Abstract

The meeting of foreign elements resulted from a relationship between foreign citizens (WNA) and Indonesian citizens (WNI) which resulted in the occurrence of International Private Law. Until now, the problem that can occur due to the existence of these two elements is regarding the status of children from extramarital relationships between foreigners and Indonesian citizens. This will happen because there are many considerations regarding the child's status, such as the laws of the country where the child was born and the laws of the country where both parents come from. There are a number of countries that adopt the jus soli principle, which means that the child will be considered a citizen of the country where he was born. This is different from other countries that apply the jus sanguinis principle, which means that the child will obtain citizenship status from one or both parents, regardless of where the child was born. Seeing this problem, this research discusses the status of the child if this occurs because a relationship is not registered as a marriage relationship. Then there is another discussion regarding the distribution of inheritance if the marriage relationship is not recorded. In this research, the method applied is the normative juridical method by looking at existing data and presenting it descriptively. It is hoped that with this research readers will be able to understand and add information related to the research.

Abstract

Mutilasi adalah tindakan yang dilakukan dengan membuat korban mati dengan cara membunuhnya kemudian dilakukan tindakan pemotongan pada bagian tubuh korban. Tujuan dari tindakan mutilasi ini yaitu untuk menghilangkan jejak dari tindakan pembunuhan yang dilakukan oleh pelaku. Tindak pidana mutilasi ini diatur dalam Kitab Undang-Undang Hukum Pidana (KUHP) Pasal 338 dan Pasal 340, peraturan tersebut menjadi dasar penjatuhan hukuman bagi pelaku tindak pidana mutilasi. Namun pasal tersebut tidak dengan rinci menjelaskan mengenai mutilasi, hal ini karena belum ada aturan yang secara jelas dan spesifik mengatur mengenai tindak pidana mutilasi ini dan masih tergabung dalam tindak pidana pembunuhan biasa dan tindak pidana pembunuhan berencana. Penulisan ini bertujuan untuk mengetahui pertimbangan hukum yang digunakan oleh jaksa penuntut umum dalam melakukan penuntutan terhadap pelaku tindak pidana mutilasi dalam kasus pidana Nomor 634/Pid.B/2023/PN.Smn. Penulisan ini dilakukan dengan metode penelitian yuridis normatif, yang dilakukan dengan menelaah peraturan perundang-undangan primer dan sekunder dan dilakukan dengan pendekatan kasus. Jenis data yang digunakan dalam penulisan yaitu jenis data primer dan sekunder. Jenis data primer yaitu data diperoleh secara langsung dan jenis data sekunder yaitu data diperoleh dengan secara tidak langsung dari sumbernya melainkan dengan studi pustaka. Hasil dari penulisan ini yaitu berkaitan dengan pertimbangan hukum yang digunakan oleh jaksa penuntut umum dalam melakukan penuntutan hukuman mati terhadap para Terdakwa dalam kasus pidana Nomor 634/Pid.B/2023/PN.Smn.

Abstract

The existence of household assistants (ART) is often ignored in labor laws in many countries, including Indonesia. This results in unfair treatment and minimal access for household members to legal protection, which increases the risk of violence against them. This violence includes verbal, physical and sexual harassment, but is difficult for household members to report due to limited legal knowledge and fear of retaliation. Social stigma and lack of support also exacerbate the situation, leaving many cases of violence unreported and perpetrators unaccounted for. This research aims to increase awareness of the importance of legal protection for household members, evaluate the implementation of labor laws, and encourage regulatory changes to expand protection. The research method uses a qualitative and descriptive approach through literature study. The research results show that legal protection for household members in Indonesia is still weak and ineffective, especially because household members are not explicitly regulated in labor law. Key barriers include a lack of rights awareness, training of law enforcement officers, and a culture of amicable resolution of violence. Better legal protection for household members needs to be implemented immediately through the ratification of the Domestic Workers Protection Bill, educational campaigns and training for law enforcement officers. Strong family, community and political support is also needed to create a safer and fairer environment for ART.
