrounding the legality of out-of-court divorce within the framework of Islamic law and positive law in Central Lombok.

Abstract

Lajnah Bahtsul Masa’il is used in Nahdlatul Ulama's Istinbathh procedure to determine Islamic law in Indonesia. Starting with the qauli approach, they directly reference the writings of the four madhhabs or their successors. There is also the manhaji approach, which combines a maqashidi approach with collective ijtihad. These three approaches make it possible to create rules adaptable to social and cultural developments in Indonesia while maintaining the core principles of Islamic law's universality. The Istinbathh technique of Nahdlatul Ulama is crucial in adapting to Indonesian society's dynamics and fostering harmony between traditional Islamic teachings and modern advancements. Lajnah Bahtsul Masa’il digunakan dalam prosedur Istinbathh Nahdlatul Ulama untuk menentukan hukum Islam di Indonesia. Lajnah ini mengacu pada empat mazhab saat membahas topik-topik keagamaan. Dimulai dengan pendekatan qauli, mereka membuat referensi langsung ke tulisan-tulisan dari empat mazhab atau penerusnya. Jika tidak ada sudut pandang yang jelas, mereka menggunakan pendekatan ilhaqiy, membandingkan penilaian masalah baru dengan yang sebanding dengan cara merujuk pada sumber-sumber kredibel (mutabar) dan mengutip sudut pandang yang sudah ada sebelumnya. Ada juga pendekatan manhaji, yang menggabungkan pendekatan maqashidi dengan ijtihad kolektif. Ketiga pendekatan ini memungkinkan terciptanya aturan-aturan yang dapat beradaptasi dengan perkembangan sosial dan budaya di Indonesia dengan tetap mempertahankan prinsip-prinsip utama universalitas hukum Islam. Teknik Istinbathh Nahdlatul Ulama sangat penting, karena dengannya keberadaan hukum Islam dapat beradaptasi dan menjalin keselarasan dengan perkembangan dan kemajuan zaman yang ada di tengah masyarakat secara menyeluruh.

Abstract

This article explores several aspects of equality in Banjar Customary marriage law, especially regarding the rights of Sasak noble women in choosing a life partner. The aim is to find out and analyze the rights of Sasak noble women from the perspective of gender and Islamic Law. According to Banjar Customary Law, a noblewoman (menak) cannot marry a jajar karang man (ordinary people). If this is done, the act is considered a nyerompang (violation) which has an impact on the severance of kinship ties and inheritance rights. This study uses the contestation method from Michel Foucault which is applied to study the position and status of men and women in Sasak Society. This study found the fact that two kinds of tendencies are currently developing in Sasak society. First, the group that maintains Customary Law, and second, the group that welcomes change. The emergence of this second group is influenced by several factors, including the influence of local Ulama who offer egalitarianism in Islamic Law to solve marriage problems that arise in society. This study also concludes that there is a relationship between customs strengthened by scholars with the theory of contestation, where customs are normative forces that are maintained and influence the dynamics of power in the context of marriage. The presence of laws, thus, that combine cultural traditions and religious beliefs is needed to achieve gender equality in marriage
