Abstract

In Indonesia, the regulation of oil and gas affairs is an important focus regarding the division of authority between the central and local governments. The central government has control over national policies and contracts, while local governments are responsible for local planning and tax revenue. Disputes often arise over royalties, taxes and environmental responsibilities. The solution lies in solid cooperation between the two parties, ensuring that both national and local interests are met fairly. With this collaborative approach, Indonesia can derive optimal benefits from the oil and gas sector while being mindful of sustainability and shared prosperity.Keywords: Oil and Gas, Division of authority, Governance

Abstract

This study reviews the legal regulations on land certificates and the resolution of multiple certificates. The research method used is legal analysis with a focus on Indonesian agrarian law. Key challenges include a lack of public understanding of registration rules and regulatory weaknesses, which trigger complex disputes. Solutions include the monitoring of land registration maps and the process of certificate transfer. Dispute resolution can be through deliberation, arbitration, or court. Further efforts from BPN are needed to ensure the validity of land data for fair and effective dispute resolution.

Abstract

AbstractThe ease of filing a bankruptcy petition in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (Bankruptcy Law PKPU) creates vulnerabilities for public companies, even though the public companies have good intentions and healthy financial conditions. The absence of insolvency test regulations creates a legal vacuum that has the potential to be misused by creditors. This study aims to examine the urgency of implementing an insolvency test in Indonesian bankruptcy law and to analyze the need for legal protection for public companies that are still solvent from the potential misuse of bankruptcy petitions through the application of an insolvency test. The research method used is normative law, which uses a legal norm system, which includes research on legal principles and legal rules, in addition this study uses a descriptive inductive approach. Public companies whose shares are owned by many investors need legal protection so that the shareholder community is also protected. The use of insolvency tests such as the balance sheet insolvency and cash flow insolvency methods can be an objective basis for the court in deciding on bankruptcy petitions against public companies. The absence of regulation on insolvency test in Bankruptcy Law PKPU is the impetus to reform bankruptcy law in Indonesia. Therefore, there needs to be a provision that requires bankruptcy test before a public company can be filed for bankruptcy, to ensure that its financial condition is truly insolvent. Keywords: Public Company; Bankruptcy; Insolvency Test.

Abstract

Land as a social asset is a means of binding unity among the social environment for life and living, while land as a capital asset is as capital in development and has grown as a very important economic object as well as a material for commerce and an object of speculation. Development activities, especially development in the material sector both in cities and villages, require a lot of land as a shelter for development activities. This research aims to examine the spatial legal perception of land disputes against the public interest of outsiders. The typology of this research is descriptive analysis which aims to describe, inventory, and analyse the actual conditions of the study of spatial law to resolve land disputes through library research (library reseach) with emphasis on secondary data sources. The results of the study of Law Number 26 of 2007 concerning Spatial Planning are the legal basis for the government to organise space in the context of national development. Land disputes that occur due to spatial planning issues can involve the government, private parties, and the community. The court is an institution that can resolve land disputes in various ways, such as mediation or through court decisions. Therefore, it is important for communities to understand the legal basis of spatial planning in order to protect their land ownership rights.
