Abstract

There have always been ups and downs in regional governance, with a number of autonomy issues and less-than-perfect institutional working relationships between the Centre and the regions. Instead of being resolved by the 2014 Local Government Law, Law No. 23/2014, these issues have further complicated the relationship between local authorities and the central government. This research aims to analyze the review of the principles of regional government and the implementation of the SOTK. This research uses a normative juridical method that focuses on legal precedents, relevant laws, and regulations. The result of this research is that regional autonomy is based on the idea that autonomous regions have the authority as well as the rights and obligations in managing their own local interests in accordance with the law. In Indonesia, local governance is guided by three basic principles, namely 1) The principle of decentralization. 2) The idea behind de-concentration. 3) Assistance tasks as a concept. There are three parts to the model of how local governments and the federal government work together, namely 1) agency model, 2) the interaction Model, and 3) the relative Autonomy Model The structure of each region will include various interventions. However, the drafting guidelines from the government make the SOTK look uniform, centralized and rigid, so despite the differences, each region's SOTK still has some similarities.

Abstract

Plastic waste is a global problem that is increasing every year because it is difficult to decompose. This article discusses the growth in waste volume in Indonesia which is triggered by population growth, urbanization, and changes in consumption patterns, as well as the main challenges in waste management at the Bantargebang TPST. Through a qualitative approach and case studies, this article highlights the need for a comprehensive approach to waste management, including the establishment of waste banks and increasing public awareness. The main challenges at the Bantargebang TPST include decreasing capacity and difficulties in handling single-use plastic waste. The proposed solutions include expanding TPST capacity, implementing environmentally friendly technology, increasing public awareness, developing adequate infrastructure, and greater funding allocation. Collaboration between the government, the private sector and the community is the key to overcoming this challenge and building a sustainable and environmentally friendly waste management system at the Bantargebang TPST.

Abstract

Prinsip non ultra petita merupakan salah satu asas penting dalam hukum acara perdata, termasuk dalam sistem peradilan agama di Indonesia. Penelitian ini bertujuan untuk menganalisis apakah putusan Nomor 2588/Pdt.G/2024/PA.Smg mengandung unsur ultra petita dan bagaimana implikasi hukumnya menurut hukum acara perdata Islam. Berdasarkan kajian yuridis normatif terhadap putusan tersebut dan prinsip-prinsip hukum acara, ditemukan indikasi pelanggaran terhadap asas non ultra petita, yang berpotensi mengakibatkan batalnya putusan. Makalah ini menekankan pentingnya hakim dalam menjaga batasan kewenangannya demi menjamin keadilan prosedural dalam sistem peradilan Islam di Indonesia.

Abstract

  Balap liar remaja merupakan fenomena sosial yang mengandung dimensi hukum dan moral yang kompleks. Meskipun Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan telah secara tegas melarang praktik balap liar dan menetapkan sanksi, implementasi hukumnya masih belum efektif karena berbagai kendala struktural dan kultural. Penelitian ini menggunakan pendekatan kualitatif dengan analisis hukum, observasi lapangan, dan kajian literatur untuk mengevaluasi efektivitas penegakan hukum terhadap balap liar di kalangan remaja. Hasil studi menunjukkan bahwa faktor sosiologis (lingkungan pergaulan) dan psikologis (pencarian identitas, pengaruh teman sebaya, serta unsur perjudian) turut menjadi pendorong utama perilaku ini. Penanganan balap liar remaja memerlukan pendekatan yang tidak hanya represif, tetapi juga preventif dan edukatif, melalui sinergi antara penegakan hukum, pendidikan karakter, peran keluarga, dan pengawasan sosial masyarakat.

Abstract

The Quick Response Code Indonesian Standard (QRIS) is a national payment standard based on QR codes established by Bank Indonesia to simplify, accelerate, and secure digital transactions. However, in practice, several business actors impose additional administrative fees on consumers for each QRIS transaction. In fact, costs such as the Merchant Discount Rate (MDR) and settlement fees should be the responsibility of the merchants, not the consumers. The imposition of these additional fees without clear notification violates consumer protection principles as stipulated in Law Number 8 of 1999 concerning Consumer Protection, particularly Articles 4 and 7, which guarantee the rights to comfort, security, accurate information, and fair treatment. This study aims to analyze, from a juridical perspective, the practice of imposing QRIS administrative fees by certain business actors under the applicable legal framework in Indonesia. The method used is a normative legal approach through library research of relevant legislation and Bank Indonesia’s technical policies. The results of this study are expected to strengthen the understanding of business actors’ obligations and consumers' rights, as well as provide concrete recommendations to establish a fair, transparent, and legally compliant digital transaction system. Quick Response Code Indonesian Standard (QRIS) adalah standar nasional pembayaran berbasis QR Code yang ditetapkan oleh Bank Indonesia untuk mempermudah, mempercepat, dan mengamankan transaksi digital. Namun, dalam praktiknya, sejumlah pelaku usaha membebankan biaya administrasi tambahan kepada konsumen dalam setiap transaksi QRIS. Padahal, biaya seperti Merchant Discount Rate (MDR) dan biaya settlement seharusnya menjadi tanggung jawab pelaku usaha, bukan dibebankan kepada konsumen. Pengenaan biaya tambahan tersebut tanpa pemberitahuan yang jelas melanggar prinsip perlindungan konsumen sebagaimana diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, khususnya Pasal 4 dan Pasal 7 yang menjamin hak atas kenyamanan, keamanan, informasi yang benar, serta perlakuan yang adil. Kajian ini dilakukan untuk menganalisis secara yuridis praktek pengenaan biaya administrasi QRIS oleh oknum pelaku usaha dalam perspektif hukum yang berlaku di Indonesia. Metode yang digunakan adalah pendekatan normatif melalui studi kepustakaan terhadap peraturan perundang-undangan dan kebijakan teknis dari Bank Indonesia. Hasil kajian ini diharapkan dapat memperkuat pemahaman mengenai kewajiban pelaku usaha dan hak-hak konsumen, serta memberikan rekomendasi konkret guna menciptakan sistem transaksi digital yang adil, transparan, dan sesuai dengan hukum.
