Abstract

Abstract

This study aims to explore the differences in perspective between the Right to be Forgotten (RtbF) principle and the records management principles contained in the Records Retention Schedule (JRA). The focus of research is on efforts to harmonize the RtbF principle in Law No. 27 of 2022 on Personal Data Protection (PDP Law) and the JRA to ensure that personal record management complies with the new privacy regulations. The PDP Law recognizes the RtbF principle allowing individuals to request the deletion of their personal information. This principle significantly impacts the concept of privacy in record management but is potentially contradictory to the record management principles outlined in the JRA due to differing views on the retention period of personal records. This study employs an argumentative literature review method based on an interdisciplinary approach. The data analysis process begins with the selection of literature, followed by comprehensive reading and evaluation of selected literature from an inclusive perspective according to the research theme, and then summarizing, analyzing in depth, and critically synthesizing. The findings of this study indicate the need for harmonization in the implementation of the RtbF principle in the drafting of the JRA requiring consideration of user consent, privacy policy, and the categorization and classification levels of RtbF. Therefore, the development of JRA policies requires harmonization with the RtbF principle to accommodate both principles without violating each other, avoiding legal disputes, and breaching existing policies. Thus, a comprehensive examination of the RtbF principle and its relevance to archival science is necessary to support legal certainty in record management activities.

Abstract

This study highlights the importance of aligning the Right to be Forgotten (RtbF) with personal data protection (PDP) policies and emphasizes the need for further research on its practical implementation in records management. While RtbF represents a strategic step toward safeguarding digital privacy, its application remains challenging due to the need to balance individual rights with organizational obligations to retain records in compliance with regulations. Using a quantitative approach, data were collected through an online survey involving 66 Indonesian Records Management Professionals Association (P3RI) members and analyzed using SPSS with chi-square tests. The findings reveal that 90% of respondents acknowledge the importance of PDP, and 85% oppose data processing without consent. Furthermore, 48.5% support the implementation of RtbF in records management (mean score: 3.3182), 51.5% report difficulties in deleting data during retention periods, and 50% (mean score: 1.7727) doubt the feasibility of its implementation within organizations. This study offers an initial contribution to shaping policy direction and practical frameworks for RtbF implementation in the Indonesian archival context.

Abstract

Personal archives not only serve an administrative function, but also contain memories, identities, and agencies closely related to human rights. Therefore, personal archives give individuals the control to determine whether they want to be remembered or forgotten, because not all individuals want to be part of the collective memory. So, the Right to be Forgotten (RtbF) is present as the individual’s right to delete their personal information and as a form of antithesis to archive management, while challenging the dominance of the narrative of archival institutions as epistemes and controllers of collective memory. This study aims to reinterpret RtbF through the lens of Foucault’s discourse to reveal the relationship between knowledge and power in the context of personal archive management practices. In this study, Foucault's discourse analysis approach is used to illustrate how the RtbF principle provides a space of control for data subjects over their personal archives. The results of the study show that RtbF becomes both a legal instrument and an ethical discourse that disrupts the hegemony of archival institutions, while strengthening individual autonomy as data subjects. This concept emphasizes that personal archives are not merely repositories of information, but also representations of private rights that must be protected within the framework of personal data protection. This study emphasizes the importance of harmonizing RtbF with archival activities, so that a design policy is needed that can accommodate individual rights over their personal data in archival activities.

Abstract

This research discusses the compliance of PT X's Office Letter Automation (OLA) system with the functional requirements for controlling access rights based on ISO 16175-2 2011. PT X has been using the system since 2019, OLA is a web-based application used to control correspondence and other activities. Electronic records management in PT X. This research aims to identify whether OLA meets EDRMS standards related to access rights or access control. This research uses a qualitative approach by studying literature and making observations to identify the implementation accuracy according to the ISO 16175-2:2011 standard requirements, which is examined with OLA as the research object. The research results show that of the 17-access control functional requirements, OLA can fulfill 16 mandatory requirements. So, it does not meet the minimum standards required by the standards and is included in the major findings. For this reason, organizations need to take corrective and preventive actions so that OLA can comply with the ISO 16175-2 2011 standard requirements. However, overall, OLA is good enough to support electronic security management activities, especially for security systems in the access rights section.
