Abstract

This research is based on the fact that in the community shows that there are still many hospitals that haven’tprovided health services to society without the element of discrimination, many mass media are preachingrejection of the patient until so that causes death. Rejection of patients in government hospitals in the formof direct action falls into the category of state administrative disputes if it is article 87 of Law number 30of 2014 concerning government administration point, which is a written determination that is also a factualaction of a government hospital. The methodology in this study uses normative juridical types as well asusing statute, conceptual, and case approach. On this research, using primary legal materials in the form ofthe Constitution, AP Law and PTUN Law.This research relates to the involvement of state administrationofficials if there is any refusal of patients at government hospitals and authority and the act of grantingdecisions without authority (Factual Actions) reviewed from the AP Law that causes material and immateriallosses towards the community. Administrative sanctions on government officials who perform factual actsthat article 81 of the AP Law, namely light, moderate, and severe administrative sanctions.

Abstract

Islam sering mendapat citra negatif terkait dengan kemiskinan. Islam pada hakikatnya tidak menyukai umatnya berada dalam keadaan miskin. Penelitian ini dilakukan dengan tujuan untuk memaparkan kemiskinan dan cara mengentaskan kemiskinan dalam pandangan hadits-hadits Rasulullah SAW. Metode penelitian ini yaitu studi kepustakaan dengan menggunakan sumber data yang diperoleh dari berbagai literatur-literatur yang relevan. Hasil penelitian menunjukkan bahwa kemiskinan adalah sesuatu yang berbahaya terhadap kehidupan manusia. Al-Qur’an dan Hadits hanya menyatakan bahwa Allah SWT tidak menyukai manusia dalam keadaan miskin sehingga diperintahkan untuk bersungguh-sungguh dalam bekerja untuk memperoleh manfaat baik di dunia dan akhirat. Upaya yang dapat dilakukan untuk mengentaskan kemiskinan adalah: (1) dengan semangat kerja keras; (2) perilaku hidup hemat atau tidak boros; (3) dengan pemberdayaan keuangan sosial Islam.

Abstract

Pencahayaan merupakan bagian penting dari bangunan dalam menunjang kenyamanan fisik dan fisiologi tenaga kerja dalam melaksanakan pekerjaannya menjadi lebih efisien. Intensitas pencahayaan buatan yang terlalu tinggi atau terlalu rendah akan menyebabkan masalah terhadap kesehatan.Tujuan penelitian untuk menggambarkan dan menganalisis optimalisasi intensitas pencahayaan buatan terhadap efisiensi kerja pada penjahit di pasar Wonomulyo. Jenis penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan fenomenologi.Subyek dalam penelitian sebanyak3 informan yang hanya menggunakan pencahayaan buatan dalam melakukan pekerjaannya dan ditentukan dengan teknik purposive sampling berdasarkan kriteria yang telah ditetapkan oleh peneliti.Setelah data terkumpul, selanjutnya dilakukan triangulasi yang bertujuan untuk mendapatkan data yang valid dan reliable. Triangulasi sumber yaitu penelitian mewawancarai secara semiterstruktur dengan menggali informasi mendetail subjek penelitian dan dokumentasi.Teknik analisis menggunakan teknik Miles dan Huberman yaitu reduksi data, penyajian data, dan verifikasi data.Hasil penelitian menyatakan rata-rata pengukuran intensitas pencahayaan pada ruang kerja tidak ada memenuhi syarat dengan pengukuran pagi pukul 08.30 bernilai 51,5 lux, siang pukul 13.00 bernilai 103,6 lux, sore pukul 16.40 bernilai 63 lux dengan standar 200 lux. Sedangkan untuk pencahayaan terhadap meja jahit (bidang kerja) rata- rata pada meja jahit 1, meja jahit 2 dan meja jahit 3 yang diukur pada pagi, siang, sore hari ternyata hanya meja jahit 1 pada waktu siang pukul 13.00 yang optimal pencahayaannya dengan nilai 301 lux.Meja jahit 1 dihuni oleh (P1) yang hasil kerjanya lebih efisien karena dipengaruhi juga dengan umur pekerja. Kesimpulan dari hasil penelitian yaitu intensitas pencahayaan buatan terhadap pekerja penjahitdi pasar Wonomulyo rata-rata tidak optimal dan kurang efisien. Sarannya untuk lebih memperhatikan penempatan para pekerja yang membutuhkan ketelitian dan ruang kerja kecil padat harus disiasati dengan mendesain penataan ruang secara tepat.

Abstract

AbstractThis essay analyzes philanthropic contributions in Indonesia and Malaysia, two nations with extremely different cultural histories, with a focus on literary studies. In the essay, the concept of charity is discussed along with how it has influenced Islamic culture in the two countries. Additionally, it examines the effects of historical, religious, and sociocultural contexts on the parallels and differences between Malaysian and Indonesian philanthropic cultures. The ideas of sadaqah, zakat, and waqf all include charitable giving in Indonesia; amal jariah and baitulmal do the same in Malaysia. Despite the fact that they approach philanthropy in different ways, both Indonesia and Malaysia have been able to establish exceptional initiatives that have a significant impact on society. Some of the challenges involved in putting philanthropy into practice in Indonesia and Malaysia, including a lack of collaboration between philanthropic groups and the government and a lack of accountability and transparency in the administration of philanthropic funding. Finally, this study provides a fascinating comparison of the significance of generosity in Malaysia and Indonesia, twonations with very different cultural traditions. The report addresses case examples of philanthropy in health and education, as well as the challenges that both countries faced when philanthropy was implemented.Keywords : Indonesia, Malaysia, Philanthropic AbstrakEsai ini menganalisis kontribusi filantropi di Indonesia dan Malaysia, dua negara dengan sejarah budaya yang sangat berbeda, dengan fokus pada studi sastra. Dalam esai ini, konsep amal dibahas bersama dengan bagaimana hal tersebut mempengaruhi budaya Islam di kedua negara. Selain itu, esai ini juga mengkaji pengaruh konteks sejarah, agama, dan sosiokultural terhadap persamaan dan perbedaan budaya filantropi Malaysia dan Indonesia. Di Indonesia, gagasan sedekah, zakat, dan wakaf mencakup pemberian amal; di Malaysia, amal jariah dan baitulmal melakukan hal yang sama. Terlepas dari kenyataan bahwa mereka melakukan pendekatan filantropi dengan cara yang berbeda, baik Indonesia maupun Malaysia telah mampu membangun inisiatif luar biasa yang memiliki dampak signifikan pada masyarakat. Beberapa tantangan yang dihadapi dalam mempraktikkan filantropi di Indonesia dan Malaysia adalah kurangnya kolaborasi antara kelompok-kelompok filantropi dan pemerintah serta kurangnya akuntabilitas dan transparansi dalam pengelolaan dana filantropi. Akhirnya, penelitian ini memberikan perbandingan yang menarik tentang pentingnya kedermawanan di Malaysia dan Indonesia, dua negara dengan tradisi budaya yang sangat berbeda. Laporan ini membahas contoh-contoh kasus filantropi di bidang kesehatan dan pendidikan, serta tantangan yang dihadapi kedua negara ketika filantropi diimplementasikan. Abstract

Public welfare is one aspect that must be considered by every country with various policies, but it is still not able to be implemented properly and effectively. The emergence of zakat institutions such as BAZNAS to optimize zakat funds so that they can minimize poverty and can improve the economy in society. In this case, Islam has obligated Muslims to pay zakat to achieve prosperity. The purpose of this study is to discuss the role of Zakat in improving the community's economy. This research method uses descriptive qualitative based on previous literature. The results of this study are that the role of the National Amil Zakat Agency (BAZNAS) has been carried out optimally from the collection process to distribution to the community by looking at the results from the past few years, but it is still not optimal.

Abstract

There are many problems in the Kecil community, namely the lowest level, AMD, and reversed financing. Ultra-Micro financing is here to provide solutions to the lower classes of society who need capital loans. This financing is regulated by Fatwa of the National Sharia Council No. 119/DSN-MUI/II/2018. This study aims to discover how the practices, mechanisms, and governance of ultra-micro financing follow sharia. The method used in this research is the empirical observation method and the literature research method. First, gather various reading sources, such as newspapers and articles. The study concluded that the channelling institution is an Islamic financial institution following DSN MUI Fatwa No 119/DSN-MUI/II/2018. The source of Super Micro Financing funds is the DSN MUI fatwa, the practice of unlawful interest. The source of Super Micro Financing funds is the DSN MUI fatwa, the method of unlawful interest. Determination of profit margins in the DSN MUI fatwa No 119/DSN-MUI/II/2018 uses the concept of profit sharing and is based on a predetermined contract. Supermicro Financing dispute resolution, according to DSN MUI fatwa No 119/DSN-MUI/II/2018, Dispute settlement is carried out through a Sharia-based dispute resolution institution.

Abstract

Studi ini bertujuan untuk mengetahui makna harta dan ruang lingkupnya, pembagian harta dan jenis-jenisnya, fungsi harta, dasar-dasar kepemilikan, serta posisi harta dalam maqashid syariah. Metode penelitian ini menggabungkan data dari penelitian sebelumnya dan teori-teori yang relevan dengan subjek tersebut. Hasilnya adalah harta memiliki nilai dan bentuk nyata yang disukai manusia, dapat dimiliki, disimpan, dan digunakan secara sah menurut syariah untuk berbagai tujuan seperti bisnis, pinjaman, dan konsumsi. Allah sebagai pemilik sejati harta memberikan pedoman untuk kemaslahatan umat manusia, yang mencakup pemeliharaan lima tujuan dasar. Studi ini hanya mengkaji definisi harta dan jenis-jenisnya, pembagian harta dan jenis-jenisnya, tujuan harta dan dasar kepemilikannya, serta posisinya dalam maqashid syariah. Studi ini sangat berguna untuk penelitian tambahan, terutama yang terkait dengan definisi harta dan ruang lingkupnya, pembagian harta dan jenis-jenisnya, fungsi harta, prinsip kepemilikan, serta posisinya dalam maqashid syariah.

Abstract

This research is normativ research which is part of libery research. In this research we will examine cash waqf which is not far from the existing problem formulation. That is how the role of the UNISIA cash waqf institution in making cash waqf a success as well progress in developing the community’s economy? And what is the maqashid of cash waqf as a community empowerer from the perspective of Ibn’Assyria’s maqashid?. Results research shows that in indonesia itself it is allowed to exist cash waqf or cash waqf with the emergence of the MUI fatwa regarding cash waqf and the existence of statutory regulations such as the waqf law no. 41 of 2004 as well some other rules. The ull waqf board foundation also launched the institute UNISIA cash waqf of december 22 2021,which is expected to progress helping the community’s economy such as empowering MSMES, education, and other economic sectors of society. Maqashid based analysis Ibn’Asyur in this case shows that there are two maqashid carried out in cash practice. First, Maqashid khassah is in the form of hifz almal which makes waqf objects more productive. Second, maqashid ammah in the form of universal benefit in economic empowerment community allocated to education, health, places of worship and things other social.

Abstract

Economic growth in a region is influenced by investment. So that the existence of business actors either on a macro or micro scale contributes to subsequent economic growth. Therefore, the government must be responsible for the investment process so that all parts of society benefit from investment. This research argues that an adequate licensing system is interesting to study. This is because an adequate licensing system has a huge impact. For example, investment growth can increase the amount of goods or services sold, create added value, increase labor, and other economic resources. One of the objectives of this research is to find the strategies used by the efforts of the One-Stop Investment and Integrated Services Agency (DPMPTSP) in increasing investment in Jember Regency. In addition, this study also wanted to find out the factors that support and hinder the efforts of the One-Stop Investment and Integrated Services Office to increase investment in Jember Regency. The results of this study state that the Jember Regency government has created an investment strategy and improved the quality and skills of the community through training. Investors and businesses will better understand their responsibilities to report investment activities and conduct complete investment promotion activities. An additional strategy proposed by the DPMPTS of Jember Regency is local regulations relating to the investment sector. This research uses Brayson's theory explaining that strategic planning is conducted using five indicators: establishing the vision, mission and goals of the organization; conducting an analysis of the internal and external environment; finding strategic issues; and then creating a strategy. The conclusion shows that of the five measurement criteria four of them run satisfactorily. While one of them is not good, namely the strategy developed by DPMPTSP Jember Regency is less than optimal as in the case of the absence of local regulations that can support future investment, the absence of a potential map and opportunity map, as well as limited internal and external human resources.

Abstract

This concept cannot yet be a universal measure of human development. The Islamic human development index (I-HDI) is here to offer a concept for measuring human development based on maqāṣid al-sharī‘ah. The research aims to analyze economic growth in mediating the influence of government spending on the education, health, and social sectors, open unemployment, and consumption patterns on I-HDI and HDI. The research results of government spending on the education, health, and social sectors as well as consumption patterns is positive and significant, while economic growth and the Open Unemployment Rate (TPT) have a positive but not significant effect on I-HDI. Meanwhile, government spending on the health sector, social sector, and consumption patterns have a positive and significant effect, government spending on the education sector has a negative and insignificant effect, and economic growth and TPT have a positive and insignificant effect on HDI. The magnitude of the direct influence on IHDI is 53.04 percent and on HDI is 59.71 percent. Economic growth as an intervening variable is unable to mediate the influence of government spending on the education sector, government spending on the health sector, government spending on the social sector, TPT, and consumption on I-HDI and HDI.
